MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

THIS AGREEMENT made and entered into between:

THE PROVINCIAL GOVERNMENT OF ISABELA, a government agency created and

existing under the laws of the Republic of the Philippines with office address at the
Provincial Capitol Building, Barangay Alibagu, City of Ilagan, Isabela, represented herein by
the Provincial Governor, HON. RODOLFO T. ALBANO III, hereinafter referred to as “PGI”;

-and-

THE LOCAL GOVERNMENT UNIT OF ALICIA of the Province of Isabela,

represented herein by HON. JOEL AMOS P. ALEJANDRO, hereinafter referred to as the
“LGU”;

WITNESSETH:

WHEREAS, Section 15, Article II of the Philippine Constitution of 11987 provides that the
State shall protect and promote the right to health of the people and instill health
consciousness among them;

WHEREAS, Republic Act No. 7610, otherwise known as the ‘Local Government Code of
1991’ states that provinces shall exercise powers necessary, appropriate, or
incidental for its efficient and effective governance and those which are essential to
the promotion of general welfare, health, and safety, including the provisions of
services to control communicable disease;

WHEREAS, the DILG has issued an unnumbered Memorandum dated January 07, 2021
directing all LGUs to further strengthen existing public health interventions;

WHEREAS, there must be effective implementation of health and safety programs that will
ensure the minimal to no transmission of the Covid-19 virus, most especially with
the existence of the new strain and other unnamed mutations, hence prompting all
Local Government Units to adopt additional measures to be observed to limit the
spread of the new variant;

NOW THEREFORE, for and in consideration of the foregoing premises, the parties do
hereby agree as follows:

I. THE PGI – THE PROVINCIAL GOVERNMENT OF ISABELA shall:

1. Purchase, together with the LGU, ONE (1) disinfecting machine; sharing the total
purchase value at FIFTY PERCENT (50%) with the Local Government Unit, together
with its implements and accessories for use by the LGU to carry out cleaning and
disinfection activities;

2. Delegate to the LGU the authority to supervise and manage the use of these
disinfecting machines, in order to ensure that these machines are maintained at all
times during the period of implementation;

3. Delegate to the LGU the authority to ensure the upkeep/maintenance of the

disinfecting machines.
 II. THE LGU shall:

1. Contribute as its counterpart, FIFTY PERCENT (50%) of the total purchase price of
ONE (1) unit disinfecting machine, together with its implements and accessories.

2. Acknowledge proper receipt of the unit upon turnover by the PGI;

2. Ensure the clean and efficient use of the disinfecting machine;

3. Ensure that the disinfecting machine shall be utilized for the purposes stated
herein;

4. Assume the financial responsibility for the maintenance of the disinfecting

machine;

Non-compliance shall cause the cancellation of the Memorandum of Agreement and

recall of the disinfecting machine in favor of the PGI.

IN WITNESS WHEREOF, the Parties have hereunto set their hands this _______ day of
