IMPLEMENTING RULES AND REGULATIONS


Capitol Rolling Stall

Article I: General Provisions

Section 1. Title
These Implementing Rules and Regulations (IRR) shall be known and cited as the
"Implementing Rules and Regulations for the Rolling Stalls within the Capitol
Compound of the Provincial Government of Nueva Vizcaya."

Section 2. Purpose
These IRR are promulgated to establish clear and comprehensive guidelines
governing the allocation, operation, and management of capitol rolling stalls within
the Capitol Compound, with the overarching objectives of fostering a dynamic and
safe business environment, ensuring environmental sustainability, and promoting
orderly administration.

Article II: Guidelines and Criteria for Capitol Rolling Stalls

Section 3. Eligibility
1. Any duly registered business entity or individual holding a valid business
permit issued by the relevant local government agency is eligible to apply for
a capitol rolling stall within the Capitol Compound.
2. Applicants shall demonstrate adherence to existing rules and regulations
relating to the Rules and Regulations for the Rolling Stalls within the Capitol
Compound.
3. Proposed business activities must be compatible with the character and
purpose of the Capitol Compound.

Section 4. Application Process


Prospective lessees shall undergo a comprehensive application process as outlined
below:
a. Submission of an official application: Applicants are required to formally
submit their application to the Capitol Rolling Stall Management. This step
serves as the initial point of contact and expresses the applicant's intention to
lease a space.
b. Inclusion of essential documents: As part of the application, applicants must
provide essential documents to support their eligibility and business viability.
These documents include, but are not limited to:
- A copy of a valid business permit: This validates the legal existence of the
applicant's business and its adherence to regulatory requirements.

- A simple business plan: This plan outlines the proposed business model,
marketing strategies, and financial projections. It provides a clear
understanding of the business's goals and operations.
- Financial capability documentation (as deemed necessary): This
documentation establishes the applicant's financial capacity to fulfill the
lease requirements. It may include bank statements, income statements,
and other relevant financial records.

Article III: Safety and Environmental Rules

Section 5. Structural and Fire Safety


All capitol rolling stalls shall conform to prevailing electrical load requirements and
fire safety standards. Compliance shall encompass, but is not limited to:
a. Routine inspection and maintenance of electrical systems and equipment (i.e.,
must adhere to the electrical load capacity of each rolling stall).
b. Installation and maintenance of firefighting equipment (if possible).
c. Prudent storage and handling of flammable materials.

Section 6. Waste Management


Capitol rolling stallholders are obligated to establish an efficient waste management
system characterized by:
a. The segregation of waste into distinct categories, including recyclable, non-
recyclable, and hazardous materials.
b. Adherence to local environmental regulations regarding the proper disposal of
hazardous waste.
c. Regular waste collection and disposal procedures via authorized channels.

Article IV: Fees and Charges

Section 7. Lease Fees


1. The capitol rolling management shall assess a monthly lease fee based on
existing Provincial Local Tax Ordinance.
2. An additional fee shall be collected in support to maintenance, improvement,
and operational expenses of the Capitol Rolling Stall.

Section 8. Security Deposit


1. A refundable security deposit (i.e., equivalent to two months lease or higher,
as determined by the capitol roll management) shall be collected from capitol
rolling stall lessees upon lease agreement execution.
2. The security deposit shall serve as collateral against potential breaches of
lease conditions and damage to the stall or premises.

Article V: Lease Agreement and Terms

Section 9. Lease Agreement


Upon approval of the application, the Capitol Rolling Stall Management shall
formalize a lease agreement between the capitol rolling stall lessee and the
Provincial Government of Nueva Vizcaya. The lease agreement shall specify the
rights, responsibilities, and obligations of both parties.

Section 10. Lease Terms and Renewal

1. The initial lease term for a capitol rolling stall shall be at six months, subject to
renewal upon mutual agreement between the lessee and the capitol rolling
management.
2. Lessees seeking renewal shall submit an application within three months prior
to the expiration of the current lease term.

Article VI: Design and Aesthetics

Section 11. Stall Design and Aesthetics


1. Capitol rolling stall lessees shall adhere to prescribed design guidelines and
aesthetics to maintain the visual coherence and appeal of the Capitol
Compound.
2. Any modifications or alterations to the stall's appearance must be approved by
the Capitol rolling management prior to implementation.

Article VII: Market Days and Hours of Operation

Section 12. Market Days and Hours


1. Capitol rolling stalls shall operate on designated market days and within
specified hours of operation as determined by the Capitol rolling
management.
2. Any changes to market days or hours must be communicated to lessees with
reasonable notice.

Article VIII: Advertising and Promotion

Section 13. Advertising and Promotion


1. Capitol rolling stall lessees are encouraged to engage in advertising and
promotional activities to attract customers.
2. Promotional materials, signage, and displays shall adhere to guidelines set by
the Capitol rolling management to maintain a harmonious visual environment.

Article IX: Prohibited Items and Activities

Section 14. Prohibited Items


The following items are strictly prohibited within the capitol rolling stalls of the Capitol
Compound:
a. Alcoholic beverages and liquors of any kind.
b. Cigarettes, tobacco products, and electronic cigarettes.
c. Illicit drugs or any controlled substances.
d. Firearms, explosives, weapons, or dangerous implements.
e. Counterfeit or pirated goods.
f. Stolen or smuggled goods.
g. Obscene or pornographic materials.
h. Items that promote hate speech, discrimination, or violence.
i. Any goods or materials prohibited by law or regulation.
j. Any activity that is illegal, unethical, or contrary to public order.

Section 15. Activities Prohibited


The following activities are strictly prohibited within the capitol rolling stalls of the
Capitol Compound:
a. Unauthorized alterations to the stall structure or design.

b. Subleasing or transferring the stall.
c. Engaging in deceptive or fraudulent business practices.
d. Violating intellectual property rights, including copyright and trademark
infringements.
e. Disruptive or disorderly conduct that disturbs the peace or safety of the
Capitol Compound.
f. Engaging in any form of gambling.
g. Unauthorized distribution of promotional materials outside the stall premises.
h. Hosting events or gatherings without proper permits and approvals.
i. Any activity that may result in harm, damage, or inconvenience to other
stallholders or visitors.

Article X: Monitoring and Enforcement

Section 16. Inspection and Monitoring


1. The capitol rolling management shall conduct periodic inspections to ensure
full compliance with these IRR.
2. Inspections shall include assessments of structural integrity, fire safety
measures, waste management, and overall stall operations.

Section 17. Penalties and Sanctions


1. Violation of any provision of these IRR may result in penalties or sanctions as
deemed appropriate by the capitol rolling management.
2. Penalties may encompass fines, suspension, or revocation of the lease
agreement, depending on the gravity of the offense.

Section 18. Three Strike Rule


1. The "Three Strike Rule" shall be implemented for violations of these
Implementing Rules and Regulations.
2. Capitol rolling stall lessees shall be subject to termination of their lease
agreement upon the third violation.

Section 19. First and Second Strikes


1. Upon the first and second violation of these IRR, the capitol rolling stall lessee
shall receive a written warning from the Capitol rolling management.
2. The warning shall outline the nature of the violation and the necessary
corrective actions to be taken within a specified period.

Section 20. Third Strike


1. In the event of a third violation, occurring after the issuance of two written
warnings, the lease agreement of the capitol rolling stall lessee shall be
terminated by the Capitol rolling management.
2. Termination shall result in the immediate vacation of the stall premises,
removal of belongings, and forfeiture of any remaining security deposit.

Article XI: Dispute Resolution

Section 21. Dispute Resolution Mechanism


1. In case of disputes arising from the interpretation or implementation of these
IRR, the concerned parties shall seek resolution through negotiation and
mediation facilitated by the Capitol rolling management.

2. If mediation fails, the dispute shall be resolved through arbitration in
accordance with applicable laws and regulations.

Article XII: Termination of Lease

Section 22. Termination of Lease


1. The lease agreement may be terminated for just cause, including but not limited
to:
a. Non-compliance with these IRR or lease conditions.
b. Persistent violation of safety, environmental, or operational standards.
c. Failure to remit lease fees or security deposit.
2. Termination proceedings shall follow due process and shall be subject to the
decision of the Capitol rolling management.

Article XIII: Miscellaneous Provisions

Section 23. Amendments


1. This IRR may be subject to periodic review and amendments as required by
changing circumstances or legal obligations.
2. All stakeholders shall be informed of any proposed changes, allowing for due
consultation and feedback.

Section 24. Effectivity


These Implementing Rules and Regulations shall come into effect upon approval by
the competent authorities.

These Implementing Rules and Regulations are hereby approved on this _______
