Greetings!

This is in connection to the letter of Mr. Marlon Erro, a resident of Wonderland, Iguig, Cagayan,
regarding his petition for the cancellation of subdivision plan Psd-(af)-02-057724 issued to lot 7410 Cad
293, located at Barangay Iraga, Iguig, Cagayan, and covered by Original Certificate of Title No. O-3293.

In his letter, Mr. Rabara claims that he purchased the two aliquot parts of the subject lot from
Lydia Casibang-Querubin and Narciso Edillo who purchased the same from Spouses Orlino Rabara and
Rosie Lucina-Rabara.

He also manifested that, the basis for the approval of the subdivision plan Psd-(af)-02-057724
was the “Deed of Donation” executed in your favor by your parents Orlino Rabara and Rosie Lucina-
Rabara

According to the provisions of existing laws, rules, and regulations involving the matter, and in
adherence to the principle of “procedural due process of law”, you are hereby directed to submit your
comment/opposition on the petition Mr. Rabara.

Submit the above-mentioned document including your supporting records within five working
days to the Office of the Surveys and Mapping Division (SMD), DENR Regional Office No. 02,
Tuguegarao City, Cagayan, after receipt of this letter.

Attached herewith is a copy of the letter and the Affidavit of Prior Declaration of Mr. Marlon
Oro, for your ready reference.

to issue a Certification ascertaining the location of Lot No. 3636 Pls-537.

Please be informed that we cannot yet give the desired document on the ground
that, the Office of the Surveys and Mapping Division (SMD) has yet to locate and project
in the Cadastral Maps and other related survey records the subject lot.

In this regard, we will later issue the desired certification after due verification of
the records and related documents.

ORDER OF INVESTIGATION
Records show that on July 27, 2021, Laura M. Nicolas, claimant of Lot A and B,
Plan Psu-124940 of the approved plan Psd-(af)-02-030148, issued an affidavit for the
cancellation of the plan previously issued to the subject lot, purposely to conform with
the Extrajudicial Partition of Estate executed by the Heirs of the registered lot
owners.

In view of the above stated petition, an investigation is deemed warranted

pursuant to the provisions of Article 39 of Section 211 of the Department
Memorandum Circular (DMC) 2010-13, otherwise known as the Adoption of the
Manual on Land Survey, and other related laws, rules and regulations on the matter.

The fact-finding team is hereby directed to conduct an investigation and submit a

report on the matter, as basis in the issuance of an order of cancellation.
