MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

THIS MEMORANDUM OF AGREEMENT (MOA), made and entered into this ________of __________ 2020
by and between:

The JSR TECHNICAL VOCATIONAL SCHOOL INCORPORATED, with principal office address at 2nd Floor
Sandness Building, Real Street, Loyonsawang, Abuyog, Province of Leyte, represented by its President, Joseph S.
Riños, hereinafter referred to as the FIRST PARTY;

-and-

The _________________________ with postal address at ________________________, herein represented by its


___________________________, referred to as the SECOND PARTY;

--WITNESSETH--

WHEREAS, in pursuit of attaining the Philippine National Development Plan’s goals and objectives for inclusive
growth and poverty reduction, thereby promoting good governance at the local level and ensuring implementation of
priority poverty reduction programs of the Local Government Units (LGU’s) through skills trainings;

WHEREAS, the FIRST PARTY is mandated by the Republic Act No. 7796, otherwise known as the TESDA
ACT of 1994, to provide relevant and accessible Technical Education and Skills Development;

WHEREAS, the FIRST PARTY is one of the TESDA Technology Institutions in the Province of Leyte and
Province of Southern Leyte offering short-term courses wherein trainees are required to be physically fit and
mentally able to perform tasks and undertake all activities which their particular training demand of them;

WHEREAS, the FIRST and SECOND PARTIES in response to the common goals for inclusive growth, poverty
reduction and increase productivity of the populace/clients in the Municipality of Abuyog Province of Leyte and
Municipality of Hinunangan Province of Southern Leyte and nearby Cities and towns in Leyte, for peace and
development, supports the implementation of Driving NC III skills training for productivity and possible
employability;

WHEREAS, implementation of the program (Driving NCIII) needs registration from TESDA as an authority under
the Unified TVET Program Registration and Accreditation System (UTPRAS) to ensure that the skills trainings are
geared toward productivity and employability;

WHEREAS, both parties agree to work together to implement the project entitled: Driving NC III for Employment
and Productivity of the people;

NOW, THEREFORE, for and in consideration of the foregoing premises and the stipulation hereinafter set forth,
the parties hereby agree and bind themselves to the following covenant, to wit:

DUTIES AND RESPONSIBILITIES OF THE FIRST PARTY (JSR TECHNICAL VOCATIONAL SCHOOL):

The First Party shall:


1. Ensure that the program/course on Driving NC III is registered with TESDA under the Unified TVET
Program Registration and Accreditation System (UTPRAS);
2. Provide registration forms and other prescribed documents for training;
3. Identify the training schedule in collaboration with the Second Party;
4. Provide trainers/facilitators for training and assessment;
5. Ensure that the program/project is efficiently and effectively implemented with the other supporting
agencies;
6. Ensure a sustained compliant status on the requirements of the registered program;
7. Issue Certificates of Training to successful graduates/completers;
8. Facilitate/assist the Second Party on the referral for OJT.
9. Apply and Observe Safety procedure during Practical Demonstration
10. Monitor Safety during Practical Demonstration in any other Off-Campus Activities and ensure the Safety
of the Learner.
11. Provide PPE ‘s and Safety paraphernalia’s and other Safety Precaution Tools during Practical Activities
and Demonstration.
12. Provide immediate First aid Kits and Medicine if accident may occur.

DUTIES AND RESPONSIBILITIES OF THE SECOND PARTY (ST. MICHAEL BUS TRANSPORT CO.)

The Second Party shall:


1. Allow Learner/Trainee to use Passenger Bus for Practical and Demonstration purposes during practical
Demonstrations and Activity of JSR TECHNICAL VOCATIONAL SCHOOL INCORPORATED
with Supervision.
2. Provide Passenger Bus Vehicle during Assessment without collecting amount from the learner and or
trainee.
3. SIL Program of 40 Hours Industry Learning and on the Job Training for Passenger Bus.
4. Assist and Guide Learner/Trainee during 40 Hours SIL Training monitored by the assigned Industry
Coordinator and Trainer.
5. Identify at least twenty-five (25) trainees per batch through the accomplishment of Registration Form that
will be provided by the First Party;
6. Submit the Registration Form to the First Party;
7. Identify the training schedule in collaboration with the First Party;
8. Facilitate provision of the following:
a) I.D. pictures (1 pc 1” x 1” colored ID pic and 2 pieces 2” x 2”) of trainees;
b) Provide the training fees to all trainees identified by the Second Party.
9. Accepts trainees for On-the-Job Training (OJT) and/or possible employment/productivity in the various
facilities related to Driving or partner government/non-government agencies.
10. Provide other logistics support.

Both parties set a period of Two (2) years terms of use of the Equipment/Vehicle exclusively for JSR
TECHNICAL VOCATIONAL SCHOOL INCORPORATED learner only and trainee in compliance with the
TESDA Rules and Regulation.

The Second Party shall provide and allow the First Party to use the said vehicle for Driving NC III Practical
Demonstration and Assessment purposes from February 15, 2023 until February 17, 2026.

This Memorandum of Agreement (MOA) details the agreement between JSR TECHNICAL VOCATIONAL
SCHOOL INCORPORATED and ST. MICHAEL BUS TRANSPORT CO. Specifically, it sets forth the rights,
responsibilities and reservations of the two (2) parties in governing the implementation of the project.

If at any time, one Party to this Agreement desires to modify if for any reasons, that Party shall notify the other
Parties in writing or through request for a meeting on the proposed modification and the reason/s for it. No
modification shall occur unless there is a written acceptance from all parties.

IN WITNESS WHEREOF, the parties have hereunto signed this agreement this ____day of

This Memorandum of Agreement consisting of three (3) pages including this page wherein this
Acknowledgment is written is duly signed by the parties and their respective witnesses on all the pages thereof.
