CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:

This Contract to Sell made and entered into by and between:

ATTY. JORGE ROITO N. HIRANG JR., of legal age,


Filipino, married, with address at 3560 Sta. Monica St., Don Galo,
Parañaque City, referred to as the SELLER;

-and-

EVELYN C. CAEDO, likewise of legal age, Filipino, married


and with address at Blumentrit St., corner Sampaguita St., Brgy.
Salvacion, La Loma, Quezon City, hereinafter referred to as the
BUYER;

WITNESSETH:

That the SELLER is the owner of a real property with improvements situated
in La Loma, Quezon City with an area of TWO HUNDRED THIRTY-TWO (232)
square meters, more or less, covered by Transfer Certificate of Title (TCT) No. RT-
28458 (47163). That the property subject matter of this contract is more particularly
described as follows:

NOW THEREFORE, as part of the contract to sell between the PARTIES, in


consideration of the amount of FIVE MILLION PESOS (P5,000,000.00), the
SELLER hereby offers to sell unto the BUYER the subject property under the
following terms and conditions, to wit:

a. The BUYER shall make a down payment of ONE
HUNDRED THOUSAND PESOS (P100,000.00) upon execution of
this contract;

b. The balance of FOUR MILLION NINE HUNDRED


THOUSAND PESOS (P4,900,000.00), will be paid by the BUYER,
as follows:

i. P500,000.00 on or before June 30, 2023


ii. P1,120,000.00 on or before April 1, 2024;
iii. P1,640,000.00 on or before April 1, 2025;
iv. P1,640,000.00 on or before April 1, 2026.

b. The parties will execute a Deed of Absolute Sale upon


payment of the full purchase price.

c. The BUYER shall pay the accruing estate taxes, capital


gains taxes and documentary stamps taxes regarding the sale between
the PARTIES and all other expenses incidental to the sale and
transfer of title from Gorgonia Bantegui to the name of the BUYER
herein.

d. That BUYER is authorized to take possession of the


subject property by virtue of this Contract. However, if the BUYER
shall fail to pay the installments hereabove stated at the time it is due,
or if the BUYER shall fail altogether to pay the entire purchase price,
the right of the BUYER to possession ceases automatically without
need of court order. The SELLER shall therefore immediately vacate
the subject premises without need of filing a case in court for
ejectment. For this purpose of recovery of possession, a mere
complaint to the Barangay is sufficient and the BUYER herein
authorizes the SELLER to take possession of the property.

e. In case of the failure of the BUYER to pay any


installments above when it is due, this contract shall be automatically
rescinded and rendered null and void without need of court order. The
BUYER shall forfeit one half of what they paid.

IN WITNESS WHEREOF, the parties have signed this 24 th day of March


2023 in Parañaque City.
