 Criminal cases are precedents because criminal encounters vary and are carried out by

persons with varying purposes; hence, their judgment should differ and cannot be

founded on a stare decisis.

employee and an employer, rendering stare decisis irrelevant in such circumstances.

Precedent is essential in the judicial process since it guarantees legal certainty.

 People may organize their business and reach agreements with more trust when the result

of a lawsuit can be anticipated by reference to prior court rulings. It ensures judges'

impartiality and openness.
