GENEVIEVE ELISE ASHTON ) SUPPORT OF PROBABLE CAUSE

Kristen E Harmon, being duly sworn upon her oath, says that:

I am a Deputy Prosecuting Attorney with the 60th Judicial Circuit, St. Joseph County, State of Indiana,
and make this affidavit after reviewing verified South Bend Police reports and speaking to detectives.
On 6/6/22 Curtis Shelby was shot and killed in South Bend, IN . Over the course of the investigation,

officers were able to identify multiple suspects. One of the suspects was identified as Treyveon Moore.

On 4/19/23, Treyveon Moore came to the South Bend Police Department with GENEVIEVE ASHTON.

Initially, ASHTON told officers she was "Mackenzie." Officers were aware that there was a valid

Protective Order prohibiting Moore from having contact with ASHTON. Officers interviewed ASHTON
and she again stated her name was "MACKENZIE." Eventually, ASHTON admitted her actual identity.

Officers explained to ASHTON that Moore was a suspect in a homicide and that MOORE'S vehicle was

used in the homicide. Moore was arrested for violating the protective order.
Officers obtained multiple jail calls from Moore to ASHTON. In the calls, MOORE refers to the

homicide and tells ASHTON that "they know." In the context of the conversation, "they" is clearly law

enforcement. ASHTON states that she has contacted the other suspects involved in the homicide.

On the morning of 4/20/23, Moore instructed ASHTON to remove "items" from ASHTON'S vehicle
that belong to Moore that would "come back to him." ASHTON agrees and the two discuss where to
move the items to. In a recorded jail call with a different person, Moore states Moore's gun was in
ASHTON'S vehicle. In a conversation later the same between Moore and ASHTON, ASHTON lists the

things she has done that day, and included, "I brought that in." On the afternoon of 4/20/23, Officers

obtained a warrant and searched ASHTON'S vehicle in the late afternoon. There was no gun located.
On 4/20/23, Officers brought ASHTON to the South Bend Police department again. ASHTON was

advised of her Miranda rights and agreed to speak with officers. ASHTON stated that she had not spoken
to Moore since before Moore was arrested on 4/19/23. Officers informed ASHTON of the jail calls with

her recorded voice. ASHTON then confirmed that she had been communicating with Moore from the jail.
DETENTION CONSIDERATIONS

The Defendant is charged with actively assisting a suspect in a murder case to speak with other person's

involved and hide potential evidence.


WHEREFORE, the State requests that the Court detain the Defendant until the Court conducts a bail

hearing in open court.

I affirm, under the pains and penalties for perjury, that the foregoing representations are true.
