MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This MEMORANDUM OF AGREEMENT (MOA) entered into by and between

METROCENTRE HOTEL AND CONVENTION CENTER (METROCENTRE), a private entity
duly organized and existing under Philippine Laws with principal office address at CPG Ave.,
Tagbilaran City, Bohol, duly represented herein by its General Manager, MS. GRETEL MARIE
ONG and HOLY NAME UNIVERSITY - TAGBILARAN (HNU), a duly registered educational
institution with principal office address at Dampas District, Tagbilaran City, Bohol,
represented herein by its President, FR. RUEL F. LERO, SVD;

W I T N E S S E T H: T H A T;

WHEREAS, HNU formally endorses its BACHELOR OF SCIENCE IN HOSPITALITY

MANAGEMENT and BACHELOR OF SCIENCE IN TOURISM MANAGEMENT students for
“On-The-Job Training Program” (OJT) during the regular school term in accordance with its
existing curriculum as approved by the Commission on Higher Education (CHED);

WHEREAS, METROCENTRE agrees to accept and accommodate the recommended

students by HNU for OJT and instruction with provisions for adequate and appropriate
materials, facilities and other work-related experience;

NOW THEREFORE, FOR AND IN CONSIDERATION OF THE FOREGOING PREMISES

and of the MUTUAL COVENANTS set forth hereunder, METROCENTRE hereby agrees to
accept and accommodate the recommended students by HNU for OJT, subject to the following
terms and conditions to wit:

1. That METROCENTRE will provide on-the-job training to HNU students in

Practicum Programs. Details of the training will be discussed by designated faculty
coordinator to the student trainees before deployment. Orientation to trainees
METROCENTRE shall likewise be provided;
2. That HNU and each and every student accepted by METROCENTRE shall hold
METROCENTRE, its officials and employees free and harmless from and against any and all
claims of injuries, death, damage to property, and liabilities in consequence of resulting from
negligence or error, or omission of a student trainee, while in the course;
3. That students have to render at least 600 hours of duty at a minimum of 40
hours and maximum of 60 hours a week or a minimum of 8 hours and a maximum of 10
hours a day provided that METROCENTRE shall exercise control and supervision of the
student trainees while they are in the workplace;
4. That METROCENTRE shall assign the students to undertake and perform on-
the-job training activities which are related to the course as may be accommodated.
METROCENTRE however may reassign student trainees as the need arises;
5. That METROCENTRE is not obliged to compensate or remunerate the student
trainess for the services while on OJT. Nothing in this MOA shall be construed as establishing
an Employer-Employee relationship between METROCENTRE and the student trainees;
6. That student trainees are required to comply with all the existing rules, policies,
restrictions and directives METROCENTRE those governing order and discipline, honesty,
safety and security, working hours, working attire or uniforms, breaks and rest periods, work
assignments and SOPs, use of company properties and access to matters of confidentiality,
and such other prescriptions deemed necessary in the conduct of METROCENTRE business;
7. That METROCENTRE shall issue a certification to certify the number of hours
each student had rendered for the on-the-job training;
8. That METROCENTRE does not guarantee employment to the student trainees
following the specified training period and reserves the right to terminate a student trainee for
violation of any of the rules and regulations implemented by METROCENTRE during the
training period without prejudice to the availment of other remedies available to
METROCENTRE under existing laws and regulations;
9. That METROCENTRE shall allow designated faculty coordinator of HNU to visit
METROCENTRE RESORT and the student trainees for feedbacking sessions.
METROCENTRE shall maintain, preserve and make available student trainee records under
this agreement;
10. That the term of this agreement will be from SEPTEMBER 2022 to JULY 2022.
 IN WITNESS WHEREOF, the authorized signatories of the parties have signed these
