AFFIDAVIT

I, JON JUSTINE D. NUNEZ, Filipino, of legal age, and a resident of Brgy. Roxas Palawan,
after being duly sworn to in accordance with law, hereby depose and state;

That I am the same person executing this affidavit:

That on March 3, 2020 I went to Puerto Electronico SM Branch to window shop for a cheap
Laptop;

That on the same date I accidentally met a certain Mr. Ramil Tabinga, my high school classmate
and friend who eventually was a sales specialist for Flexi Finance;

That Mr. Tabinga told me that I can process a loan through Flexi Finance but he said that by that
time most applications for Gadget Loans from my co-leagues in Sitel Philippines were being
declined due to bad records;

That at the same day I was in a hurry and is about to leave when Mr. Tabinga asked for 2 of my
Valid ID’s and promised to process the loan application. He also asked me how much can I pay
for the downpayment;

That out-of-trust to my classmate and friend, I handed over 5 thousand pesos to him to pay for
the downpayment of the Laptop Loan;

That after about an hour and couple of minutes, I went back to SM Puerto Electronico to follow
of on the Loan application. Mr. Tabinga asked me to sign couple of documents in which I never
get the chance to read. He also added me that I do not have to worry about delayed payment as
Flexi Finance don’t charge interests;

That I received the Laptop and documents of Loan on the same day;

That I left my Job in Sitel Philippines due to medical reasons last September, 2020;

That after a couple of months when I was in Culion Palawan. I received a phone call from one of
Flexi Finance’s Representative, saying that my Payment is delayed;

That I tried calling Mr. Tabinga on his phone number multiple times but he is unreachable;

That after checking the documents, I found out that the initial payment I made for the laptop is
only Two Thousand Five Hundred Ninety five Pesos (P 2,595) which is not the amount that I
handed over to Mr. Tabinga;

That I was unemployed and have no source of regular income that time to settle the amount of the
Past Due;
 That I was able to secure employment by November to December 2021 but was affected by mass
lay-off due to Covid.

That I was also a beneficiary of DOLE TUPAD (Tulong-pinansyal para sa mga Displaced
Individuals)

That my family and I were victims of Typhoon Oddette and is still on recovery period up until
today;

That I do not have the capacity to pay the Loan and Interest.

As such, I am executing this affidavit to attest to the truth of the foregoing and to defend myself from a
complaint to me by Flexi Finance for my unpaid loan.
