MALAYANG SINUMPAANG SALAYSAY NG PAG-ARESTO AT PAG- REREKLAMO1

Kami sina, PO1 MIGUEL DELA CRUZ at PO1 ARNOLD MARCELINO, pawang nasa
wastong taong-gulang, at mga miyembro ng Pambansang Pulisya ng Pilipinas (PNP) at kasalukuyang
nakatalaga sa Station Drug Enforcement Unit (SDEU) ng Muntinlupa City Police Station, na matapos
makapanumpa ng naayon sa ating Bagong Saligang Batas na umiiral sa kasalukuyan ay malaya at kusang
loob nagsasaad ng mga sumusunod;

Na, kami ay inatasan ng aming Hepe na si Police Superintendent ANNIE BUBA na magsagawa
ng pagmamatyag at pag- oobserba tungkol sa mga taong nasasangkot sa pag-gamit, pagdadala at
pagbebenta ng illegal na droga sa aming nasasakupan lalo na sa Purok-6 Brgy. Bayanan Muntinlupa
City kung saan laging nauulat na laganap ang bentahan ng pinag babawal na droga, gamit ang aming
sasakyan na isang Toyota Innova na kulay puti at may plakang TK 5034 ay nagsagawa na kami ng
nasabing operasyon;

Na, humigit kumulang 04:30 ng madaling araw ika-7 ng Marso 2022 ay narating naming ang
nasabing lugar, at kami (PO1 MIGUEL DELA CRUZ at PO1 ARNOLD MARCELINO) ay nag
simula mag lakad sa nasabing lugar ng may nakita kami isang lalaki (later identified as ANTON
GABITO y GABON, @Atong) na nakaupo sa isang nakaparadang tricycle, at ng ako (PO1 ARNOLD
MARCELINO) ay papalapit na sa nasabing lalaki (@Atong), ay mabilis itong tumakbo, dahil dito ako
(PO1 MIGUEL DELA CRUZ) ay mabilis na hinabol ang nasabing lalaki at hindi sa kalayuan ay akin
itong na abutan, at doon ay agad akong nag paikilalang pulis at agad inresto ang nasabing lalaki;

Na, ako (PO1 ARNOLD MARCELINO) sa aking pag iimbistiga sa tricycle ay may nakitang
isang (1) piraso ng heat sealed na transparent plastic sachet na naglalaman ng puting crystalline
substance na pinaghihinalaang shabu (later marked with “AG”) na maaring pag aari ng tumakbong
lalaki (@Atong);

Na, matapos noon ay aming sinabihan ang nasabing lalaki (@Atong) ng kanyang mga karapan
alinsunod sa ating umiiral na Bagong Saligang Batas ng Pilipinas, at agad namin siya dinala sa aming sa
Opisina (SDEU) Himpilan ng Pulisya ng Lungsod ng Muntinlupa para makuha ang kanyang
pagkakilanlan at dinala na namin siya sa Ospital ng Muntinlupa (OSMUN) upang ipa-medikal at physical
na examination at muli ay dinala sa aming opisina para sa kaukulang imbestigasyon at disposisyon;

Na, ang nasabing suspek ay aming nakilala sa pangalan na kanyang ibinigay na ANTON
GABITO y GABON, @Atong 29y/o (DOB March 29, 1987), male, single, tricycle driver residing at
Block 201 Brgy. Bayanan, Muntinlupa City;

Na, ang mga nakuhang isang isang (1) piraso ng heat sealed na transparent plastic sachet na
naglalaman ng puting crystalline substance na pinaghihinalaang shabu (later marked with “AG”) ay
aming ginawan ng imbentaryo, at kinunan ng litrato at matapos magawan ng ilang dokumento ay dinala
ko ((PO1 ARNOLD MARCELINO) sa tanggapan ng SPD, PNP Crime Laboratory, sa Lungsod ng
Makati City para sa kaukulang pagsusuri at pag-iingat;

Na, itong si si ANTON GABITO y GABON, @Atong ay ipaghaharap namin sa kasong


paglabag sa Sec. 11 Art II ng RA 9165 (Comprehensive Dangerous Drug Act of 2002) sa piskalya ng
Lungsod ng Muntinlupa para sa disposisyon ng nasabing kaso;

Na, bilang patotoo sa lahat ng nilalaman ng salaysay na ito, kami ay kusang loob na nilalagdaan
ang aming mga salaysay at sa ibabaw nito ay ang aming mga pangalan.

After the arrest, the case underwent inquest proceedings. The respondent was then
assisted by the Public Attorney’s Office, after being duly advised the respondent opted to not
undergo preliminary investigation and a “REFUSED TO SIGN” was annotated on the waiver.

Together with the Malayang Sinumpaang Salaysay Ng Pag- Aresto at Pag- Rereklamo
are the following documents:

1. Referral for Inquest by the Investigating Officer to the Duty Prosecutor;


2. Attestation by the Investigating Officer;
3. Inventory of Seized Items, unsigned, except by PO1 Arnold Marcelino;
4. Request for Laboratory Examination.
5. Physical Science Report, showing that the specimen submitted for laboratory
examination tested positive for methamphetamine hydrochloride and weighed 5.02
grams.
6. A Chain of Custody Form showing the name and signature of PO1 Arnold Marcelino
and the time of arrest and seizure, only.
7. Photograph of transparent plastic sachet containing white crystalline substance with
marking “AG”.
8. Mug shot of the accused.
9. Booking and Information Sheet of the accused.
10. SPOT Report.

The case was raffled to RTC Branch 123, Muntinupa City as Criminal Case No. 19-
1234. On April 2, 2022, the accused was arraigned and pleaded not guilty for Section 11, R.A.
9165.

On April 9. 2022, the Pre- Trial proceeded and the following matters were taken up:

ADMISSIONS

1. The jurisdiction of the court and the identity of the accused as shown in the
Information.
2. The existence of Chemistry Report 123
3. The expertise of Police Chief Inspector Kiki Castillo in Forensic Chemistry.
4. The case is an inquest case.

ISSUES

1. Whether or not the arrest of the accused is valid without a warrant.


2. Whether or not was found in possession of the dangerous drugs.
3. Whether or not the chain of custody of the items has been sufficiently established.
4. Whether or not the accused is guilty as charged.

During the Initial Trial of the case om April 16, 2022, the prosecution and the defense
entered into stipulation with respect to the testimony of the Forensic Chemist Diego Ardan to
wit:

1. The expertise of PCI Diego Ardan in Forensic Chemistry.


2. That the witness is a Forensic Chemist at the Southern Police District, Crime
Laboratory who examined the specimens subject of the case.
3. That PCI Ardan received the specimen from PO1 Arnold Marcelino on March 8,
2019 at around 2:00 P.M. as shown by the “stamp received” by the SPD Crime
Laboratory on the Request for Laboratory Examination.
4. That PCI Ardan is also the receiving Clerk during that time.
5. That the witness received the specimens in the condition stated in the Request for
Laboratory Examination.
6. That the result of the examination was reduced into writing in Chemistry Report No.
123 and the contents thereof are accurate.
7. That after examination of the specimens the witness placed seals, tapes and his
markings on the items and submitted the same to the evidence custodian for
safekeeping.
8. That the witness withdrew the evidence from the Evidence Custodian with his
marking and seals that all intact.
9. That the evidence was never changed, altered or adulterated in any manner while in
the custody of the Forensic Chemist or Evidence Custodian.
10. That the item tested positive for methamphetamine hydrochloride, a dangerous drug.

All of which were admitted by the defense with a qualification that the witness has
no personal knowledge of the source or origin of the specimen seized. Hence, the
testimony of PCI Diego Ardan was dispensed with.

On August 2, 2022, the prosecution and the defense entered into stipulation with respect
to the testimony of the Evidence Custodian PCI Rainer Buba to wit:

1. That PCI Rainer Buba is the Evidence Custodian of the SPD, Crime Laboratory,
Makati City.
2. That the Forensic Chemist, PCI Diego Alarva turned over the specimens to him on
March 8, 2019 at around 4:30 P.M.
3. That the witness was the one who released the specimens to the Forensic Chemist for
turn over to the honorable court.

All of which were admitted by the defense with a qualification that the witness has no
personal knowledge of the source or origin of the specimen seized. Hence, the testimony of
PCI Rainer Buba was dispensed with.

On February 5, 2023, the prosecution presented the arresting officers.

I. Imagine that you have been engaged as counsel by the accused before Arraignment
render a legal advice regarding his defense and course of action that you will take as
a lawyer.
II. Prepare cross examination questions for the arresting officers, consider their
Sinumpaang Salaysay ng Pag- Aresto at Pagrereklamo as their direct testimony.
III. After the presentation abovementioned witnesses, the prosecution rested its case and
formally offered its evidence orally during the hearing, comment and objection was
made by counsel for the accused. The pieces of evidence offered by the prosecution
was admitted by the honorable court over and above the comment and objection of
the defense subject to the appreciation of its probative value. Believing that the
prosecution was not able to prove its case, file a Motion for Leave to File Demurrer
to Evidence and Demurrer to Evidence.
IV. Alternative Scenario: The accused manifested his willingness to enter into plea
bargaining. Prepare a Motion to Allow the Accused to Enter Into Plea Bargaining
Agreement.
