MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This contract for the Project-based Research Grant Batch 5-1 titled “Language Use and
Maintainance of IP Students of University of the Philippines-Manila” entered into this August
20, 2018 at the Philippine Normal University, Taft Avenue Manila, Philippines by and among:

The Philippine Normal University (PNU), the National Center for Teacher Education
created pursuant to Republic Act 9647 with principal address at Taft Avenue, Manila
represented herein by its President, ESTER B. OGENA herein referred to as “GRANTOR”;

and

MITZI RICA A. PALIMA, Faculty of the Philippine Normal University-Mindanao with


principal address at Prosperidad, Agusan Del Sur herein referred to as the “GRANTEE”.

Witnesseth, that:

Whereas, Section 3 of Republic Act (R.A) No. 9647, mandates PNU to conduct
researches, case studies, and other appropriate methodologies to enhance curriculum
and training designs for teacher training, teacher education, and continuing professional
education of teachers and education supervisors;

Whereas, PNU Board of Regents thru BOR Resolution No. U-1635, s. 2011,
approved the giving of Project-based Research Grants to faculty members,
administrators, and staff who wish to conduct research project without any claim for
non-teaching loads or over and above their regular and extra loads.

NOW, THEREFORE, for and in consideration of the foregoing and the stipulations herein set
forth, the parties hereby agree on the following:

I. Entitlement of the Grantee:

The GRANTEE, as the Project Leader, shall be given an amount of One Hundred
Thousand Pesos (Php 200,000.00) for this research. This amount covers all expenses for
the conduct of this collaborative research including the honorarium of all research
personnel and operating expenses as stipulated in the approved Line-Item Budget
hereto attached. The amount will be given in three tranches, full amount of operating
expenses upon signing of MOA, 80% of the personnel honorarium through request for
special order of payment upon submission of the completed research in publishable
format, and the remaining 20% of the personnel honorarium through request of special
order of payment upon acceptance and publication of the research article in a refereed
journal.

II. Obligations of the Grantee:

1. The research should be completed within the period of SIX (6) months starting July
1, 2015 to December 30, 2015.
2. The GRANTEE is accountable for the completion of this research within the period
approved.
3. A monthly progress report is required and should be submitted to the Educational
Policy Research and Development Center (EPRDC) for monitoring the progress of the
research study.
4. The full research report in a publishable format shall be submitted to the EPRDC
upon completion of the project.
5. A liquidation report of the operating expenses following the accounting and auditing
regulations shall be submitted upon completion of the project.
6. The release of the honoraria due to the research team shall be subjected to
submission of the research report and the liquidation report of the amount released
for the operating expenses.
7. The GRANTEE (or together with his/her co-researchers) is expected to deliver an oral
presentation of the completed research work in an appropriate forum.
8. The GRANTEE (or together with his/her co-researchers) is expected to publish in a
refereed journal within one year after the completion of the research project with
due recognition to PNU, if the publication is done outside of the university.
9. In the event the GRANTEE fails to complete the project within the approved
timeframe as a result of circumstances beyond his/her control, an extension not
exceeding 60 days may be allowed. If the GRANTEE still fails to complete the project
after the extension period, he/she should return all incentives provided within the
period of one year.

III. Ownership of the Research Outputs

The GRANTOR and the GRANTEE together with his/her co-researchers hereby
agree and understand that intellectual property rights, ownership and enjoyment
thereof arising from this study shall be governed by existing and future policies of the
GRANTOR on Intellectual Property Rights such as but not limited to the following:
1. The RESEARCH outputs developed from the study shall be jointly owned by the
GRANTOR and the GRANTEE and his/her co-researchers. Any publication arising
from the activities undertaken by virtue of and pursuant to this Contract shall clearly
establish and identify the Parties as source of the sources.
2. All reports arising from the activities undertaken by virtue of and pursuant to this
Contract shall be made in the name of the parties.
3. The GRANTOR shall have the right to freely use all data and findings by virtue of and
pursuant to this Contract for any of the purposes within its legal mandate. However
the GRANTEE shall in writing request permission from the GRANTOR on the intent to
use any of the data or information contained in the report and the purposes thereof.
4. Copyright, royalties, and other economic rights arising from work produced or
developed from the Project shall be owned by the GRANTOR and the GRANTEE and
his/her co-researchers in accordance with the following proportion as per University
Policy and Guideline:
GRANTOR – 60%
GRANTEE – 40% (TO BE SHARED WITH HER CO–RESEARCHERS)

IV. Amendments

The parties to this Contract, may by mutual consent and for as long as the same
is written in the purview of the law, accordingly reverse, modify, amend, delete any
word(s), phrase(s), sentences(s) or articles in this contract

V. Effectivity:

This Contract shall take effect upon the signing hereof by both parties.
