MEMORANDUM OF AGREEMENT

Known All Men by These Presents:


This Agreement is made and entered by and among the Parties:

EMELIE FERNANDEZ JURADA of legal age and a resident of PC Hills, Barangay


Apas, Cebu City, Philippine 6000, hereinafter referred to as “FIRST PARTY”
And
CHERRYL ALEGRADO of legal age, Filipino and a resident of R Bacaltos St.,
Poblacion, Sibonga, Cenu, Philippines, 6020 herein referred to as “SECOND PARTY”
WITNESSETH, that:
WHEREAS, the Parties have entered and agreed into this agreement on their own
free will;
WHEREAS, CHERRYL ALEGRADO desire to purchase a property for
residential purposes;
WHEREAS, the FIRST PARTY is willing to sell her property categorized as a
Residential Unit, located at Carcar City, Cebu, Philippines.
WHEREAS, the SECOND PARTY is willing to purchase the property of the
FIRST PARTY.
WHEREAS, property is particularly described as follows:
Tierra Nava, Block 18 and Lot 28, Carcar City, Cebu
WHEREAS, the FIRST PARTY has acquired the possession and ownership of the
said property through Contract of Loan with Real Estate Mortgage with Home
Development and Mutual Fund, otherwise known as PAG-IBIG;
WHEREAS, the FIRST PARTY pays the Home Development and Mutual Fund
monthly amortization of Six Thousand Five Hundred Fourteen Pesos Only (PhP6,514.00)
with a total amount as stated in the Home Development and Mutual Fund statement of
account.
NOW, THEREFORE, for in consideration of the foregoing facts, PARTIES agree and
stipulate the following:
A. That the SECOND PARTY shall:
1. Be represented by CHERRYL ALEGRADO;
2. Assume the payment of the pending unpaid amortizations in the Home
Development and Mutual Fund until it is fully paid;

3. Continue to pay the required amortization until fully paid regardless of any
contingency, change of mind, event, accident, loss, disability, or death of any
of the parties;

4. Pay for the full amount of taxes, fees, charges and all other administrative fees
required by the government as a consequence of the sale of the property;

5. Pay the FIRST PARTY, the amount of FOUR HUNDRED FIFTY


THOUSAND PESOS (PhP450,000.00) as a consideration for the assumption
of property, payable in installment, as follows:

That the cash must be given to EMELIE JURADA, the FIRST PARTY and
the bank transfer must be given on or before September 30, 2023 under the
name of VICTORIA GARCIA, the daughter of the FIRST PARTY until fully
paid.

B. The FIRST PARTY shall:


1. Deliver the keys and surrender the property to the SECOND PARTY upon
payment of the SECOND PARTY of the first installment and delivery of ALL
Checks; and
2. Issue acknowledgement receipts of ALL Payments made by the SECOND
PARTY.

C. The PARTIES shall:


1. Cooperate with and support each other to finalize and complete the sale and
transfer of title and all documents to the name of CHERRYL ALEGRADO,
the SECOND PARTY; and

2. Pay in equal parts, the fees for the drafting of necessary documents, contracts
and agreements prior to the assumptions of rights of the SECOND PARTY
over the property with the Home Development and Mutual Fund.

IN WITNESS WHEREOF, the parties have hereunto set their hands this day of
