MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement is entered into this - day of

ThC DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES, A


national government agency duly organized and existing under the iaws of the
Republic of the Philippines, with principal office address at Visayas Avenue,
Diliman, Quezon City, represented herein by its Secretary, HON. RAMON J.P.
PAJE. hereinafter referred to as "FIRST PARTY"
-and-

The AKLAN STATE UNIVERSITY, a state university with principai office


address at Banga, Aklan, represented herein by its President, DR. DANILO E.
ABAYON, hereinafter referred to as "SECOND PARTY"

WITNESSETH:

WHEREAS, His Excellency, President Benigno S. Aquino III issued


Executive Order No. 26 on 24 February 2oll declaring the implementation of a
National Greening Program (NGP) as government priority for poverty reduction,
food security, biodiversity conservation, and climate change mitigation and
adaptation;

WHEREAS, EO 26 prescribes the- harmonization of all greening efforts


and similar initiatives of the government, private sector, LGUs and the civil
society, and provides the list of partner agencies and stakeholders including
state universities and colleges (SUCs) with their respective roles and
responsibilities, among others;

WHEREAS, EO 26 designated the DENR as the lead agency in the


implementation of the NGP;

WHEREAS, EO 26 has mandated that "a11other government agencies,


instrumentalities, including government-owned and controlled corporations
(GOCCs),state universities and coileges (SUCs), shall provide fu11support and
assistance to the NGP":

WHEREAS, under Executive Order No. 192 (1987), the DENR is the
primary government agency responsible for the sustainable development and
management of the country's environment and natural resources;

WHEREAS, DENR Memorandum Circular No. 2011-01 was issued last


0B March 2OlI to provide guidelines and procedures in the implementations of
the NGP, and identifies parameters and activities that can be undertaken by
partners-implementers;

WHEREAS, both parties recognrze the importance of collaboration and


partnership in order to achieve the objectives of the NGP, and have agreed to
work together for the production of qualitfplanting materials consistent with
the objectives and requirements of their respective mandates and programs;

NOW THEREFORE, in consonance of the above premises, the PARTIES


have agreed the following:

ARTICLE I - ROLES AND RESPONSIBILITIES OF THE PARTIES

Section 1. The FIRST PARTY shall:

1.1 Provide financial support to the SECOND PARTY in the amount of Three
Miilion and Five Hundred Thousand Pesos (PhP 3.5 Million) for the
construction of clonai nurseries and facilities, program on manpower
development and related activities pertaining to clonal propagation technology;

1.2 Provide a mobilizatton fund amounting to 15o/oof the PhP 3.5Mi11ionupon


signing of the MOA and release the remaining amount following the attached
approved work and financiai plan for the project;

1.3 Provide assistance in seed sourcing, collection, processing and storage as


well as establishment of clonal nurseries and facilities;

1.4 Provide technical guidance in the selection or profile of species to be


pianted, species matching for planting sites, propagation of selected tree
species, and updates on reforestation techniques and methodologies, based on
existing DENR research outputs, experiences and policies;

1.5 Mobilize aIl its bureaus, attached agencies and regional offices to provide
support to the SECOND PARTY in the implementation of the project; and

1.6 Provide such other available support to help ensure the successful
establishment and operation of the clonal nursery as weii as implementation of
the NGP.

Section 2. To implement the roles and responsibilities of the DENR, the


Regionai Offices may undertake the following:

2.1 Provide technical assistance in nursery operation within their respective


jurisdiction;

* their respective localities or jurisdiction;

2.3 ldentify and select areas and sites for planting of the seedlings produced in

the established clonal nursery of the SECOND PARTY;

2.4 Procurethe seedlings produced by the Second Party in excess of the
seedlings commitment through Community Direct Contracting (CDC) method
through Bids and Awards Committee (BAC) resolution, provided that the
seedlings pass the criteria for quality planting materials.

2.5 Be primarily responsible for preparation of selected sites for planting in


their respective localities or jurisdiction;

2.6 Monitor and evaluate the progress of this project;

2.7 Ascertain that these undertakings are done in accordance with DENR
policies;and

2.8 Enter into other activities to achieve the objectives of the NGP.

Section 3. The SECOND PARTY shall:

3.1 Manage the funds for the establishment of clonal faciiities /construction of
clonal nursery complex to include ramet/hedge gardens, seed storage,
and seed banking;

3.2 Proposeareas or sites needed for the establishment of clonal facilities,


subject to approval of the DENR-REDs;

3.4 Be responsible for the production o.f 60,000 quality seedlings of premium
and indigenous species upon approval of this agreement. An annual production
of cloned materials after the establishment of the clonal nursery and related
facilities should be made available for NGP, the seedlings shall be distributed to

b the identified and selected NGP sites provided by the concerned DENR

3.5 Provide access of identified sites to representatives of the DENR such as
expel:imentalf laboratory areas, Seed Production Areas (SPAs), natural stands,
plantation forests, etc. Other logistic support should also be provided;

3.6 Provide for the water svstem. electricitv, aircon and other necessary

3.9 Using its network and in coordination with the DENR, assist in the
distribution and outplanting of planting materials raised in these nurseries.
Section 4. Both PARTIES shall:
