MEMORANDUM OF AGREEMENT

  KNOW ALL MEN BY THESE PRESENT:


 
This Memorandum of Agreement made and executed between:

 Bureau of Plant Industry, a Government Agency duly organized and existing under Philippine Laws
with office address at 692 San Andres Street Malate, Manila, represented herein by GERALD GLENN
F. PANGANIBAN, Ph.D., hereinafter referred to as the First Party.
 
and

Bataan Peninsula State University, a non-stock, non-profit educational institution, duly organized
and existing under Philippine Laws with office/business address at Bangkal, Abucay 2114 Bataan
representing the University/College by WALTER G. VALDEZ, Ph.D., hereinafter referred to as the
Second Party.

-WITNESSETH-
 
The parties hereby bind themselves to undertake a Memorandum of Agreement for the purpose of
supporting the UNIVERSITY’S/COLLEGE’S on-the-job training for students-trainee under the
following terms and conditions:
 
1. The UNIVERSITY/COLLEGE shall be responsible for briefing the on-the-job student-
trainees who intend to conduct practicum exposure in the Bureau as part of the
UNIVERSITY’S curriculum;

2. The UNIVERSITY/COLLEGE shall provide the on-the-job student-trainee the basic


orientation on work values, behavior, and discipline to ensure smooth cooperation with
the Bureau;

3. The UNIVERSITY/COLLEGE shall issue an official endorsement vouching for the well being
of the on-the-job student-trainee which shall be used by the Bureau for processing the
application of the student-trainee;

4. The UNIVERSITY/COLLEGE shall voluntarily withdraw a student-trainee who is found to


misbehave and/or act in defiance to existing standards, rules, and regulations of the
Bureau and impose necessary university sanctions to the said student-trainee;

5. There is no employer-employee relationship between the Bureau and the student/s-


trainee;

6. The duration of the program shall be equivalent to two hundred eighty (280) training
hours and upon completion, the Bureau shall issue a Certificate of Completion of the
accrued training hours of the student as agreed upon by the Bureau and the
UNIVERSITY/COLLEGE;

7. The STUDENT/S-TRAINEE shall secure a waiver signed by the parent/guardian and the
faculty-in-charge that the Bureau will not be held responsible for any untoward incident/s
that may occur during their training in this Bureau especially for trainees in laboratories,
fields etc.

8. The STUDENT/S-TRAINEE shall be personally responsible for any and all liabilities arising
from negligence in the performance of his/her duties and functions while under training;

9. The Bureau will not grant allowance and/or adequate insurance to student-trainee in
accordance with Malacañ ang Administrative Order No. 103 and existing rules and
regulations of the Bureau;

10. The Bureau, upon consultation with the UNIVERSITY/COLLEGE, may require qualified
students to submit themselves to examinations, interviews, and file pertinent documents
to support their application;

11. The Bureau is not obliged to employ student-trainee upon completion of the training;

12. Any violation of the foregoing covenants will warrant the cancellation of the Memorandum
of Agreement by the First Party within thirty (30) days upon notice to the Second Party;

13. This Memorandum of Agreement shall become effective upon signature of both parties
and implementation will begin immediately and shall continue to be valid upon the
completion of the required training hours of the students-trainee/s or unless otherwise
modified and amended by mutual consent of the parties; and

14. That the hereunder Students - Trainee has been approved by the BPI Management to
undergo On-the-Job training.
