DEED OF USUFRUCT

KNOW ALL MEN BY THESE PRESENTS:

This DEED is made and executed by and between

The PHILIPPINE NATIONAL POLICE (PNP), POLICE REGIONAL OFFICE 6

(PRO 6), an agency of the National Government created and existing by virtue of and
pursuant to R.A. 6975, as amended by R.A. 8551 and R.A. 9708, with principal office
address at Camp Gen Martin Teofilo B Delgado, Fort San Pedro, Iloilo City, Philippines,
represented herein by the Regional Director, PBGEN RENE P PAMUSPUSAN,
hereinafter referred to as the GRANTOR;

AND

The OFFICE OF THE CIVIL DEFENSE 6 (OCD 6), a government agency of the
Republic of the Philippines with principal office address at Camp Gen Martin Teofilo B
Delgado, Fort San Pedro, Iloilo City, Philippines, represented herein by the Regional
Director, JOSE ROBERTO R. NUÑEZ, hereinafter referred to as the GRANTEE;

WITNESSETH

WHEREAS, the GRANTOR is the owner of a parcel of land (Original Certificate

of Title No. S-11), more particularly described as follows:

“A parcel of land (Plan of Land No.06-000024, situated in Brgy. Camp Martin

Delgado, Iloilo City).

Bounded on the NW., along line 1-2 by Existing Road (10.00 m. wide); on the NE.,
along lines 2-3-4-5 by the Road (20.00 m. wide); and on the SE., along lines 5-6-7 by
the National Road (30.00 m. wide); and on the SW., along line 7-8-1 by Existing
Road (10.00 m. wide).

Beginning at a point marked “1” on plan being S. 80-14’E., 1098.52 meter from
BLLM No. 1, Iloilo Cad. 23, thence:

N. 32-09 ’E., 197.75 m. to point 2;

S. 55-25 ’E., 70.00 m. to point 3;
S. 58-38 ’E., 124.41 m. to point 4;
S. 61-53 ’E., 119.62 m. to point 5;
S. 12-36 ’W., 107.83 m. to point 6;
S. 10-17 ’W., 89.26 m. to point 7;
N. 61-05 ’W., 313.55 m. to point 8;
N. 60.07 ’W., 70.00 m. to point 1;

of the beginning; containing an area of SIXTY FIVE THOUSAND EIGHT HUNDRRED

NINTY SIX (65,896) SQAURE METERS, more or less. All corners referred to are
indicated on the plan and are marked on the ground by PS cyl. Conc. Mons. 15x40
cms. Bearing true, surveyed by Engr. Ernesto F. Ciriaco on September 16, 2003
and approved on December 11, 2003.”

WHEREAS, GRANTOR, by these presents offers for the use of the GRANTEE
the portion the abovementioned parcel of land which lot area consisting of
_______________ (_____________) SQUARE METERS currently occupied by OCD 6
for the improvement project of the OCD 6 and Operations Center.

WHEREAS, GRANTEE accepts the offer of the GRANTOR with gratitude and
deep appreciation.
 NOW THEREFORE, as an act of liberality and generosity, the GRANTOR
hereby voluntarily and freely transfers and conveys, by way of USUFRUCT to the
GRANTEE which the GRANTEE hereby accepts and expresses his appreciation and
gratefulness for the kindness and generosity of the GRANTOR for and in consideration
of the foregoing premises and of the mutual covenants hereinafter contained, the
parties hereby agree to the following terms and conditions:

1. TERM – GRANTEE is allowed full use or right of use through gratuitous act
for a period of _________ years, renewable for another extended period of
____________ years, provided that the property is to be solely and
exclusively used as the site of OCD 6 Office;

2. OWNERSHIP – While the usufruct and/or the beneficial use of the land is
transferred to the GRANTEE, the ownership and title remains with and
continues to be in the name of the GRANTOR;

3. OTHER TERMS AND CONDITIONS:

a. The property shall be used exclusively by GRANTEE as the site of their

Office, which shall be used for their official functions;

b. GRANTEE, upon proper coordination with and approval of the GRANTOR

may introduce facilities and/or improvement that may be necessary for
the proper and beneficial use of the property; and

c. In case the OCD 6 will be abolished or it’s office will transfer to other
place, the GRANTEE’s building and improvements will be automatically
given to the GRANTOR.
