JEMA DELA CRUZ ZHOU, married to Zhou Qing, of legal age, and residing in
Daang Hari St. Maybamcal, Morong, Rizal, herein referred to as the BUYER;
WITNESSETH;
WHEREAS, the BUYER has offered to buy and the SELLER has agreed to
the abovementioned property under the terms and conditions herein below set
forth;
4. The SELLER shall cover the REAL ESTATE TAX up to the time of sale, and
the Capital Gains Tax;
5. The BUYER shall cover the Documentary Stamp Tax and the Transfer Fees
and all miscellaneous fees and expenses to transfer the certificate of title
in the name of the new owner.
7. Upon full payment of the total price, the SELLER shall sign and executed
a DEED OF ABSOLUTE SALE in favour of the BUYER. The SELLER shall
likewise execute and delivery any and all documents, including but not
limited to the original copy of the Transfer Certificate of Title, Tax
Declaration and all other documents necessary for the transfer of
ownership from the SELLER to the BUYER. Should SELLER fail to do so
for any reason, the SELLER hereby undertakes to return / refund to the
BUYERS all payments made by them to serve as a guarantee that the
SELLER shall faithfully comply with the obligations imposed under this
CONTRACT;
9. In case the BUYER renege on their obligation to pay, the BUYER shall
forfeit Php 100,000.00 in addition to shouldering the necessary expenses
undertaken by the SELLER to accommodate the sale which shall be and
not limited to: AGENT FEES, REAL PROPERTY TAX.
