MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement is entered into this ___ of January, 2022 by the
DEPARTMENT OF EDUCATION and by the JDVP-Partner Industry, WEST PRIME
HORIZON INSTITUTE, INC. in Pagadian City.

The Department of Education, Division of Zamboanga Del Sur, with the principal address at
Provincial Government Complex, Dao, Pagadian City, Zamboanga Del Sur, represented by its
Schools Division Superintendent, MAJARANI M. JACINTO, Ed. D., CESO VI, Filipino, of
legal age, and hereinafter referred to as the “DIVISION”:

WEST PRIME HORIZON INSTITUTE, INC., duly constituted and registered in the
Philippines, with the principal address at V. Sagun, Cor. M. Roxas St., San Francisco Dist.,
Pagadian City represented by its Acting School President, ARIEL S. BINAG, legal age,
hereinafter referred to as “JDVP-Partner-TECHNICAL Vocational Institution”;

WITNESSETH:

WHEREAS, the Department of Education of the Philippines, hereinafter referred to as

“DepEd”, is the primary government instrumentality mandated to formulate implement, and
coordinate policies, plans, programs and projects in the areas of formal and non-formal basic
education: supervise all elementary and secondary education institutions, including alternative
learning systems, both public and private: and provide for the establishment and maintenance of
a complete, adequate, and integrated system of basic education relevant to the goals of national
development;
WHEREAS, the DepEd has introduced the K to 12 basic education reform program that
includes Senior High School, hereinafter referred to as “SHS, with the major objective of
ensuring that graduates of basic education are ready for employment, entrepreneurship and
higher learning;
WHEREAS, the SHS curriculum can be customized at the local levels to take into consideration
the needs of local industries and the labor market;
WHEREAS, the DepEd believes that for the effective delivery of SHS instruction, there is a
need for the school- industry partnership that will provide the school the necessity expertise and
venue for practical, JDVP-training for SHS learners.
WHEREAS, the DepEd will start the full implementation of SHS in School Year 2022-2023;
WHEREAS, the SCHOOL is among those that will offer SHS to students in community to carry
out DepEd’s objective for SHS as spelled out above.
WHEREAS, Cogon National High School with its JDVP Partner-Technical Vocational
Institution, West Prime Horizon Institute, Inc. conform to DepEd Order No. 40 s 2021.

RESPONSIBILITIES OF THE PARTIES

A. Joint Responsibilities
Both the school and the Training Provider shall;
1. Create a joint working group to facilitate the smooth flow in the implementation of
the program.
2. Form a joint steering committee to monitor progress of partnership and ensure the
provisions of this Memorandum of Agreement (MOA) are met.
 3. Adhere to the laws, memorandum and circulars especially those that are pertaining to
the child protection as provided for.

B. Responsibilities of the School

The school shall:
1. Conduct and online orientation by the learner-beneficiaries and their parents, teachers
and representative from JDVP-TVI Partner.
2. Secure Parents’ Consent for all the learner beneficiaries.
3. Arrange an education and training schedule with the JDVP-TVI that is convenient
and responsive to the needs of the learner-beneficiaries.
4. Assign a Teacher JDVP Coordinator, TVL Teacher to regularly confer with the
trainer of the JDVP TVL Partner on the implementation of the agreement discussed
during the orientation.
5. Monitor the attendance and the participation of the learner-beneficiaries.
6. Ensure safety and protection of the learner-beneficiaries in the whole duration of the
training.

C. Responsibilities of the Training Provider/JDVP-TVL Partner

The Training Provider Shall:

1. Provide effective trainer’s to ensure the beneficiaries learning.

2. Provide the needed education and training of the learner-beneficiaries of 320 nominal
hours.
3. Exercise due diligence to ensure protection and safety of the learner-beneficiaries
during the whole duration of the training.
4. Provide adequate tools, equipment and facilities and other operational expenses
necessary for the beneficiaries learning inclusive of the sufficient consumables which
contribute great factor in learning.
5. Provide input through discussion or enhancement to the learner beneficiaries.
6. Provide free assessment to SHS beneficiaries including transpitation in going to
assessment center and going back to Cogon National High School.
7. Monitor the delivery of the education and training by the assigned trainers and
participation of the learner’s beneficiaries.

EFFECTIVITY

This agreement shall hold for the duration of the academic School Year 2022-2023 and is
renewable every school year upon the agreement of both parties.

The TRAINING PROVIDER and the SCHOOL in this DIVISION reserve the right to terminate
their participation in the agreement through formal written notice 30 days before the effectivity
of the termination.

LIABILITY

The school, training provider exercising authority and supervision over the trainees may be held
responsible for the trainee’s act.

Each party shall be held liable for any loses, damages, and any accident, act, or omission directly
attributed to its fault or negligence.

IN WITNESS WHEREOF, we hereunto affixed our signatures this _______ day of ______
