SUBJECT : CSW REPORT ON THE SUMMARY ADMINISTRATIVE


CONFISCATION PROCEEDINGS ON THE APPREHENDED
40 PCS. (1,553 BD. FT.) OF LAUAN FLITCHES AT P-4,
BRGY. LINGAYAO, LAS NIEVES, AGUSAN DEL NORTE.

Respectfully endorsed herewith the complete staff work (CSW) regarding the
abovementioned subject.

BACKGROUND INFORMATION

a. That on September 22, 2022 an information thru a text message


was received by the personnel of Dankias ENR MIAC from a
concerned citizen relative to the presence of the undocumented
Lauan flitches rafted along the Agusan River.
b. That the personnel of Dankias ENR MIAC and Bit-os ENR MIAC
responded and immediately conducted patrolling and monitoring
at the Agusan River within the Area of responsibility of Las
Nieves, discovered and verified the presence of the abandoned
Lauan flitches hidden along the river bank at Purok-4, Brgy.
Lingayao, Las Nieves, Agusan del Norte.
c. The team conducted identification and scaling which resulted to
40 pcs (1,553 bd.ft) of lauan flitches with an estimated value of
Php 54, 355.00.
d. That notice of apprehension was duly served by the DENR
apprehending officers by posting at the place of apprehension of
the abandoned undocumented forest products.
e. On October 7, 2020, a seizure order was issued by CENR
officer upon determination of a prima facie case for summary
administrative confiscation proceeding with control number CN
2022-020 over the abandoned forest products.
f. That on October 19, 2022, a summary administrative
confiscation proceeding was conducted and despite due notice
of the apprehension by posting of the notice of apprehension for
the abandoned forest products, nobody appeared during the
hearing and claimed ownership over the same and it was
recommended by the hearing officer for confiscation in favor of
the government.

Based on the aforementioned facts gathered thru the conduct of the


proceedings by the apprehending team and the office of CENRO Nasipit, in
accordance with DENR Administrative Order 97-32, this office finds preponderate
reason to concur with the recommendation to confiscate the apprehended
abandoned 40 pcs (1,553bd. ft) of Lauan flitches in favor of the government for want
of pertinent documents.
