AGREEMENT TO CONSTITUTE EASEMENT

KNOW ALL MEN BY THESE PRESENTS:

            This AGREEMENT, made and entered into on this ______ day of ______________, 2020
by and between:

NAME, of legal age, Filipino, married to NAME and a resident of

______________________________________, hereinafter referred to as the
GRANTOR,

and

NAME, of legal age, Filipino and a resident of ADDRESS, hereinafter referred to

as the GRANTEE.

WITNESSETH:

WHEREAS, the GRANTOR is the owner of a parcel of land located in ADDRESS, covered

by Tax Declaration No. ----------------- with Property Identification No. ------------ which lot is
adjacent to the GRANTEE’S property, which is covered by Tax Declaration No. _____________
with Property Identification No. _____________________________.

WHEREAS, the property of the GRANTEE has presently no convenient outlet to a public
highway, except through the estate of the GRANTOR.

WHEREAS, The GRANTOR is willing to grant to the GRANTEE a perpetual and permanent
easement of right of way consisting of a strip of land for the consideration and under the terms
and conditions set forth herein.

            NOW THEREFORE, for and in consideration of foregoing premises, the parties have
agreed as follows:

1. The GRANTOR hereby grants unto the GRANTEE, a perpetual and permanent easement
of right of way over the above-described land of the GRANTOR, said easement to cover
and embrace a strip of land measuring _____ meters wide and _____ meters long,
running across the property of the GRANTOR and connecting the property of the
GRANTEE to the nearest public road or highway, as shown on the sketch plan which is
attached hereto and made an integral part hereof as Annex A.

2. For and in consideration of the use and enjoyment of the land herein granted for the
purpose above indicated, the GRANTEE shall pay to the GRANTOR a one-time fee in the
amount of AMOUNT PESOS (P0.00), the receipt whereof is hereby acknowledged by
GRANTOR.
 3. It Is further agreed that the GRANTOR shall deliver unto GRANTEE all the
necessary papers, deed, and titles in relation to the servient estate in order
to facilitate the registration of the above-mentioned right of way.

            This agreement shall be binding between the parties and upon all their heirs, successors,
and assigns.

            IN WITNESS WHEREOF, the parties hereto have signed this agreement the day and the
