CONSTITUTION AND BY LAWS


HUMAN RESOURCE SOCIETY

PREAMBLE

We, the students of Human Resource Society imploring the aid of Almighty God and recognizing the
need for an alliance in order to affect a more committed participation in realizing the HRS's battle cry for
fellowship and solidarity, academic, excellence, socio-civic and cultural consciousness and moral
integrity among its members, do hereby ordain and promulgate this Charter.

ARTICLE I
GENERAL PROVISIONS
Section 1: The constitution shall be known as the constitution of Human Resource Society of
Eastern Samar State University.

Section 2: The organization may adopt the seal of the University provided that the acronym of
the organization shall be added to it;

Section 3: This organization shall be called the Human Resource Society herein referred to as
HRS;

Section 4: This is an organization of ESSU students who are Bachelor of Science in Business
Administration: Major in Human Resource Management adhering to this constitution.

Section 5: The office of the organization shall be located and established within the university
campus; and
ARTICLE II
ORGANIZATION SEAL

1. Definition. The federation seal embodies the organization. The logo type is a combination
mark wherein an emblem is used to represent the whole logo. The figures of the federation seal
and their definitions are as follows:
a. Three Person – represents the Human Resource Management students who are members
of the organization.
b. Shield – embodies unity and relationship of the federation within an organization.
c. Laurel Leaves – implies the uplifting excellence and perseverance of the organization
among Human Resource Management students nationwide.

2. Color Palette. The colors and definition of the Federation Seal shall be as follows:

ARTICLE III
DECLARATION OF PRINCIPLES
Section 1: This organization believes that:
a) That a truly relevant education must be liberating, just pro people and patriotic.
b) That the student’s organization enhances democratic processes on the campus,
therefore with their democratic granted, they can serve a s potent and dynamic force
in the social and national economic transformation.
c) That genuine organization shall be responsive to the actual needs of its members and
the people to this end should be autonomous, democratic and responsive;

1. It is autonomous and responsive if it has the complete control on the


planning and implementation of its program, projects or activities.
2. It is democratic if it is popularly elected by consultation with purpose and
interest of its constituent;
3. It is responsive if it vigilantly promotes the students and peoples needs,
rights and welfare.

d) That the student’s potential and dynamism can be actual practice if they will be
exposed to various responsibilities and activities that involve decision-making and
implementation of such; and
e) That the success of any program or activity of organizations like CBMASO is greatly
dependent on the cooperation and involvement of its members in coordination of its
advisers and other concerned parties

ARTICLE IV
STATEMENT OF THE OBJECTIVES

Section 1: The organization is committed to:

a) Observe a truly united and law-abiding organization;


b) Strengthen its rules and values in the attainment or curricular and extra-
curricular activities of HRS and the university as a whole;
c) Promote and develop its members potential especially in the aspect of business
education, and accounting as to be ready for the real world they are in;
d) Develop its members intellectually, socially and culturally and train them for an
effective and responsible leadership;
e) Establish a patriotic and pro-people consciousness among HRS students in
particular and the people in general; and
f) Coordinate with the students and other school organization in the advocacy for
an accessible and quality education and exercise of rights in general.
ARTICLE V
MEMBERSHIP
Section 1: Membership of the organization is open to all Bachelor of Science in Business
Administration Major in Human Resource Management (BSBA-HRDM) (regular or
irregular) who may be willing to actively participate in the activities and programs of
the organization and who will be ready for the commitment to whatever duties and
responsibilities that a member may have.

Section 2: A cross enrollee may apply for the membership to the organization provided that
he/she meets the requirements in section 1 in this article.

Section 3: Members of the HRS should fill-up a membership for and pay a corresponding
membership fee per academic year of P50.00, which will serve as the standing or
reserve fund for whatever activities and expenses that the organization may occur;

Section 4: Membership on the organization is deemed withdrawn or terminated if the


member has been inactive or has not paid the membership fee for the whole school
year.

Section 5: Any member who may be found guilty of the violation of the University and/or the
organizations policies, rules and regulation shall be dealt with accordingly through
the organizations Executive Council who is the member of the HRS Students
Tribunal Committee with the observance of the due process of law in coordination
with the proper disciplinary action.

ARTICLE VI
RIGHTS, PRIVILEGES, DUTIES AND RESPONSIBILITES OF MEMBERS

Section 1: Every member shall have the following rights and privileges:

a) Open participation in any or all of the activities of the organization;


b) Voice consent or dissent with regards to top plans policies and activities;
c) Request for the information of the financial standing or condition of the
organization;
d) To have access on all the records and all documents pertaining to and entered into
by the organization;
e) To receive citation, recommendation and recognition due to him/her in relation to
his/her services, performance and commitment to the organization; and
f) To avail of the service and the benefits that the organization may be offering to its
members as in symposia, lecturers, review classes, training seminars sponsored by
the HRS.

Section 2: Every member shall have the following duties and responsibilities:
a) To uphold and abide by the provisions of the HRS Constitution and By-laws;
b) To abide the policies, program, rules and regulations decisions adopted by the
organization;
c) To submit reports, proposals and actions to any time to the college and the
university as need arise.

ARTIVLE VII
STRUCTURE OF THE ORGANIZATION

Section 1: The organization structure shall be composed of the following:


a) The highest policy-making body of the organization is the Organizational Assembly
or the Executive Council if the assembly is not on session;
b) The governing body is the Executive Council; and
c) The Executive Council of the organization shall be composed of the officers stated in
section 3, herein.

Section 2: The organizational assemble shall have the following powers:


a) To study, amend and ratify the constitution;
b) To legislate policies and programs of action of the organization;
c) To pass and discuss resolutions;
d) To act on proposals and recommendations submitted by any members of the
organization;
e) To elect officers in the organization
f) To impeach and suspend officers of the organization;
g) To receive and review reports for any members considered; and to decide on
matters of membership
Section 3: The Executive Council of the organization shall be composed of the following;
a) President
b) Vice-President for Academics
c) Vice-President for Non- Academics
d) Vice-President for Finance
e) Vice-President for Communication
f) Vice-President for Audit
g) Vice-President for Membership
h) Vice-President for Graphics and Publication
i) General Secretary
j) Standing Committees
k) Representatives
ARTICLE VIII
POWERS, DUTIES, AND FUCTIONS OF OFFICERS

Section 1: PRESIDENT - The President shall have the following powers, duties, and functions:

a) Preside over all the meetings of the organization;


b) Sign all resolutions, communications, and any official paper or document of the
organization that requires his/her signature;
c) Create special committees as needed and assign, chairmen who will be residing in the
meetings called for by the committees.
d) Prepare a whole year plan and budgeting proposition of the organization;
e) To break the ties in any deliberations or decision-making as need arises;
f) To appoint any auxiliary position as the need for it arises; and
g) To perform such other functions as may be deemed necessary in the performance of
his/her function.

Section 2: VICE-PRESIDENT FOR ACADEMICS– The Vice-President for Academics has the
following duties and functions:

a) Assume, preside over all the meetings of the organization in the absence or incapacity of
the president;
b) Assist the president in the implementation of the programs or activities of the
organization;
c) To supervise the implementation of academic projects of the organization;
d) Participate and vote during the meetings of deliberations of the organization;
e) Propose program of action of the body as deemed necessary;
f) Coordinate, consolidate and preside to the council or assembly the proposed plans and
programs of action to the committees (the standing and special committees of the
organization)
g) Acts as the chairman of any of the standing committees as provided in this constitution;
and
h) Perform such functions that may be assigned to him by the president/

Section 3: VICE PRESIDENT FOR NONACADEMICS – The Vice president for Non-academics has
the following duties and functions;
a) To supervise and execute the complementary role of curricular and extracurricular activities by
integrating and coordinating cultural, spiritual and sports activities and incorporate these in
general activities of the organization;
b) To coordinate with other institutions, agencies or organizations necessary for the non-academic
programs of the Council; and
c) To perform other duties inherent to the position.

Section 4: GENERAL SECRETARY – The General Secretary shall have the following functions;

a) Prepare and keep the minutes of all meetings of the organization;


b) Head and administer the secretariat of the organization;
c) Maintain the records of all the activities conducted by the organization;
d) Perform such task as may be deemed necessary in the performance of his/her function
and any other that may be assigned to him/her by the president.

Section 5: EXECUTIVE SECRETARY – The Executive Secretary shall have the following functions:
a) Prepare executive documents in lieu of the president; and
b) Keep and safeguard all records, documents and other pertinent papers of the
organization; and
c) Perform such task as may be deemed necessary in the performance of his/her function
and any other that may be assigned to him/her by the president.

Section 6: VICE PRESIDENT FOR FINANCE– The Vice President for Finance shall have the
following functions;

a) Take charge in custody of all the funds of the organization;


b) Take custody of all the supplies and properties of the organization
c) Initiate the fund-raising activities and organization;
d) Keep the records of all collection, dues and disbursements of funds and materials of the
organization; and
e) Perform such task as may be deemed necessary in the performance of his/her function
and any other that may be assigned to him/her by the president.

Section 7: VICE PRESIDENT FOR AUDIT – The Vice President for Audit shall have the following
functions:

a) Audit the financial statement and the other documents of the organization as prepared
by the treasurer;
b) Prepare and recommend internal control procedures necessary in the safeguard of the
asset of the organization;
c) Prepare statement or report as a result of his view or audit of financial records of the
organization

Section 7: VICE PRESIDENT FOR MEMBERSHIP – The Vice President for Membership shall have
the following function:

a) To keep a complete and an up-to-date list of all accredited members and their
directories;
b) To develop an effective recruitment and membership renewal scheme within the
scope of the region so as to encourage more members;
c) To monitor the attendance, performance and degree of participation of
members schools in the Organization meetings and functions; and
d) To perform other duties inherent to the position.
Section 8: VICE PRESIDENT FOR COMMUNICATION – The Vice President for Communication
shall have the following functions;

a) Take charge in the information and communication function of the organization;


b) Ensure proper coordination and efficient relations with other organization;
c) Take charge of the preparing press releases, news items and/or write-ups about the
organization and those of the organization interested to the HRS.
d) Together with the Presidents, he/she is the official representative to any activity called
for the by the college an on other organization which has relation to communication and
information; and
e) Perform such task as maybe deemed necessary in the performance of him/her by the
president
Section 9: VICE PRESIDENT FOR GRAPHICS AND PUBLICATION – The Vice President for
Graphics and Publication shall have the following functions;

a) To do all the tasks necessary for his or her position;


b) To create posters, tarpaulins and other materials for the councils’ information
dissemination;
c) To serve as the Liaison Officer of the Organization;
d) To handle social media accounts/pages/blogs of the organization; and
e) To perform other duties inherent to the position.

Section 10: REPRESENTATIVES – The Representatives shall have the following functions,
a) To represent their program in any activities and meeting that need their
representations;
b) To initiate and/or attend transactions of the organizations that may require his/her
presence; and
c) Perform such task as maybe deemed necessary in the performance of him/her by the
president

ARTICLE IX
QUORUM AND DECITION MAKING

Section 1: In all meetings, sessions are assemblies, a simple majority of the member or
concerned participants shall be sufficient to constitute a quorum. A majority of the member or
concerned participants.

Section 2: Only when a quorum is reached that the session or assembly meeting can be started
hereby the body can transact a business, decide, adopt and result and resolve matters for
implementation.

Section 3: As far as practicable, all decisions in the different committees of the organization
shall be reached by a consensus in order to adopt a resolution or policy for final
implementation.

Section 4: Where a consensus is not possible, the vote for the simple majority of all members
present there being quorum, shall be necessary to adopt/or approve a motion, policy for final
implementation.
Section 5: The Executive and Legislative Council shall attend a meeting on every month end.
ARTICLE X
FUNDS

Section 1: The funds of the organization shall be derived from the membership fees, fines,
solicitations, or donations.

Section 2: The membership Fee amounting to P50.00 shall be collected by the VP for Finance
from the members form every enrolment with proper receipt issued to the paying members.

Section 3: Funds may be disbursed only in accordance with the prepared annual budget or on
matter urgently necessary for the smooth operation, or functioning of the organization
provided it has been submitted and approved by the council

Section 4: The 60% fund of the organization shall be deposited in the commercial bank as
agreed upon the officers in the name of the organization and the remaining 40% will serve as a
Cash On Hand. Withdrawals or disbursements by check or draft shall be signed by the treasurer,
the president, and the adviser of the organizations.

Section 5: Additional fund from fines as stated on the Article X Section 3, an officer who wants
to be excused on the said fine, he/she must present an excuse letter duly signed by the HRS
president and at least one HRS adviser. Any letter that is said to be reasonable to his/her
absence on the agreed meeting.

Section 6: The penalty/fine for any member of the organization will be as follows:

a) Absence of major events and activities of the organization or the college itself
without reasonable cause and excuse letter will be fined the amount of P30.00
b) Absence in the classwork activities without reasonable cause and excuse letter
will be fined the amount of P50.00
c) The penalty for any other minor to major violations of the organizations rules
and policies, shall be decided by the Executive Council upon the event it occurs
and depending on its intensity.

Section 7: That the signatory shall be the adviser, president and the Vice President for Finance
of the HRS, moreover;

Section 8: The signatory stated in this article shall submit specimen signature every start of
classes and newly elected HRS officers.
ARTICLE XI
STANDING COMMITTEES

Section 1: A standing committee may be created by the president as may deemed necessary
and shall act until the completion of its task;

Section 2: In all committees, the standing and special committees, as a chairman shall be
appointed by the president through the consent and confirmation of the council members.

Section 3: The power, duties and responsibilities of this committee shall be determined and
defined by the Executive Council in a resolution for the purposed, and in case of vacancy the
council may fill-up vacant position through the appointment of the president approved by other
members of the Executive Council.
ARTICLE XII
QUALIFICATION OF OFFICERS

Section 1: all confide students of the Eastern Samar State University may run in any of the
elective office of the organization provided that he/she possesses the following qualifications:

a. Must be a College of Business Management and Accountancy (CBMA) student.


b. Must be currently enrolled in BSBA Major in Human Resource Management.
c. Under load students can run as long as he/she is not overload in his/her subject.
d. Must have a good moral character and no pending administrative case against
him/her inside and outside of the university.
e. Must have no failing grade/s on his/her academic subject in the last semester
attended prior to the election.
f. The candidates must have the general weighted average of 2.5 or above in his/her
current year.

ARTICLE XIII
ELECTION AND TRANSITION

Section 1: All confide students of the HRS Officers shall consist of President, Vice-President for
Academics, Vice-President for Non-Academics, General Secretary, Assistant Secretary, Vice
President for Finance, Vice President for Audit, Vice President for Communication, Vice
President for Membership, Vice President for Graphics and Publication, and Representatives.

Section 2: The HRS Election shall be held yearly at the start of the academic year or unless
otherwise prescribed by the Committee on Election for valid cause.
a. Elections of the President of the different organization shall be provided by their
respective Constitution and By-Laws.
Section 3: The Committee on Election shall initiate, administer, and supervise the elections.

Section 4: Election shall be done by secret ballot.

Section 5: Each course shall be converted to do electoral precinct with SEC members to
determine the qualified voters.

Section 6: Candidates which garner the highest vote shall be declared the winner by the
COMELEC.
Section 7: In any case of a tie concerned candidates shall break the tie by drawing lots of on
dates as may determine by the Comelec but in no excuse exceed one week from the date to the
of declaration of said tie.

Section 8: Any defeated candidate or his authorized may file election protest in good faith to
the COMELEC, with one week after the declaration of winners. The COMELEC shall probe and
determined the presence of Prima facie case based on the written testimonies of witness and
other evidence presented it shall render decision within seven (7) days after all the evidence
were presented.
Section 9: All elected officers shall hold office for one academic year or until a new set of
officers are elected and proclaimed. An academic year covers the first and second semesters
and summer.

ARTICLE XIV
ADVISER

Section 1: There shall be a maximum of five advisers of the organization recommended by the
council and approved by the College Dean and one who accept and confirms his commitments
to the organization;

Section 2: The advisers of the organization must belong to the College of Business Management
and Accountancy or atleast be handling most of his/her subjects in the college during his/term
of office.

Section 3: The advisers shall have term of one (1) year or more unless otherwise decided by the
assembly to replace him/her anytime for any act of negligence or omission prejudicial to the
members which shall be done upon recommendation of the president with the concurrence of
two-thirds (2/3) votes of members; and

Section 4: The adviser may at any time withdraw from his/her position upon the proper
notification to the chairman of the CBMA, College Dean and Executive Council.
ARTICLE XV
TRANSITORY PROVISION

Section 1: All provision of the respective local council constitution and by-laws that runs
counter to the principles stipulated in this constitution upon the ratification of the latter shall
be deemed null and void.

Section 2: Amendments or revisions should be given immediate and preferential attention so as


to avoid conflict and disagreement in the future.

ARTICLE XVI
EFFECTIVITY

Section 1: Effectivity. The Constitution and By-laws shall take effect immediately upon the
ratification of majority votes during the organizational assembly.
