WHEREAS, Section 2, paragraph (1), Article XIV of the 1987 Constitutions, the state shall “establish,
maintain and support a complete adequate and integrated system of education relevant to the needs of the
people and society”;
WHEREAS, Section 36, Batas Pambansa Bilang 232 or also known as the Education Act of 1982
mandates that, Provinces, Cities and Municipalities and Barangays shall appropriate funds in their annual
budgets for the operation and maintenance of public secondary schools on the basis of national fund
participation;
WHEREAS, Section 41, of the same Batas Pambansa, also mandates that, the government, in
recognition of their complementary role in the educational system, may provide aid to the programs of private
schools in the form of grants or scholarships, or loans from government financial institutions: Provided, That
such programs meet certain defined educational requirements and standards and contribute to the attainment of
national development goals;
WHEREAS, the Department of Education (DepEd) launches Brigada Eskwela as its annual school
maintenance program aimed to engage all education stakeholders to contribute their time, effort, expertise and
resources to ensure that the school campus will be safe for the school-children as they go back to school;
WHEREAS, this distinctive way of engaging the community is pursuant to the saying that "it takes a
whole village to train and nurture a child" and is expected to improve not only the school itself but also the
students who will be inspired to be active and productive citizens of the society in return;
WHEREAS, the local government of Vintar recognizes the policy of the State to give priority to
education, science and technology, arts, culture, and sports to foster patriotism and nationalism, accelerate
social progress, and promote total human liberation and development;
CHAPTER I
TITLE
Section 1. TITLE. This ordinance shall be known as the “BRIGADA ESKWELA ORDINANCE”
CHAPTER II
OBJECTIVE AND COVERAGE
Section 2. OBJECTIVE. To assist the public schools in keeping school-children in school by making the
start of classes exciting and as safe as possible.
Section 3. COVERAGE. This Ordinance shall apply to all public schools within the territorial
jurisdiction of the Municipal Government of Vintar.
CHAPTER III
DEFINITION OF TERMS
Section 4. DEFINITION OF TERMS. As used in this Ordinance, the terms below have the meanings
ascribed to them in this section. Any words or terms not defined shall be given their plain and
customary meanings, unless the context requires otherwise, and shall be interpreted in a
manner consistent with the purpose and spirit of this Ordinance.
1. Brigada Eskwela - refers to the annual school maintenance program of the Department of
Education.
2. Community Participation - refers to widest support of the Barangay residents through the
Barangay Council members, Purok Officials, Non-government and People's Organizations,
Civil Society Organizations, including cooperatives, accredited or recognized by the
Sangguniang Panlungsod, actively participating in Brigada Eskwela activities.
3. Public Schools - refer to schools operated by the Department of Education within the
jurisdiction of the Municipality of Vintar.
4. Task Force Brigada Eskwela — a group of individuals representing the Department of
Education, Municipal Government of Vintar, All Barangay Governments within the
municipality, Community Parents and Teachers Association, with support staff and
Secretariat from the DepEd herein created with specific duties and functions.
CHAPTER IV
BUDGET UTILIZATION
Section 6. AVAILMENT OF SUPPORT. For purposes of availing the support abovementioned, the
activity design shall be prepared by the Task Force Brigada Eskwela through the Secretariat
chosen by the Department of Education as to the utilization of the amount allocated for
approval and release by the Local Government of Vintar subject to accounting and auditing
rules and regulations.
CHAPTER V
THE CREATION OF MUNICIPAL TASK FORCE BRIGADA ESKWELA
Section 7. THE MUNICIPAL TASK FORCE BRIGADA ESKWELA. The Executive Officer shall
form a Municipal Task Force Brigada Eskwela, composed of the following;
1. Prepare Activity design containing, among others, the specific activities sought to be
undertaken for Brigada Eskwela and the materials to be procured; strategize full community
participation in every barangay;
2. Facilitate the conduct of Search for Best Community Participation in Brigada Eskwela
Program;
3. Monitor and evaluate the extent of implementation of the program;
4. Recommend policy changes to enhance Brigada Eskwela program for appropriate action by
the DepEd and Municipal Government of Vintar;
5. Submit annual post-activity report to the Municipality Government through the Office of
the Municipality Mayor, Sangguniang Bayan and the Department of Education – School
Division of Ilocos Norte, showing, among others, how the support funds were used, extent
of community participation, and the same shall be posted in three (3) conspicuous places in
the Municipality.
6. Perform such other related functions and those that may be assigned by the Municipal
Mayor and Division Superintendent or District Supervisors.
CHAPTER VI
PROVISION OF IMPLEMENTATION
Section 10. SUPPORT OF THE BARANGAYS. All Barangays shall be required to allocate funds in
support to the implementation of Brigada Eskwela program in their respective Barangays. For
this purpose, the Local Finance Committee of the Municipality of Vintar is hereby directed to
include in the initial review of the Annual Budget of every Barangay compliance with the
provision of this Section to form part of its comments and recommendation to the Sangguniang
Bayan.

Section 11. JOINT IMPLEMENTATION. To carry out the purpose of this Ordinance, the Municipal
Mayor is hereby authorized to issue appropriate orders, including the determination of
members of the Task Force Brigada Eskwela to represent the Municipal Government.
CHAPTER VIII
Miscellaneous Provisions
Section 11. REPEALING CLAUSE. This Municipal Ordinance is hereby repealed, amended, or
modified to the extent that it conflicts with any other ordinances, executive orders, or local
policies.
Section 12. SEPARABILITY CLAUSE. The other provisions of this municipal ordinance shall remain in
full force and effect even if one or more of its provisions are found to be unconstitutional or in
conflict with any law.
Section 13. EFFECTIVITY. Effectivity Clause. After complying with the requirements on public hearing,
this Ordinance shall take effect fifteen (15) days after its publication in a newspaper of local or
general circulation or posting in at least two (2) conspicuous places in the Municipality.
