Environmental and Social Management

This report presents a brief summary of the monthly activities and parameters for the
Environmental and Social implemented by INC on the project of Project: "Durres-Tirana
Railway Line Public Transport Terminal (PTT) and New Railway Line to Tirana International
Airport (TIA)"

1.1 Executive Summary of ES

During the month of February 2023 INC has not registered major incidents regarding the
Environmental and Social parameters.

- Major ES Accident statistics are zero (0).

During the month of February 2023 INC have implemented training sessions with the
workers for the improvement and increase the level of awareness of the Environmental and
Social among the workforce:

- A total of 6 hour of Environmental and Social training are implemented on site for
the month of February 2023.

1.2 Social – Project Workforce

During the month of February, the workforce that is implemented for the construction of the
Durres-Tirana Railway is presented in detailed way in the Sub-Clause 6.0 Record of
personnel (Project Monthly Report).
The project workforce is divided in three main categories:
- 26 Key Personnel – That are in charge for the management process of the project.
(6 international staff and 20 local staff from which 2 female staff).
- 168 Site and Production Personnel – That are the workforce in charge for the
implementation of the site activities.
- Subcontractor Personnel – That are the personnel of the subcontractors with
different categories of employees based on the activity that they are subcontracted.

1.3 Social – Labor and working conditions

During the month of February there is no registered any issue regarding the health and the
labor working conditions and no worker grievance registered. The contractor has created
the necessary facilities for the workers for the implementation of their activities in the
project. As a good will, the contractor has followed practices that engage local workers who
live near this project.

1.6 Contractor’s Engagement

The contractor before construction activities in the new working areas will implement
communication and engagement with the residents in order to deliver the correct
information for the construction activities for the project of rehabilitation works and improve
of the existing railway line Durres-Tirana, Public Transport Terminal (PTT) and the
implementation of the new connection to Rinas Tirana Airport.

The purpose of the resident engagement is to inform and involve public institutions
regarding the various complaints and problems that residents has along the segment where
the project will be implemented.
To ensure a functional plan in relation to stakeholder’s engagement, the contractor has
implemented the requirements of this plan by informing residents about the project of
"Rehabilitation of Durres - Tirana Public Transport Terminal (PTT) railway line and new
railway connection to Tirana International Airport (TIA)".

The issue of residential properties that have access by crossing the railway track and the
expansion of the track from the existing canals coming to the border of private properties
(according to the residents’ claims) are the main social topic during the month of February.
During the excavation, cleaning the canals and arranging the slopes in KP 4+700, 0+400,
20+250, 28+350 several issues have been raised regarding accesses properties. The only
way that they reach their homes is passing on the railway track without any other
alternative.
Referring to the above problem at KP 28+350, a meeting was held with the representative
of community to listen and record the request of access.

1.6.1 Grievances
During the month of February have been registered 3 grievances

1. KP 20+250 potential overlaps of the project with the property, Grievance No.20

2. KP 4+700 vehicle access required, Grievance No.21

3. KP 0+100-0+300 potential overlaps of the project with the property, Grievance No.22

The above-mentioned cases were registered during the month of February and were
forwarded to the Supervising Engineer to share them to the Company.
A dedicated meeting was held with each of the representatives, as well as receiving the
documentation, which was verified with the project.
After the verification according to the graphic documentation, the complete file has been
completed and is forwarded to the Supervision Engineer.

1.6.2 Potential Grievance

• At segment km 31+200 to 32+700 in the track of the railway line, unauthorized


vehicles access it by using it as a connecting road with other secondary urban
roads. A complaint has been communicated to HSH by the Administrator of

Administrative Unit no.11 Tirana, who presents the problem of using the project
railway track by local community as a traffic route causing disturbance, dust
generation and traffic. The contractor has communicated directly to set up a meeting
with the representative of Administrative Unit no. 11, but unable to coordinate with
his agenda, he has communicated to the contractor that it is necessary to take
measures to close this issue and the meeting could be held in a most suitable
moment. The Contractor is engaged in taking measures on the day the
communication was made and has closed the accesses at both ends of the segment
from 31+800 to 32+700, leaving open with the relevant signage, 600m, as a result of
the conflict (overlap) with Grievance No.19 (Access Required)./

• KP 24+600 – The community of Berxulle and the request for an underpass for the
passage of vehicles in this KP (A repeated complaint and already considered as un
directly issue of the contractor as long as it has a direct impacted causing delays in
contractor’s work activity)

• At km 2+200-2+420, a meeting was held with the residents, who were informed
about the works of the project for the rehabilitation of the Dr - Tr railway line, which
runs parallel to the houses of the "Hasan Prishtina" street. The apartments that were
built very close to the railway track on its left side, have a potential to lose access to
the entrance and exit by vehicle since the building has been build over the existing
canal (which is now not evident) being a few meters away from the existing axis. For
this reason, this issue has been considered as a potential grievance in order that
every

1.6.3 Minutes of Meeting with community


During the month of February, several meetings were held with the community in some
segments where there were issues to be seen closely and to inform the residents directly.
In the framework of the above issue (kp -0+638 to 0+600), the Contractor has held MoMs
regarding the access to the railway truck of the residents. The works in this segment are
intensive and the presence of the ESO has been continuous in order to provide as much
information as possible and to prevent the access of residents to the track of the railway
line which is under construction.

The contractor also during the works in socially sensitive areas has implemented a system
according to which he has developed Minutes of Meeting to get to know the of the residents
and the issues that they may have, referring to the works carried out in these areas and
how they have affected them in their lives.
During the month of February, the contractor held a few minutes of meeting, mainly
informing the residents not to access the railway track km -0+500 – 0+600 as there is
continuous work there and the risk of operating heavy machinery increases.

1.7 Action in progress

During the month of February, ES-HS, in accordance with the plans that has submitted,
continued with the implementation of measures for Environmental, Social and Health and
Safety issues at work. Also within the framework of the close out monitoring plan of the
experts agreed by the EBRD, those measures that needed improvement were
implemented according to the relevant reports as Corrected Actions with the below

On 02.02.2022, a meeting was held with the IESC where the all the contractor's activity

Corrective actions have been taken in accordance with the issues that have been
submitted for improvement in the Master Tracker drawn up by the IESC Specialists.
Dedicated meetings were held every Friday with the IESC monitoring group for the weekly
issues related to Health, Safety and Environment and Social.
All the documentation includes the corrective measures that the Contractor has taken in
the framework of all the issues that have been opened in the Master Tracker by the IESC
monitoring group. The Contractors engaged in the most effective way to be in accordance
to the EBRD standards and Albanian Legislation, starting from the implementation of HS –
ES plans and other supporting documents such as the Traffic Management Plan, Third
Part Management Plan etc.
In the close out meeting, the issues that will be improved by adding management
elements for both HS and ES were discussed.
On 03.02.2022, a final walkthrough was held where were seen all the measures that were
implemented on the site at the Durres station.

1.8 Environmental and Social Executed Activities

The environmental and social requirements are monitored on the construction site by the
contractor ES specialists on daily basis. During the month of February there are
implemented several activities in order to monitor and implement the Environmental and
Social Management Plan

The main activities implemented on site for the ES are presented below:
• Daily site visits at different working areas for monitoring activities and monitor the
excavation process and soil displacement according to the environmental
requirements.
• Considering the extension of the works, continuous announcements have been
made regarding road access.
• After the findings that were made near the rivers and streams, signage was added
to prevent access through them by the residents of the community. During the
periodic visits, MoM with PAPs Contractor has been held in order to inform them for
any possible affect or impact from the Project activities.
• Every issue related to the environment and social has been taken into consideration
and reported to the responsible person.
• Inspections to check if all the necessary measures are taken in the works carried
near residential areas and to present the appropriate information to avoid possible
conflicts.
• Periodic checks to maintain the project activities inside the footprint of the project in
order to prevent the damage of the vegetation outside this trail.
• Controlling the rules for the transport of the excavated material with the cover trucks
in order to not create air and environmental pollution during transportation process.
• Inspection of cases of leaks from machinery, to evidence the implementation of the
proper environmental equipment’s.
• Sensitization campaigns have been undertaken for the proper use of the Spill Kit
and for the cases of its use
• Periodic maintenance of the construction site and cleaning from harmful vegetation.

• The excavated material with good agricultural value will be temporarily stored within
the working area and reused during the process of planting /rehabilitation.
• Monitoring the excavation process and storage of the material for reuse.
• Monitoring processes that cause dust pollution and verification through checklists to
take mitigating measures.
• Monitoring the risk of spills during refueling of the heavy vehicles on site.
• Recommendations for water management through suction pumps in the nearest
discharge pipeline.
• All materials produced on-site and / or imported for working activities shall be
properly handled and stored by the Contractor
• Training activities for the Environmental in order to install a culture where the
workers will be able to understand and undertake their activities to minimize risk by
type of work activity.
• Communicating and informing residents who have direct access to the railway track
as the only way to access their homes.

2.1 Executive Summary of HS

During the month of February 2023 INC have not registered major incidents regarding the
Health and Safety parameters.

- Major HS Accident statistics are zero (0).

During the month of February 2023, INC has implemented training sessions with the
workers for raisin the awareness of the Health and Safety.

A total of 137 hours of health and safety training implemented on site and 35 hours of Tool
Box Talk delivered.

Based on the construction activities INC Health and Safety specialists have implemented

2.4 Health and Safety Executed Activities

The health and safety requirements are monitored on the construction site by the
contractor HS specialists on daily basis. During the month of February there are
implemented several activities in order to monitor and implement the Health and Safety
Plan.

Blocked access at segment 31+500 – 32+700


Grievance 24
At the segment of km 31+200 to 32+700 in the track of the railway line, unauthorized
vehicles access it by using it as a connecting road with other secondary urban roads. A
complaint has been communicated to HSH by the Administrator of Administrative Unit
no.11 Tirana, who presents the problem of using the project railway track by local
community as a traffic route causing disturbance, uncertainty and traffic. The contractor
has communicated directly to set up a meeting with the representative of Administrative
Unit no.11.The contractor is engaged in taking measures on the day the communication
was made and has closed the accesses at both ends of the segment from 31+800 to
32+700.

instructions in case of any emergencies and responsible personnel in charge.

electrical lines in order to monitor the safety distances and to instruct the necessary
awareness.
• Monitoring the safety elements of the heavy machinery working on site in order to
define the necessary corrective actions required.
• Identification of the hazardous areas at the working front and implementation of the
prevention safety tape in order to prevent entering of not authorized personnel.
Implemented and construction of the stairs for access in the lower level of working
areas.
• Identification and monitoring of hazard areas in the presence of overhead and
ground power lines at the work front and implementation of ground and overhead
electrical hazard warning signs to prevent and warn workers.
• Identification of dangerous areas that are accessed on the railway body by the

community residents at the work fronts where we have also been informed about
not accessing these areas and the implementation of the preventive security tape to
prevent the entry of unauthorized personnel.
• Organizing of the internal health and safety meeting for the definition of the safety
measures and activities to improve the HS performance.

2.5 Traffic Management

The contractor has in place a dedicated Traffic Management Plan that is being updated in
order to have the final approval by the Engineering. For each dedicated section where is
required by the Albanian Road Authority or other state institution the contractor will present
a dedicated “Traffic Scheme” according to the ARDM Manual for the management of the
project and third parties traffic.

The health and safety specialist on site have implemented a dedicated team that is in
charge and have installed the traffic signs on the necessary areas before the starting of
the work activities. In case of heavy traffic, the contractor has implemented a flagman in
order to prevent any collision of the project vehicles and third parties. In the working area
at km, -0+500-0+700, 3+700 – 3+800, 7+700 – 7+800 and at km 29+300 – 30+500.

The Contractor has developed a dedicated action plan for the improvement of the traffic
signs and signaling and barriers in all the most crucial project area, based also on the
Master Register presented by the IESC team during the month.
The Contractor has delivered during the month of February 2 Corrective Action Report
with the specific measures for the traffic safety and also for the safety of the community.

PURPOSE

This Rehabilitation Management Plan (RMP) is to provide guidelines and actions to


ensure that decommissioning and rehabilitation activities will be undertaken in a manner
that minimizes environmental, health, safety and social (EHSS) risk.
SCOPE

This document relates to the period of the project after the completion of the actual works,
the onset signalled by site clean-up, site rehabilitation, the withdrawal of the Contractor
from site.
The rehabilitation of the physical condition of the affected area by the construction works,
to their original state will be carried out immediately after the end of construction works.
Restoration works will aim to restore the affected area into the natural state.
The appropriateness of restoring the initial accurate physical condition will be assessed by
comparing the condition data prior to the start of construction with the built-up area.
During the construction activities, it shall be paid attention to ensure that no unnecessary
surface area is impacted, but only those within the project area that are indispensable.

CONSTRUCTION SUMMARY OF ACTIVITIES

 The civil works for the improvement of the existing line Durrës - Tirana has to do
with the rehabilitation total infrastructure of the existing line and the replacement of
the superstructure of this line, for it provide a more long-term and efficient
infrastructure for the busiest section of the national network. The construction
activities to be executed for the rehabilitation of the railway line Durres-Tirane are
briefly described below. These works consist of the following activities:

 for support functions such as camps:


o site preparation/clearance/logging requiring use of heavy machinery, such
as excavators, dozers, tipper trucks, etc.
o construction of accommodation/offices/welfare facilities/washrooms/storage
areas
o connection to utilities, as appropriate, e.g. power, water, drainage
o demobilisation, including the removal of all structures and reinstatement, as
required

 for new/upgrade of railway line:


o use of heavy machinery, such as excavators, dozers, tipper trucks, etc.
o removal of rails, old binary, compaction of material, laying of ballast,
expansion of the railway track, cleaning of side channels, light and medium
machinery/equipment such as graders, rollers, tipper trucks, etc.
o concrete works, requiring medium machinery such as concrete mixers
o signage works, requiring light machinery and equipment
o slope/embankments works, requiring medium and heavy machinery such as
tipper trucks and excavators

 for the new bridges:


o earthworks in water where necessary, requiring use of heavy machinery,
such as excavators, dozers, tipper trucks, etc.
o piling, requiring use of heavy machinery, such as piling machinery, tipper
trucks, etc.
o concrete works, requiring medium machinery such as concrete mixers
o signage works, requiring light machinery and equipment demobilisation
including the removal of all equipment and reinstatement of areas affected
(except the new bridge) to their original condition

ENVIRONMENTAL CONTROL MEASURES

The contractor will organize and implement all the necessary measures in order to
guarantee the reinstatement of the areas that are interested by the construction activities
and have been evaluated as impacted by the contractor. Below are presented the
summary of the reinstatement activities that will be analyzed and implemented after the
closure of the construction activities.

Removal of Structures and Infrastructures

All construction plant, equipment, storage containers, temporary fencing, temporary


services, fixtures and any other temporary works will be removed from site.
Stockpiled soil that will not be used again must also be removed if possible or re-
contoured to blend in with the surrounding landscape.
All access roads utilised during construction (which are not earmarked for closure and
rehabilitation) are to be returned to a usable state and/or a state no worse than prior to
construction.

Inert Waste and Rubble

After the completion of the construction phase, all construction material should be
removed from the rivers and the area should be rehabilitated.

• The site will be cleared of all inert waste and rubble, including surplus rock,
foundations and batching plant aggregates.
• Excess spoil and inert rubble will be loaded and hauled to fill in borrow pits / or to
dump sites, or approved landfile
• All domestic waste will be removed and disposed of in the approved manner, as per
the Waste Management Plan (refer to Document Nº 0382-attachment ES Subplan
No.05)
Hazardous Waste and Pollution Control

• All temporary fuel stores, hazardous chemical substance stores, hazardous waste
stores and pollution control sumps to be removed. Hazardous waste will be
disposed of in the approved manner, as per the “Waste Management Plan”.
• All pollution containment structures such as bonded areas will be broken down and
removed. Materials that will not be used again must be disposed of as hazardous
waste.

Topsoil Replacement and Soil Amelioration

• The reinstatement of disturbed areas shall be implemented on an ongoing basis,


immediately after the specified construction activities for that area are concluded.
• Top soiling activities are to take place prior to the rainy season or any expected wet
weather conditions, where possible.
• Topsoil placement should be executed concurrently with construction where
possible, or as soon as construction in an area has ceased.
• Stockpiled topsoil is to be replaced and redistributed together with herbaceous
vegetation, overlying grass and other fine organic matter in all disturbed areas of
the construction site, including temporary access routes and roads. Topsoil will be
replaced to its original depth.
• Where possible, topsoil will be re-placed in the same area from where it was
stripped. If there is insufficient topsoil available from a particular soil zone to
produce the minimum specified depth.
• Ensure that storm water run-off is not channelled alongside the gentle mounding,
but that it is taken diagonally across it.
• Any remaining stockpiled topsoil not utilised elsewhere will be shaped in an
acceptable manner so as to blend in with the local surrounding area in agreement
with CONTRACTOR.
• All excessive and inappropriate excavated materials will be removed from the
working area to final disposal area or reused for rehabilitation in the location nearby
as per agreement with respectively legal institutions.
• Top soils with good agricultural value should be stored temporarily within the
working area and reused during the process of planting/rehabilitation.
• The Contractor will ensure that the erosion-sensitive areas are protected through a
temporary or permanent drainage system as soon as possible, and by taking other
measures in order to avoid collection of surface water in streams forms.
• Any open tunnel or erosion channel during the construction phase or during the
vegetation placement period should be filled and compacted and the area will be
recovered in proper conditions.
• Anti-erosion compounds should be organic and inorganic materials that bind the
parts of the soil together and being a product that is capable to compact dust and
erosion.The application rate will be conforming to the manufacturer's
recommendations. The used material must have a quality that will allow the
germination of seeds and grass and will not hinder growth.
• Rehabilitate affected areas by the project activities and restore with topsoil and
planting of vegetation.

• One of the mitigation measures is for any invasive vegetation species not to be
used for the rehabilitation and restoration phases.
• Rehabilitate affected areas by the project activities and restore with topsoil and
planting of vegetation.
Soil excavated disposing

Generated soil will be managed as follows

• Parts will be re-used as filling material according to the project needs.


• A part of the soil will be used for rehabilitation of damaged areas that need filling
material (soil, inert).
• A part of the soil and the inert waste will be deposited in dispose approved area as
per respective agreement with the local institutions.
• For all disposal areas it will be drafted specific rehabilitation plans that will be
delivered to the respective institutions.
Cleaning the Vegetation and Shifting the Trees

The Contractor will ensure that no trees or shrubs or waterside vegetation are felled or
harmed except for those required to be cleared for works execution. The Contractor will
protect trees and vegetation from damage to the satisfaction of the engineer and the
employer.
The Contractor shall be responsible for obtaining any necessary felling permits and for
ensuring the disposal of felled trees in accordance with prevailing regulations.
No tree will be removed without the prior approval of the Engineer and the Employer.
In the event that trees or other vegetation not designated for clearance are damaged or
destroyed, they will be repaired or replaced by the Contractor at his own expense to the
satisfaction of the Engineer and the Employer.

The following mitigation strategies will be implemented to reduce potential ecological


impacts during clearing and preparation of land for all land-related jobs:

• Areas to be cleaned should be kept to a minimum and limited by the visible limits, in
order to preserve the natural vegetation where possible.
• No vegetation outside the working area defined by the project should be cut.
• Prior to excavation all grass is to be cut.
• Before starting the work, any surface should be cleaned from the wood material.
• This material should be stored for subsequent redistribution on the surface of
vegetal or rehabilitated area for use as a protective measure in slippery areas.

• Removal of vegetation from the areas where the works are to be carried out (trees,
shrubs, etc.) will be carried out off of the birds' nesting season (March - July).
Where this is not possible, an inspection must be carried out prior to the start of the
work, and if there are active nest, no work will be carried out near the nest, defining
a buffer zone of 20 m, until the birds leave the nest.
• The trees will be rooted up within the established boundaries and the trees that fall
outside this boundary or on the undisturbed vegetation will leave there, in order to
avoid maximum disturbance of vegetation and habitats in the area outside the
defined area. All work is carried out in a way that minimizes the impact on the
surrounding vegetation of the area.
• All the quantity of damaged trees that can be traded will be recovered and what
cannot be marketed will be stored for reuse (with different destinations) or final
deposit.
• During cleaning processes, the material should never be piled outside the
boundaries of the specified work.
• Access to areas with dense vegetation should be limited before the construction
works start and during this process.
• Trees or bushes that have been selected to be stored inside or near the working
area should be surrounded around their perimeter tape. Fires, cigarettes, should not
be allowed in this enclosed area, nor should vehicles not be parked in these
vegetation areas. Also, the area should not be used for storing materials or
installing temporary objects.
Replanting the impacted area from construction activities

The following management measures will be taken for replanting the impacted area as
part of the rehabilitation process after completion of construction work (egg temporary
field facilities, areas adjacent to construction sites). Section 4 can be seen as an area that
will have an impact on the part of the river due to vegetation. The replenishment will
include the regeneration area based on the existing vegetation prior to the works starting.
In this way the representation of the area original biodiversity will be aimed before the
start of the works.
Endemic species and existing vegetation varieties in the area will be preferred to be used
during the rehabilitation process. Where the use of endemic species will not be possible,
the use of naturalized species is an acceptable alternative.

Final Shaping

• All borrow pits, quarries and dangerous excavations will be made safe by shaping
as and when required.
• In general, no slopes steeper than 1(V):3(H) should be allowed, unless otherwise
specified by CONTRACTOR. New slopes must mimic the natural slopes and
topography.
• All disturbed areas to be shaped to blend in with the surrounding landscape.
• No excavated material or stockpiles are to be left on site. All material remaining
after backfill is smoothed over should blend in with the surrounding landscape.

LEGAL REQUIREMENTS

Reinstatement/Rehabilitation: Ensuring restoration and re-vegetation of areas affected by


construction work activities should be compliant with the Albanian legislation requirements
and EBRD PRs.

PURPOSE
The Contractor Stakeholder Engagement Management Plan (CSEMP) aims to coordinate
the necessary activities in order to manage the implementation of the construction
activities with the minimum impacts on the commit to the management and coordination of
issues related to third parties.
This Plan is intended to provide an overview of how the Contractor will manage and
implement the requirements of the Stakeholder Engagement.

SCOPE
Stakeholder engagement is defined as 'an ongoing process whereby the contractor builds
and maintains constructive relationships with the residents that are impacted by the
construction activities using a range of activities and approaches.
In a direct way, the contractor takes some commitments and obligations towards the
impacted community of the construction activities with construction information, grievance
mechanism, support in case of necessity, training for the safety, specific MoM with them.
In cooperation with the Company HSH, in case of necessity the CLO will participate with
the relevant personnel and including higher levels of entities, local and national units.

Stakeholder management includes activities as per bellow:

The importance of the project includes the engagement of stakeholders at the community
level.
The requirements of the community that are related to the added infrastructure, facilities
and utilities, etc. are beyond the management of the Contractor and will be delivered to
the Company. The decisions that the Company will arrange regarding the requests
submitted by the community, should be forwarded and communicated also to the
Contractor.

Local content imperatives and worker grievance management are addressed by means of
the Worker Management Plan as part of stakeholder engagement; drown up as per sub
plans WGP and TPGP.
Stakeholder engagement activities are also documented separately in the following Sub
Plans and their related procedure.

The contractor, in order to be in compliance with the EBRD requirement as well as to


better managing the SE, has drawn up several documents with the relevant processes
that present the strategy that will be implemented in the needs for follow various issues
arising from SE.

STAKEHOLDER ACTIVITIES

Community Liaison and staff


The contractor will nominate a dedicated Community Liaison Officer in order to establish
effective and efficient community relations system between the CLO and Company’s
Community Liaisons Manager CLM within the HSES team including the following topics:

 Proactive activities to inform the stakeholders that are in the line of the construction
activities.
 The CLO will liaise with local communities, stakeholders and government
regulators on the Project’s behalf.
 Make arrangements to implement this Stakeholder Engagement (SE) PLAN;
 The CLO will implement environmental and social awareness and education
program with communities.
 Provide the management team with full access to all documents and information
regarding the stakeholder engagement process;
 Facilitate communication with the residents in the Project area; compiling and
managing minutes of any meeting organized with the local stakeholders;
 Assigning a responsible person to organize the resolution of grievances in line with
Grievance Mechanism and ensure effective implementation of the Third-Party
Grievance Procedure
 Manage a process for dealing with both workers’ and communities’ grievances;

Community Meetings and Information


In case of necessity or during stakeholder activities as meetings or information’s sections
related to the community resident in the construction line of activities the CLO will have
official records that need to be registered.

The Contractor will record all the meetings with the stakeholders with a MoM template as
per Appendix A. The meetings will be held in accordance with the intensity of the work
activity and their location, to be as informative as possible for stakeholders.

The records of the information’s sections, meetings or other type of clarification with the
community registered by the contractor will be presented in the dedicated reports and
delivered as information to the Supervisor Engineer and Company CLM.

Grievance mechanism is a procedure that the contractor will follow in order to register any

Grievances raised by the community will be managed according to the process and
associated roles and responsibilities set out in the sub-plan “ES Sub Plan No.1 – Third
Party Grievance Procedure” by:

 Process for receiving, recording and acknowledging, registering, assessing,
investigating, managing and responding to grievances

The contractor personnel in cases that any issue will be raised by the possible affected
community, will inform the Contractor’s CLO who will classify the information and the

All the grievances that are related to damages or impact inside of the working Streep of
the railway raised by the community will be registered and solved by the contractor with
the satisfactory of the community.

All the grievances that are related to expropriation of information related the boundary of
the properties raised by the community will be delivered to the CLM of the Company and
Supervising Engineer to be solved with the satisfactory of the community.

Stakeholder Engagement Trainings


The contractor INC has implemented another element such as training to complete the
stakeholder engagement mechanism. Contractor consider very important the approach
that all the project personnel will have in the direct approach to the community and people
that will need to communicate regarding several project issues.

For this reason, a dedicated training program is developed by the Environmental and
Social Officer that in collaboration with the CLO will introduce in the induction training for
all the project employees the necessary information.

This information includes the approach and the communication that the site project
personnel is allowed to have and the dedicated information that they need to deliver to the
community.

The training session will be implement in each induction training and also through
dedicated training session based on the areas of the project that need a higher level of
attention and engagement with the following topics:

 Conducted training for all employees on the understanding of commitment to third


parties.
 Realized trainings for the notification and forwarding of complaints from
stakeholders related to the work processes of this project
 To manage the first stages of a conflict against any potential project affected
people.
 Realized training for the hierarchy of stakeholder engagement management
officers, making available their contacts to avoid direct confrontations with
stakeholders

Stakeholder Engagement Action Plan

The Contractor before commencing activity on a new segment of the railway will
implement a dedicated action plan that will be based on the social sensitivity that the work
activities will cause in that area. The action plan will be implemented by the CLO and the
ES Officer and will include the following steps:

 Determining the time when the works will start in that dedicated section.
 Meetings with residents to inform about the works activity.
 Official MoM to listen to the community related to any issue.
 CLO and ESO will make an observation and assessment of the situation and how
many people will be affected by the line and extent of this project.
 Register the issues or grievances of the section in case of official ones in the
dedicated form before start the construction activies.
 Communicate to the Comapny CLM and Supevizor the grievances and deliver the
registration form.
 Take actions based on the decision of the grievance resolution internally or by the
Company.

The Contractor organization is committed to the following objectives for the Stakeholder
Engagement function:

 To ensure a consistent, comprehensive, coordinated and culturally appropriate


approach.
 To create and implement a SEMP function that is “fit for purpose” to support the
Company to achieve compliance with Contractor and Supervizing Engineer
commitments.
 To align all his actions with the requirements of the EBRD Performance
Requirements 10 .
 To ensure free, prior and informed consultation of the affected communities
through the realisation of an inclusive and culturally appropriate process of
stakeholder engagement, in an early, on-going and iterative way throughout the
construction stages of the Project.
 To build a trusting relationship with the host community and other interested
stakeholders based on a transparent and timely supply of information and open
dialog. The Contractor is committed to addressing, to the best of its abilities,
concerns pertaining to this proposed development raised by local residents and
community members.
 To achieving the Project’s objectives while respecting the needs and issues of
stakeholders as they relate to potential project impacts.

The contractor, in the case of areas that are free of any legal obstacles in terms of land,

and official documents, need to access these area with the help of the state police or
other institutions.

The Contractor will notify the relevant institutions regarding the issues that require the
participation of third parties and the notification will always be made with the approval of
the Company.

PURPOSE
The contractor, INC, is committed in the drafting of this Social and Environmental plan to
describe the measures that will minimize the interruption of services for the community
during the execution of the activities for the Project from the construction activities.

SCOPE
This Environmental and Social Implementation Sub Plan is applicable to all the below
Contract activities. Infrastructure and utilities include, but may not be limited to, the
following third party services utilized by the community in Albania:

 Roads (internal village roads as well as roads linking villages and towns)
 Bridges and culverts
 Telecommunications
 Potable water
 Wastewater
 Electricity
 Storm water/drainage
 Irrigation
 Hydro-electric
 Buildings (farm buildings and dwellings, both rural and in villages)
 Walls and fences
 Plantation forests

OBJECTIVES
The objectives of this Sub Plan are to provide a high-level “road-map” describing how the
Contractor:
 minimises damage to settlements and household assets during construction and
improvement activities
 ensures no significant temporary loss of, or access to, infrastructure or services
and no reduction in services available to the local communities

A secondary aim of the infrastructure and utilities management process is to prevent


stakeholder grievances and the associated negative publicity, reputational damage and
claims for compensation.

INFRASTRUCTURE AND UTILITIES MANAGEMENT PROCESS


The contractor will take the commitment to follow the plan of the consent of the
infrastructure and utilities that will be used or interrupted affecting the third parties.
The aim of the Contractor’s infrastructure and utilities management process is to minimize
damage to existing third party infrastructure as well as the disruption of services to the
local community that can be impacted by the construction activities of the CTR.

Graphic Documentation

At the beginning of the works, the contractor first receives from the relevant entities all the
documentation design updates to identify all the facilities and utilities that could potentially
interact with the project construction work.

Official notification has been and continue to be implemented by the CONTRACTOR to


the state institutions for the detailed maps of the underground and aerial utilities including
the water infrastructure, electrical infrastructure and internet or other types of
infrastructures.
The activities of the contractor will be based on the official documentation received by the
national or local authorities. Periodic update will be made to the maps and documentation
based on the information received by the respective authorities.

The update will be made in type and location of the existing infrastructure was indicated
on aerial photographs and maps. In framework of the graphic documentation, the
Contractor undertook a rigorous design verification process. This included, amongst other
activities, visual inspections of all roads and bridges both by vehicle and on foot. This
intensive ground-truthing exercise revealed some additional infrastructure that was
omitted from the detailed design documentation.

The Contractor created detailed records of inspections including photographs, GPS


locations and other pertinent information.
This survey collects evidence (both written and in the form of photographs) of all the
potentially-impacted infrastructure and utilities as well as the type and owner.

Community Information

The contractor for all the activities, that give disturbances or interrupt any services for the
community, that is scheduled by the construction activities will implement a dedicated
process of information with the CLO and the CLM if required.
The community will be informed regarding the day and the max hours of the activities that
can have impacts and this will be recorded with the dedicated information format.

Throughout the process outlined above, representatives of the Company and Contractor
engage proactively and reactively both with the owners of assets, infrastructure and
utilities entities to the project; and also with users of the services who may be affected by
temporary disruptions to normal service availability.
Engagement measures are in place for interacting with both the owners and users of
assets, infrastructure and utilities as required for:

 Planned relocation
 Planned temporary disruptions/interruptions
 Accidental damage or disruptions

The Company takes the lead with respect to Stakeholder Engagement and the Contractor
provides support as required. The various processes for engaging with project affected
persons (PAPs) are managed and executed by the Company, with the Contractor taking
on a support role.
Mainly, the relevant authorities make the notification for possible interruptions, but the
supporting role of the contractor or the employer is as an additional element for the
compliance and understanding of the residents in those segments where the specific
activities of the project are carried out.
Their function includes providing advanced notice to communities and local authorities
regarding changes in infrastructure, diversions, temporary closures and other disruptions.
They also receive feedback and complaints from communities with regard to the condition
and/or disruption of utilities and infrastructure; and this is managed in accordance with the
Minutes of meeting Procedure or Contractor Third party Grievance Procedure or other
implemented Contractor’s document presented below

Emergency Repair Intervention

In case of damages created by the construction working activities of the utilities the
CONTRACTOR will immediately intervene and organize the repairing and the assessment
of the situation.
In case of damages the Site Manager and the CLO must be informed immediately, and
they will be in charge for the developing of the technical solution and also informing the
community or the direct related person for the repair process.

The objective of the contractor will be solving of the damages within the best minimum
time in order to minimize the impact on the community and lower the possibility of formal

Exit Survey and documentation

On completion of construction activity on the specific sensitive areas related to the


infrastructure of utilities of the project, an exit survey is undertaken. It covers the
documentation of the pre-entry areas surveyed and additional areas or property affected
by access.
Photographic evidence of road and infrastructure condition is taken of all areas covered in
pre-entry above and any potential areas of concern. Actions arising from the exit survey
are closed-out in a timely manner to return assets and land to the relevant
authority/village or landowner in an acceptable condition.

Monitoring and inspection


During the execution of works and intervention in infrastructure and utilities, continuous
monitoring is also done for the construction activities that are thought to have potential for
problems.
The contractor will implement a dedicated monitoring activity by the CLO in all the areas
that are indicated as sensitive by the site engineers as per the construction activities
continues. Monitoring consists of identifying and noting any infrastructure or utilities that
will be impacted and dedicated action need to be in place before proceeding with the
relocation of removing the utilities, so that people are not affected by the loss of access
and their interruption.

PURPOSE
The Contractor Community Health and Safety Management Plan (CCHSMP) aims to
coordinate the necessary activities in order to manage the potential impacts to the H&S of
the affected community and to establish the specific preventative measures.

The impacts and the specific preventive and protection measures for the community are
designed by the Contractor in other management documentation as the method
statements, risk assessments, traffic management plan and Environmental and Social
Management Plan.
This Plan is intended to provide an overview of how the Contractor will manage and
implement the community health and safety strategy.

SCOPE
This Plan has the scope to address health and safety issues from a community
perspective only. Through this plan the contractor aim to raise the community awareness
of H&S risks associated with construction activities. Having in place dedicated plan and
mitigation measures for the community, will reduce and minimize the possible impact of
the exposure the community to the hazards or material of the construction activities.

The objectives of this plan are as per below:

 Avoid or limit risks to, and impacts on, the health and safety of the
community during the construction phase from both routine and non-routine
circumstances. This is achieved through implementing mitigation measures to
reduce risks, along with the implementation of an effective monitoring and
evaluation risk assessment.
 Ensure that safeguarding of personnel and property is conducted in an appropriate
manner that avoids or limits risks to the community’s safety .
 Maintain a monitoring and evaluation system that record any potential threats or
hazard to the community and react for their prevention.

COMMUNITY HS MANAGEMENT
This CHSMP provides a general description of the methods, procedures, commitments
and best practice to be implemented by the Contractor during construction activities of the
railway. These general descriptions are in line with the specific requirements that the
contractor has as per contractual agreements and policies.

The present section includes the following topics:

 General impact avoidance and mitigation;


 Health and safety risks to the community;
 Community notification management;
 Construction site management;
 Traffic safety management;
 Security;
 Worker-community interaction.

By implementing this CHSMP and related monitoring activities in compliance with


Albanian legislation and the required international standards, Contractor will ensure that
the Project (including all site operations, equipment and machinery) will comply with the
best practice Standards.

To prevent incidents caused by material, construction defects or project traffic, Contractor


will apply quality control when purchasing materials, undertake continuous supervision of
construction works, and perform the control activities before project will be considered
completed. In addition, Contractor will provide access to health care for those injured by
its activities.

Health and Safety risks to the community

Implementation of the Project may affect the health and safety and security of
communities near the jobsites for the railway project as a result of the interactions of the
workers and the community, the risk of injury related to construction activities.

The contractor has identified and assessed the risks of possible impacts that are defined
in the ESMP and also in the risk assessment document and will adopt the relevant
mitigation measures starting from those described in the document ESMP.

The main sources of impacts are as the following:

 Presence of the construction workforce, who through interactions with communities


may lead to increased disease transmission.
 Community members could be involved in accidents leading to injuries and even
fatalities if they enter areas, where construction activities are being undertaken.
 Changes to the environment due to increased noise, decreased air quality and
changes to the visual environment as a result of the Project may affect health and
wellbeing, etc.
Before commencement of construction activities, Contractor will identify and evaluate
other risks and potential impacts to the health and safety of the affected community,
especially during the inspections before the construction activities survey.

One of Contractor’s main objectives is to ensure communities adjacent to construction


areas are aware of and educated on safe behavior around construction sites and on roads
used by the project.

Adequate training will be provided to the workforce of Contractor and subcontractors,


mainly focusing on identification and assessment of health and safety risks and their
avoidance, as described in the training plan.

Community notification management

Prior to start the construction activities on the different segments of the railway, Contractor
will organize dedicated meetings and notification to Project affected communities, on the
potential community safety and security impacts and mitigations.

Information provided will be updated during the project, in case of changes or specific
construction activities of particular consideration for the affected communities. This activity
is detailed in the Stakeholder Engagement Management Plan ESIP and scheduled based
on the CLO activities related to the construction schedule.

The Contractor will implement dedicated meeting and information session with the
community near to the working areas that is affecting by the construction impacts, in order
to disclose the identification and evaluation of the risks and potential impacts to the health
and safety that could affect the community.

The HS officer and CLO will provide information about the risks of trespassing into sites,
to raise community awareness of the health and safety risks associated with construction
and explanation of the dangers associated with the construction works, establish
preventative measures and plans in order to address these risks in an appropriate manner

to prevent/avoid the risk of impacts over minimization and reduction and explain the
dangers associated with the construction works.

Contractor CLO team will seek inputs from Contractor health and safety team in terms of
identifying community hazards and suggesting correct safety messages.

Contractor’s CLO team will undertake some of the following tasks:

 Through the posters, leaflets, etc. or through special meetings, give information for
communities (eg relevant construction activities and locations, advance notice to
road closures or diversions, relocation of irrigation canals, etc.); schedule changes,
timelines, activities planned for stakeholders in the vicinity of construction site;
construction time to the landowners in order to give them the opportunity to
organize their future agricultural and business activities; where are the critical dust
producing activities is expected to provide notification and relevant information to
the local authorities in Durres, Tirana and crossing Kashari to Rinas Airport at least
72 hours before the start of the activities, etc.
 Organize dedicated training sessions, delivering frequent safety awareness training
to employees, PAP-s, communities explaining the dangers and risks of
construction sites and construction activities, etc.
 Through organization of open sessions provide education to communities and
drivers on traffic safety and precaution habits.
 Consult ambulance, police, fire services and heads of communes regarding road
diversions.
 provide information to communities related to healthcare services, fire services,
etc. nearby construction areas

Pollution prevention and resource availability

The construction of the Durres-Tirana railway line and the new line to Tirana International
Airport will result in changes in the physical environment which has low potential to affect
the health and well-being of communities.

The construction of sites for the railway line is likely to result in increased noise mainly for
the residents inside 50 square meters of construction. This increase in noise is likely to
result in an increase in annoyance and reduced welfare for those closest to construction
activities. Proposed hours of the operation, avoids the night in order to prevent sleep
disturbance.

Measures for minimizing from pollution of dust and noise during construction are
described in the monitoring program of the ESMP. Community members will be made

aware of the projects communication channels for reporting feedback and grievances and
how they can let the project team know of a concern, risk or problem.

Details are included in the ES Sub Plan No.1  - “Third Party Grievance Procedure”. The
impact of waste production on the health of communities at the station sites, as a result of
the construction activities, is minimized, as waste will be stored in a designated area on
the site and the possibility for community to come into contact with waste will be minimal.

Contractor’s target is to manage environmental impacts in a way that minimizes and


mitigate adverse impacts on local communities (emissions, discharges, accidental
releases of contaminants). In the frame of ESMP framework, Contractor has prepared a
series of sub plans that describe its management actions in relation to environmental
impacts, which also address environmental impacts that could also become community
health and safety issues:

 ES Sub plan No.05 - Waste Management Plan- includes mitigation measures for
managing potential waste from the camp site and from the construstion site.
 ES Subplan No.9 – Air Pollution Management Plan that discribes mitigation
measures for dust control, air quality, air emission,etc.)
 ES Subplan No.12 - Pollution Prevention and Hazardous Materials Management
Plan that aims to mitigate negative impacts by storage in good conditions all
hazardoues materials and managing all construction waste.
Grievance mechanism is a procedure that the contractor will follow in order to register any
claim regarding the work activities raising from the stakeholders who consider themselves
affected by the Project - Construction Activities.

Grievances raised by the community will be managed according to the process and
associated roles and responsibilities set out in the sub-plan “ES Sub Plan No.1 – Third
Party Grievance Procedure” by:

 Receiving, recording and acknowledging, registering, assessing, investigating,


managing and responding to all stakeholder and community claims.
 Monitoring, evaluating and reducing grievances.
 Training all the employers how to deal with and submit a complaint to the CLO

The contractor personnel in any case that an issue it is raised by the community that
consider themselves affected by construction activities, should inform the Contractor’s
CLO as the person in charge who will receive and classify the information.

All the grievances that are related to damages or affect inside of the working track of the
railway raised by the community will be registered and solved by the contractor with the
satisfactory of the community.

All the community grievances that are related to a potential expropriation or related to the
boundary of the properties will be delivered to the CLM of the Company and Supervising
Engineer to be solved with the satisfactory of the community.

Community safety during construction

The CONTRACTOR will inspect and inform on the condition of roads and local
infrastructures to be utilized by the project and will identify potential risks for the local
inhabitants.

Excavations, storage and transport of materials that operate close to a community or that
may risk temporarily flooding will be fenced.
Proper warning barriers, and signs will be displayed around areas of minor risk to
members of the public. Appropriate posters will highlight site trespassing associated risks.
There will be a surveillance control on the perimeter of the construction site operation
every day and regular inspections will be carried out to check the integrity of the barriers
and signs. All the overhead cables and temporary crossing points will be adequately
signaled.

All excavations in sites are to be kept free from ponding water and the Contractor will take
all necessary measures to maintain excavation free from water during construction. Water
will be pumped from flooded excavations where a risk assessment concludes that they
present a safety risk to people or livestock and in all cases where there is public access.

The Contractor will ensure that the discharge of water will not worsen the quality of
surface waters and ground water which may impact the livelihood of local communities.
Therefore, water will be collected into a temporary water pond and extra water will be
discharged to the adjacent channel, only after obtaining of all necessary project approvals
and where the quality of water meets requirements for discharges into surface water
bodies.

The CLO within Contractor’s ESMS team will be in charge for disclosure of information on
plans of changes/ rerouting of irrigation/drainage channels, diversions and closures of
roads, etc.
In compliance of its commitments, Contractor will provide advance warning, carry out a
risk analysis of effects on affected settlements, provide alternatives where there will be a
risk to the health or livelihood of settlements or where the disruption is not acceptable to
the affected settlements, etc. For more details, refer to the ES Sub Plan No.16 -
Stakeholder Engagement Plan.

Driving behavior

Contractor will ensure, that all the workers/drivers know and understand the traffic rules,
safety policies and procedures for the workplace and the behaviors being observed in the
community interaction.

The main objective is to guarantee that the project personnel do not create any negative
impact on the local communities and guarantee the professional management of any
situation that can be created by the community.

All workers of Contractor and Subcontractors will undergo training before and during
construction to understand community safety issues and how to avoid safety risks to
communities. In addition, the Contractor’s drivers will be properly trained on their
behaviors to be followed while driving.

Contractor’s drivers will abide the Contractor code of conduct. Detailed information is
included in Health and Safety Plan. In particular, all drivers will undergo defensive driver
training and off-road driver training as well as to drive in the project.

The Contractor will ensure, workers/drivers have the necessary training, qualifications and
licenses to operate the vehicles, and will:

 check for licensing, qualifications and fitness for work when engaging drivers or
operators;
 managing the activities of visiting drivers,
 training drivers and operators

Contractor will carry out driver safety, environmental, social and cultural heritage
awareness training to promote safe and responsible driving behavior. Drivers will be
subject to disciplinary actions in accordance with the Code of Conduct and the Golden
Rules of Safety should they not comply with set expectations. The Contractor will also
conduct random and with-cause drug and alcohol testing to ensure safe driving
conditions.
Visitors to the workplace will be informed and become conscious of the site traffic safety
rules and procedures by setting informative signs, registering and compliance procedures,
frequent supervision to control etc.
Management of personnel

The movement of personnel, machinery and equipment on public roads has the potential
to impact on community safety and security.

Contractor will develop and implement a Traffic Management Plan (TMP). The traffic
management plan will include procedures to reduce the risks associated with vehicle use.
These procedures will include measures to reduce the exposure of vehicle drivers, their
passengers and other road users to traffic hazards.

Access, diversions and road closures

Contractor will identify local roads for access, vehicle routes, prepare route planning and
alternative routes, as well as an overall vehicle movement and notify the municipalities
and police of all approved Project transport routes.

Contractor will identify and assess alternatives and measures to limit road use by the
Project during high public traffic periods, in order to reduce traffic risks to the community
and workers.

If any road crossing will occur Contractor will evaluate and will develop a specific method
statement describing requirements and length of crossing.

If any temporary road diversion and closures will be needed for the execution of the
activities, Contractor will notify and consult with related authorities and will give the
interested stakeholders and affected communities’/road users at least 72 hours advance
warning through his CLO.

A road pavement assessment will be carried out during inspection activities in the area
Durres-Tirana and the new line to Tirana International Airport on all possible routes that
will be used by the project. This assessment will provide detailed information on road
improvement needs and permanent and temporary risks to be minimized. It is intended
that access to commercial and residential properties will always be maintained and if this
should not be possible, the Contractor will inform Company in advance in order to reach
an agreement with the affected stakeholders.

7. MONITORING, INSPECTION AND REPORTING

The monitoring and inspection requirements and activities relating to community Health
and Safety will be delivered by the Health and Safety Officer and the CLO by
implementing also the checklist as per Appendix A. In regard to community safety, the
following items/ activities will be monitored:

Issue: Vissible land erosion during work activities - During the site inspection in the area, the construction site was not fenced properly.
Action: The contractor should install effective erosion control measures in line with subplan - Unauthorised persons were entering the construction site.

- No proper measures were taken for river crossing.
- The informative sign for construction site was damaged and found in the drainage channel.

construction area or should provide an alternative way to the community for crossing in line with subplan 18
