AFFIDAVIT

(RE: RETURN AND CLAIM OF FALSELY CLAIMED BAGGAGE AND


DECLARATION OF NO LIABILITY)

I, DEVAK KAPUR , of legal age, married, and a citizen of Australia, with email
address, _________________________ having been duly sworn in accordance
with Philippine law, hereby depose and state:

1. I arrived to the Philippines together with my wife Norvelle Kapur from


Australia last April 10, 2022 via (flight details);

2. Before I left for said trip, as there was no more room for my luggage at the
compartment above or near our seat in the economy class section located at
the rear part of the plane I was advised by the flight attendant to place my
hand-carry luggage (Black Travelling baggage) containing our personal
belongings in the compartment in the first class section located at the front
portion of the plane to which I agreed;

3. That upon arrival at the Philippine airport and before boarding off the plane,
I walked towards the compartment where my luggage was placed and
naturally took the same, as our bag was one of the few that remained
considering we were ones of the few who last boarded off the plane;

4. As me and my wife were about to leave the airport after checking out, my
wife noticed that the bag we were carrying was not our bag. The appearance
of the bag resembles that of our actual bag as it made of the same material,
same shape and color but without the lock which my wife placed before the
flight;

5. After we discovered that the baggage we were carrying was not ours, we
immediately proceeded to look for any airport personnel at the lost and
found section to report on the matter. As such, we were able to talk to an
airport manager. We informed her that the luggage we are carrying was not
ours and that somebody might have mistaken our bag as theirs;

6. After reporting to her what happened, she went looking for the owner
afterwards came back to me and said she can’t locate him/her and no bag is
left by any passenger in the lost and found section. I was advised by the
ground staff to take the bag with me and just leave my number so that if
someone contacts them they will give him or her my number and we switch
bags;

7. Heeding the advise by the Philippine Airline Staff and after giving them my
contact details, me and my wife went out of the airport with the baggage and
proceeded to our destination;

8. The night of April 10, 2022, someone from the Philippine Airline Baggage
Tracing Department sent me an email informing me that a certain passenger
from the same flight named ONKAR falsely claimed our baggage and
returned it to PAL’s counter in Business Lounge and that it was endorsed to
their Lost and Found Section. In the same email I was advised to return the
other passenger’s baggage or else they will report me to Philippine
Immigration Police as the other passenger urgently needs it;

9. I find PAL’s email specifically the part where I was threatened to be


reported to the Immigration Police if I do not return the other passenger’s
luggage immediately, reprehensible and unfair. Firstly, it was not my fault
that I took the wrong baggage as someone was not careful enough and
mistook my bag as his, otherwise, as diligent as I am, I would not have taken
someone else’s belonging. Secondly, I was willing to leave the wrong
baggage right there and then but I was advised by PAL’s personnel to take it
home and they will just contact me. I am ready and willing to return the
wrong baggage on my end but the airline company must also consider that it
is also inconvenient, difficult and costly for me to travel right away to the
airport as I was staying 800 kilometers away and could only go to the airport
on April the 22nd when I depart to Australia, hence the warning was uncalled
for and is not the proper way to treat a passenger they say is “valued”;

10.Regardless of the uncalled for way of demanding, I am hereby returning the


wrong baggage in my possession, using my own expense and despite the
inconvenience, COMPLETE, INTACT and WITHOUT DAMAGE as I also
expect my equally important luggage to be returned to me in the same
condition;

11.I understand that providing false information is a violation of the Philippine


law and could lead to criminal prosecution and additional charges against
me. I further understand that this is my only opportunity to state that it was
not my fault I got the wrong luggage as another passenger mistook by
luggage first. I have no intention of stealing any other passenger’s belonging
as this is also a crime in the Philippines as well as in my country. I should
not be held liable for the above-stated reasons..

12.As such, I am executing this Affidavit to certify or attest to the truth of the
foregoing facts and for purpose of denying any liability that will cause me to
be reported in the Immigration Police and for whatever legal purpose that
this Affidavit may serve.

ACKNOWLEDGMENT

BEFORE ME, a Notary Public of Pasay City, the Philippines, this 12 th day
of April 2022, personally appeared the person whose name and signature with
corresponding proof of identity written above, known to me and known to be the
same person who executed the foregoing instrument constituting of three (3) pages,
including the page wherein this acknowledgment appears and acknowledge before
me that the same is his free and voluntary act and deed.
