Case #1: Mr. Fernando Jose wishes to put-up an Php85-million sports complex within the vicinity of
the Intramuros area. What advice will you give?

The piece of advice that I will give Mr. Fernando Jose is not to continue this attempt to put up a sports
complex within the vicinity of the Intramuros Area because Intramuros has been a priceless heritage over
the past years for the City of Manila. It is a major historical landmark of the Philippines, so it is not
suitable that suddenly Mr. Jose will put up a sports complex. Also, if Mr. Ferando Jose insists on putting
up his Php 85-million sports complex, he must talk to Intramuros Administration because this
administration is responsible for the restoration and development of Intramuros. Also, the Tourism Act of
2009 stipulates that the DOT shall be the primary government agency responsible for the planning,
programming, coordinating, implementing, and regulatory aspects of developing and promoting the
tourism industry, both domestically and internationally. Furthermore, suppose Mr. Fernando Jose really
wants to put up a sports complex. In that case, he might consider talking to Tourism Infrastructure and
Enterprise Zone Authority (TIEZA) because this agency of the Philippine national government under the
Department of Tourism operates and manages tourist facilities from Luzon to Mindanao.

Case #2: On July 25, 2019, Mayor Isko Moreno ordered the cancellation of all business permits of
stores in Manila selling alcoholic drinks within the 200-meter range of schools and universities.
Moreno said that the order would also affect convenience stores that sell liquor. Executive Order
No. 17 mandates the Bureau of Permits and License Office (BPLO), City Treasurer’s Office, and
business establishments to strictly observe Ordinance No. 3532 that prohibits the sale of
intoxicating liquor within 200 meters of schools, and Ordinance No. 8520 that prohibits the sale of
any alcoholic beverage to minors. Moreno, however, noted that establishments are still free to
continue business as long as they would not sell alcoholic drinks to students. The executive order
took effect immediately.

On August 1, 2019, a week after the Executive Order has been issued, Moreno ordered the closure
of at least seven (7) bars in Sherwood, Taft, for violation of city ordinances. He said business owners
must mend their violations before they can operate again. Is this valid in relation to the power to
regulate devolved by the Department of Tourism to local government units?

One week after the Executive Order was issued, on August 1, 2019, Moreno issued the Order to
close at least seven (7) bars in Sherwood, Arizona. The explanation offered was that the establishments
violated city regulations. He said that before a business can resume operations, its owners must accept
responsibility for their offenses. Is this legal, given that the Department of Tourism has granted local
governments the power to control some areas of their operations? Yes, it is valid for the regulatory
authority given to LGU by the Department of Tourism, which was established by Presidential Decree No.
189 (May 11, 1973) and implemented to make the tourism industry a helpful tool for rapid national
development. The word "there" has a positive connotation. Therefore, unlike Ordinance No. 3532, it does
not restrict the sale of alcoholic beverages within 200 meters of schools.

Additionally, according to 02 Handout 1 on page 1 of 8, the Department of Tourism (DOT) has


the authority and responsibility to create and promulgate rules and guidelines that control how all tourism
enterprises operate. This is done in consultation with local government units (LGUs), private sector
businesses, and other tourism stakeholders. A national standard for the licensing, accreditation, and
categorizing of tourism firms that specifies minimal levels of operational efficiency may be one of these
laws and regulations, but it is not the only one. Thus, consequences for violating the laws as mentioned
above should be handed out to businesses so that their owners can comprehend the nature of their
offenses.
