BAC RESOLUTION RECOMMENDING TO THE DISTRICT ENGINEER TO RESORT TO

ALTERNATIVE METHOD OF PROCUREMENT (NEGOTIATED PROCUREMENT -
EMERGENCY CASES)

WHEREAS, on 9 March 2020, the President signed Proclamation No. 922 declaring a State of
Public Health Emergency throughout the Philippines upon the recommendation of the DOH
following the confirmed local transmission of the novel coronavirus disease (COVTD-19);

WHEREAS, per GPPB Resolution No. 3-2020, dated March 9, 2020, under the State of Public
Health Emergency, the relevant government entities shall be capacitated to facilitate the
sufficient and immediate access to funding, particularly for all concerned government agencies
and local government units, intensify government response and measures such as easing
procurement process, mandatory reporting, and enforcing quarantine and disease control
prevention measures;

WHEREAS, Section 53 of the 2016 Revised Implementing Rules and Regulations of Republic
Act No. 9184 provides that Negotiated Procurement is a method of procurement of Goods,
Infrastructure Projects, and Consulting Services, whereby the Procuring Entity directly
negotiates a contract with a technically, legally, and financial capable supplier, contractor,
or consultant in any of the following cases:

"53.2. Emergency Cases. In case of imminent danger to life or property during a state
of calamity, or when time is of the essence arising from natural or man-made calamities
or other causes where immediate action is necessary to prevent damage to or loss of
life or property, or to restore vital public services, infrastructure facilities and other public
utilities. In the case of Infrastructure Projects, the Procuring Entity has the option to
undertake the project through negotiated procurement or by administration or, in high
security risk areas, through the AFP."

WHEREAS, on the 16th of March 2020, Proclamation Order No. 929, series of 2020, was issued
by President Rodrigo R. Duterte declaring a State of Calamity throughout the Philippines due
to the Corona Virus Disease 2019 enjoining all government agencies and LGUs to render full
assistance to and cooperation with each other and mobilize the necessary resources to
undertake critical, urgent and appropriate disaster response aid and measures in a timely
manner to curtail and eliminate the threat of COVID-19;

WHEREAS, due to the foregoing the Planning and Design Section submitted the Plans and
Program of Works for the project Construction of Isolation Facility at Talairon, Oroquieta City,
Misamis Occidental under the following:

WHEREAS, Contract ID No.: 201(10099 is included in the CV 2020 approved Supplemental

Annual Procurement Plan (APP);

NOW, THEREFORE, WE, the Members of the Bids and Awards Committee, hereby
RESOLVED to recommend to the District Engineer of DPWH - Misamis Occidental 1g District
Engineering Office, for approval, the use of Alternative Method of Procurement (Negotiated
Procurement— Emergency Cases) under Section 53.2 in procuring Contract ID No.: 201(10099-
Construction of Isolation Facility at Talairon, Oroquieta City, Misamis Occidental.

RESOLVED, at DPWH - Misamis Occidental 1 51 District Engineering Office, this 7th of

September 2020.
