MEZZANINE SLAB

Our supply includes Support columns, Primary beams and Secondary Joists that support
reinforced concrete slab (by others). Before pouring concrete for the slab, a formwork and
supporter system has to be made to carry the weight of the wet RC slab during construction. This
supporter system has to be checked.

Section 2 Applicable Codes

The Pre-Engineered Building described in these calculations was designed according to the
U.S.A. Buildings and Design Codes that have been referred to in the design:

1. The loads have been applied on the structure in accordance with:


ASCE 7-10 “American Society of Civil Engineers “Minimum Design Loads for
Buildings and Other Structures. 1801 Alexander Bell Drive Reston, Virginia 20191.
Note: Live load considered on frames is 30 Kg/m2 according to TCVN2737-
95.

2. The deflection limits have been applied on the structure in accordance with:
MBMA 2010 "Metal Buildings Manufacturers Association" Metal Building Systems
Manual, 2010 Edition. 1300 Summer Avenue, Cleveland, Ohio 44115.

3. Hot rolled sections and built up components have been designed in


accordance with:
- AISC 360-10 “American Institute of Steel Construction" ASD (Allowable Stress
Design). One East Wacker Drive, Suite 700 Chicago, Illinois 60601-1802.
- IBC 2012 “International Building Code" 4051 West Flossmoor Road, Country
Club Hill

4. Cold formed components have been designed in accordance with:


- AISI S100-2007 “American Iron and Steel Institute" Cold Formed Steel Design
Structure members, 2007 Edition.

5. Welding has been applicabled in accordance with:


- AWS D1.1/D1.1 M :2010" American Welding Society" Structural Welding
Code- Steel Manual, 22nd Edition. 550 N.W. Lejeune Road, Miami, F1 33126.

Section 4 Steel Work Finish

• All primary steel member (column and rafter) and secondary member (Bracing, Rod…)
will be cleaned and painted at our factory with one coat of red oxide primer .
• Secondary member of frame (Purlin & Girt) shall be cold formed from galvanized steel
coil.

Section 5 Standard Supplied Items

The following are normally supplied unless mentioned otherwise:


• Electricity galvanized Anchor Bolts for rigid frames, end wall posts and framed wall
openings.
• All necessary Flashings & Trims
• Connection bolts, Sheeting Fasteners

Section 6 Delivery and Storage at Site

Loading at : BMB&A factory in Tan Uyen – Binh Duong Province


Discharge at : Jobsite of Customer located at Poipet, Banteay Meanchey
Partial Shipment : Allowed
6.1 When Seller meets Force Majeure causing a delay in delivery, the delivery time shall be
extended automatically by the period of delay caused by the Force Majeure
6.2 Seller will inform the customer about detail delivery by Fax or Mail 3 days before shipment
6.3 The Customer is responsible for accurately checking the materials upon delivery and
acknowledging such delivery by duly signing on the “Material Delivery Note” at site. The
Buyer must report to the Seller by writing any damages / shortages upon the delivery time.
After 7 days from the delivery day, if Seller is not received any writing report of damages/
shortages, the delivery responsibility of Seller is complete.
6.4 Buyer is responsible for the management of buyer’s contractors on site. Buyer must pay the
cost for fixing / damages of Seller’s good on site that caused by others.
6.5 Storage: Should a customer delay dispatch of goods for a period exceeding 15 days after
the originally scheduled dispatch date, STORAGE CHARGES shall be levied by Seller at
the rate of 0.1% of the ex-works selling price (of the unshipped material) per day but can
not exceed 30 days. In this case, Seller is complete the Fabrication and Delivery
responsibility, the buyer must follow the payment term.

2. The price above is including transportation fee.
3. The price for painted panel as quoted here is subject to standard color only. Any special
color requested may lead to extra price & time according to current market situation.
4. The contract value only be changed (increase or decrease) after contract signature if the
scope of work changes (increase or decrease) and an Appendix signed by both parties.
5. The contract amount is a lump sum fixed price for design, supply and construction of
pre-engineered steel building works contract and shall not to be subjected to re-
adjustment of unit rate and the quantities shall not be re-measured according to the
actual work done.
6. Scope of Erection Services:
¾ Unloading material at jobsite.
¾ Erection of steel structure
¾ Installation of Insulations (if applicable)

Section 8 Payment Terms & Bank Details

A. PAYMENT TERMS
40% of down payment shall be paid not later than 07 days from the date of signed contract.
The balance (60%) is secured payment by bank guarantee, according to the form and issued
by the bank acceptance to BMB&A, and shall be paid as following:
• 30% of contract value within 07 days from the date of delivery of frames and purlins
at site.
• 25% of contract value within 07 days from the date of delivery of all remaining
materials (Panel, gutter, and downspout) at site.
• 5% of contract value within 07 days from the date of completion of erection.
Note:
1. Any delay in payment will be subject to an interest charge at 0.5 % per week.
2. Working schedule will extend equally with delayed payment. In this case, Seller will not
be responsible for the cost caused by delayed working schedule..
3. The Bank Guarantee should be valid equal to …. % of the contract value in the
period of ….days from the day of issue.
4. The Bank Guarantee shall be extended twenty one (21) days before expiry date if the
full payment is not received by the Seller and for any reason.
5. For each payment period, BMB will issue VAT invoice that is worth as the same
value of that payment period. The first payment period is the exception, will not be
issued. VAT invoice will be issued on the second payment including the value of the
first payment period.

Section 9 Supply And Erection Period

A. SUPPLY PERIOD
1. Our current Delivery Period is to start 8 weeks from the latest date of receipt and
acceptance of the following at our Head Office:
a. Signed & stamped contract (Any change must be noted and initialed by both
parties)
b. Down payment
c. Signed final Approval Drawings
d. Bank Guaranty Letter is acceptable.
2. Please allow a minimum of 02 weeks for Approval Drawings submittal, or 3-4 weeks if
buildings are complex.
3. The Delivery Period is considered to start on the date of first delivery of the materials to
the carrier.
4. Customer is responsible for confirmation of Approval Drawings (duly signed in red in
red ink and stamp) and returns it to Seller’s office within 01 week of receipt. Any
delays in returning the Approval Drawings back to Seller may result in changes of our
delivery commitment and Contract price.
B. ERECTION PERIOD
1. Within 8 weeks from the latest date of delivery of materials at jobsite.
2. Installation work shall be started right after Buyer completes the progress payment in
Section 8
¾ Working schedule will be extended equally with delayed payment
3. The erection schedule will be extended equally with caused by Force Majeure such
as storm, flood, heavy rain, earthquake, fire ...

Section 10 Changes / Revisions

10.1 Any change and / or revision to the above stated scope of supply may lead to a variation in
the price and the delivery period. An Appendix shall be signed to reflect the changes on
scope of supply and price before the variation works are carried out. A change must not
hold payment for work completed in accordance with the contract.
10.2 Since Seller complete the delivery or start to erect building at site, any variation or revision
of Customer (if any) will lead to a variation in price of erection and erection period.

Section 11 Exclusions

11.1 Any material not specially mentioned is exclusive from this contract
11.2 Any supply & erection scope specially mentioned in Section 1 and section 7 is exclusive
from this contract.
11.3 Seller’s work does not include any material or labor in connection with foundations,
concrete, grouting under columns or in recess around bottom of wall sheets, electrical
installations, plumbing, interior finishing.
11.4 The “Construction licenses” is at Customer’s responsibility.
11.5 Seller is not responsible for any rust damage that might occur / appear on the steel due to
long storage periods on site.

Section 12 Standard Erection Conditions

12.1 Erection to be undertaken on a clear, level and unobstructed & strong enough floor slab,
with suitable access for cranes and forklifts. The extra of cost, time caused by this problem
is not subject to Seller’s responsibility.
12.2 Customer is responsible to apply, clear, level and compacted access at least for 3 M
around the building, suitable for discharge and erection.
12.3 The Buyer must be responsible for making the plan site ready for site activities including
temporary road for facilitating the erection equipment.
12.4 Seller have the right to claim any cost because of extension and / or frequent interruption of
Erection, dismissing or re-execution the work that not the Seller’s causes. This cost is
inclusive but not limited in labor salary, equipment cost and others.
12.5 Customer is responsible to supply the power during the time of erection.
12.6 Buyer's representative will check and hand over completion work report gradually base on
Seller’s Project Managing Process. The confirmation of completing installation on the
whole project bases on the document of Project Supervisor.
12.7 Installation work shall be started right after Buyer completes the progress payment.
12.8 Seller’s workers as well as equipments need agreement of Customer to enter or go out the
site.

Section 13 Other Terms

13.1 Both parties agreed that the price quoted in this proposal is based on a lump sum basis
calculated according to the building descriptions in section 1 as well as requires loading
and code show above and not as a re-measurable basis. Therefore, the Bill of Quantity
given at the proposal is only indicative and not used to re-calculate the value of the project
after Seller finishes responsibilities of supply / erection.
13.2 The acceptance minutes of work item, the requirement of acceptance minutes of work item
in writing, the complete certificate of erection works or the requirement of the complete
certificate in writing be approved by the Customer within 07 days as from the date of Seller
informs to Customer officially in writing. After 07 days from the noticed date of completion
of contractual work, if the Customer postpone on approval for the completion certificate
without any right reason in writing by Customer, the contractual works of the Seller is
automatically become fulfill. The Customer has obligation to pay the Seller as the term of
this Contract based on the noticed date of completion set by the Customer.
13.3 The price of supervision, test that different from Seller Quality Management Standard is
exclusive from this proposal. The Buyer will pay all cost for additional testing.
13.4 If the buyer violates the progress of payment in section 8, the entire Seller’s possession
(material, fabricated material, delivered material, erected material…) will be decided by the
Seller.
13.5 Contract / orders CANNOT be cancelled or modified by BUYER under any circumstances
without BUYER first reaching an agreement in writing with Seller damages. If Seller agrees
for cancellation or modification, the Buyer agrees to promptly pay all reasonable expenses
for the Seller that involves the contract and not less than 20 % value of the contract in any
case.
13.6 Force Majeure: due to circumstances beyond Seller’s control such as war, riots or the
adoption of any laws, regulations, orders, or acts of any authority directly or indirectly
interfering with the production or delivery of the products, floods, fires, weather condition,
delays in or shortage of transportation or inability to obtain labor, power failure or any
circumstances or event beyond the Seller’s control.
Seller does not responsible for delayed schedule, damages, lost caused by Force Majeure.
13.7 If Seller and Buyer have dispute during the time executing contract, at first, two parties
should negotiate to find best solution base on corporative, fair spirit. If the dispute cannot
be solved, the Seller and Buyer must follow decisions of the judge. The applicable law is
the Commercial Law issued 2005.
13.8 This Contract is made of four (04) original sets. All four (04) original sets shall be signed
and, dated by both parities. Each party to keep two (2) sets.

Section 14 Warranty

14.1 Seller is responsible for warranty of material of this project within 365 days from the date of
completion.
14.2 Seller is responsible for warranty of design of this project within 10 years from the date of
completion.

Section 15 Workshop Fabrication Inspection

15.1 The quality fabrication inspection program of Steel Structure (ITP) at Factory will be applied
to BMB’ Quality Fabrication Procedure”. This full-set of document will provide to the Customer
when signing acceptance minute and hand-over steel structure item of project.
15.2 The Customer have right to rent a third party to inspect quality fabrication at factory (check
welding line… etc). All of inspection fee will be paid by Customer. The fabrication inspection
steps of steel structure by 3rd party (if any) will be inspected at Factory and must to sign
acceptance before delivery to the site.
15.3 The Buyer (BMB) have right to deny the inspection steps of third party if this is un-reasonable
inspection requirement.

Section 16 Validity of Price

This proposal is valid for 10 days from the above noted date. Any extension of validity by
Seller must be in writing.

Should there be any conflicts, discrepancies or ambiguity among these documents, priority
shall be given in order as listed below:
1. BMB&A’s Proposal No. BMB&A 103/17, Rev.02 Dated 02-Feb-2017 with agreed and
initiated amendments (if any).
2. Signed final approved Drawings
3. BMB&A’s Standard Product Specifications

The effective date of Contract shall be the later of any one of the following events:
a. The later date of signing this Contract by both Parties.
b. Seller’s receipt of the Down Payment.
c. Seller’s receipt of the Final Change Order.
