EMPLOYMENT CONTRACT

KNOW ALL MEN BY THESE PRESENTS:

I, , of legal age and who willingly enter into this


contract for probationary employee with the position of
deployed at Centrium Tower 2, Lot 41, Block, 2 Aseana Ave, Parañaque, Metro Manila

This aggreement includes the following consideration:

1. The EMPLOYEE shall be placed in six (6) months probationary period from
____________________ to _________________subject to renewal based on
Employer performance evaluation.
2. The EMPLOYER, at its option, may extend the contract period depending on
the employees performance evaluation.
3. As a Probationary employee, he shall faithfully abide, obey and comply with all
the rules and regulation of the Employer for the efficient operation of its
business and proper conduct of its employee as well as the rules, regulations
and policies of the clients;
4. That, for just and valid cause or whenever there is no project available due to
my inefficiency, incompetence, tardiness, gross insubordination of the period
herein agreed upon without any obligation of whatever kind or nature on the
part of the Employer.
5. Any falsification or misrepresentation of date declared by me in my application
for employment, which is made in conjunction with my contract, shall be
sufficient grounds for my immediate dismissal.
6. That, as an employee, I shall be entitled to daily wage of
Php ( .00) inclusive of E-
cola a provided however that if I fail to work on a day I shall not earn my
wage/allowances.
7. That, as a Probationary employee I understand that I will have flexible working
hours as required by the operation demand for 12 hours inclusive (1) hour
break time;

Remuneration:
1. That the EMPLOYEE salary breakdown is as follow:
Overtime Pay : Inclusive with my monthly salary
Holiday Pay : to be applied accordingly as per Dole rule
Night Differential: Inclusive with my monthly salary
13th Month Pay : to be applied accordingly as per Dole rule
Food Allowance: Food is provided
Mandatory benefits: Employer provide the Employer share and employee
share will be deducted to employee

Resignation:
2. If the EMPLOYEE desire to terminate the period of his/her employment he/she
shall give thirty (30days) written notice of such intended resignation otherwise the
remaining salary shall not be given to the EMPLOYEE” as payment for any losses
incurred by the company due to sudden resignation;

Compliance with Company Rules and Regulations:


3. The EMPLOYEE shall observe and comply with all the rules and regulations
promulgated by the EMPLOYER;

Exclusivity:
4. While I’m employed, I shall not engage in part or in whole, gainfully or not, in any
capacity, with any other business, company, or concern without prior written
information to and written consent of the EMPLOYER.
Confidentiality:
5. The EMPLOYEE shall not reveal to any person outside the EMPLOYER its trade
secrets and confidential information which shall include but not limited to market
information, marketing hypothesis and strategic marketing intent, any technical
information, supplier and customer lists and profiles, product rates, computer
systems and business plans of whatever nature that may come to the
EMPLOYEE’S knowledge during his/her employment;

6. The EMPLOYEE shall keep in highest secrecy all confidential information


entrusted to him and shall not use or attempt to use any such information in any
manner, which may

information covered by the provisions of the preceding two paragraphs which are or
shall become the property of the EMPLOYER;

Intellectual Property:

8. The EMPLOYEE shall not do anything whatsoever to infringe the copyright,


design or patent of all the properties or products of the EMPLOYER, make copies of
the properties or products for his or her or for distribution to other, shall not use any
of the properties other than those supplied and authorized for use by the
EMPLOYER and shall not procure any person to do any such infringing acts;

9. The EMPLOYEE shall be liable to pay all damages and/or full indemnity to the
EMPLOYER as the case may be for any liabilities, claims or damages or loss which
the EMPLOYER may suffer arising from any infringements by the EMPLOYEE of
any copyright or design.

10. In the event that the EMPLOYEE violates any of the above terms and conditions
hereof, the EMPLOYEE is bound to pay damages and recognizes the right of the
EMPLOYER to restitution, forfeiture of benefits, termination including the right to file
a case for damages to protect its rights and interest.

EMPLOYEES ACCEPTANCE

I hereby accept my employment and therefore the foregoing terms and conditions which
I have acquainted myself with and I pledge to strictly upload, observe and abide by the
same.
I declared that I am physically and mentally fit and able to perform the duties assigned
to me.
