CONTRACT OF SERVICE

THIS CONTRACT IS MADE AND ENTERED INTO BY AND


BETWEEN:

The DEPARTMENT OF AGRARIAN REFORM (DAR),


AKLAN, a government agency with office address at 2nd
Arcada Prime Building Corner M. Laserna- G. Ramos Sts.,
Kalibo, Aklan, duly represented by MA. TERESA C.
VALENCIA, Provincial Agrarian Reform Program Officer II
of Aklan, hereafter referred to as the "FIRST PARTY";

and

CHIE-ANN S. MACABANTE of legal age, Filipino, single


and a resident of Mobo,Kallbo,, Aklan, hereafter referred to
as the "SECOND PARTY";

W IT N E S S E T H :

WHEREAS, the FIRST PARTY is in need of the service of LCMS


DATABASE ADMINISTRATOR/ TECHNICAL SUPPORT at the Office of the
PARAD crucial for the Agrarian Justice delivery;

WHEREAS, the SECOND PARTY possesses the education, experience


and skills required to perform the job, as describe herein;

WHEREAS, the SECOND PARTY hereby attests that she is not related
within the third degree of consanguinity or affinity to the: 1) hiring authority
and/or 2) representative of the First Party; that she has not been previously
dismissed from government service by reason of any administrative offense;
and that she has no reached the compulsory retirement age of sixty-five (65);

WHEREAS, the SECOND PARTY commits that she will always uphold
the public interest over and above personal interest, and use all government
resources efficiently, effectively, honestly and economically, particularly to
avoid wastage of public funds and revenues;

WHEREAS, the SECOND PARTY commits that she will perform and
discharge her duties with the highest degree of excellence, professionalism,
intelligence and skill, and render service with utmost devotion and dedication
to duty;

WHEREAS, the SECOND PARTY commits that she will act with
justness and sincerity and not discriminate against anyone, especially the poor
and the underprivileged, respect the rights of others, and refrain from doing
acts contrary to law, good morals, good customs, public policy, public
safety and public interest;

NOW THEREFORE, the parties agree as follows:

1. SERVICE AND COMPENSATI ON

The SECOND PARTY is hereby contracted as an LCMS


DATABASE ADMINISTRATOR/TECHNICAL SUPPORT for the period
of February 1, 2023 to June 30, 2023.

As agreed by both parties, the SECOND PARTY shall receive


a daily rate of SIX HUNDRED TWENTY-THREE PESOS AND 30/
100
(Php 623.30), payable every 15th and JQth of the month, subject to
all applicable deductions and other rules and regulations promulgated
and/or may be promulgated by concerned government institutions, and
upon submission of Daily Time Record (DTR) duly signed by her
immediate supervisor;

Likewise, the SECOND PARTY shall render not less than eight (8)
hours of work a day for Five (5) days, minimum total of Forty (40) hours
a week, with no noon break. In the exigency of service or as required
by the PARAD, the SECOND PARTY may render overtime work/service,
provided a certification to that effect shall be signed by the PARAD and
duly approved by the PARPO.

Lastly, DTR is the basis of the SECOND PARTY's attendance and


the payment of services rendered which shall not be processed until the
said DTR had been duly submitted. The SECOND PARTY and the
immediate supervisor's signatures signify their asses and/or attestation
to the time entries in the DTR.

2. TERMINATION OF THE CONTRACT

2.1 This contract shall cease at the end of the period stated
w ithout need of notice. However, this contract may be pre
terminated by the FIRST PARTY, provided that the SECOND
PARTY is informed in writing at least thirty (30) days prior to the
affectivity of such termination.

2.2 The services of the SECOND PARTY may likewise be


terminated earlier than the expiration date due to the failure to
provide the standard of service required under contract, breach of
any of the provisions of this agreement breach of trust, loss of
confidence, and for reasons detrimental to the interest of the
FIRST PARTY.

2.3 Over the same period, the SECOND PARTY may initiate the
termination of this contract provided that:

2.3. A. A written notice for the pre-termination of this


contract is subm itted by the SECOND PARTY stating therein the

reasons for the pre-termination of the contract, at least thirty (30)
calendar days prior to the proposed date of effectivity for contract
termination; and

2 .3. B. The written notice has been received, accepted and


approved in writing the FIRST PARTY.

2.4 The SECOND PARTY, upon the end of the period of this
contact or upon pre-termination thereof, shall promptly deliver to
the FIRST PARTY through its authorized representatives, all
property, documents, records, papers, and the live, which may be
in his possession or under his control and which relate in any way
to the functions and services of the FIRST PARTY and no copy of
such or any part shall be retained by the SECON D PARTY.

2.5 The SECOND PARTY shall only be granted clearance when


the latter is cleared of all money and other accountabilities upon
termination/exp iration of this contract.

3. CONFIDENTIALITY

The SECOND PARTY shall not, during the term of this contract
and within one (1) year after its expiration, disclose to any other person
or make use of, for her own benefit, any secret or confidential
information about pending and decided cases, internal communication
and correspondence, and other confidential information, data, files, and
documents and the like, to which shall come to her knowledge during
her employment or otherwise.

4. EMPLOYER-EM PLOYEE RELATIONSHIP

It is understood that this contract in so far as tenure in


government service is concerned does not create an employer
employee relationship between the FIRST PARTY and the SECON D
PARTY, that the services rendered hereunder are not considered and
will not be accredited as government service; and that the latter is not
entitled to benefits enjoyed by the regular personnel of the FIRST
PARTY such as, but not limited to, PERA, ACA and RATA. The
SECOND PARTY is not an agent of the FIRST PARTY for any intent or
purpose.

That in the event the Second Party will have to travel in relation
to his/her function or/by written Office Order of the First Party, the
Second Party may be allowed to claim travelling expenses in case of
leave-out activity in accordance with existing rules and regulations of
the Commission on Audit and in accordance within the budget threshold
stated below :

A. Actual transportation expenses supported by tickets/officia l


receipts and/or proof of payment;

B. Maximum allowable claims for meals and lodging per day is
stated below, provided that the Second Party will provide
official receipts for the said expenses;
