the motor vehicle to Sibongile upon full payment of the R50 000.

Q.2.1 ABC Company hired a building as office premises under a five-year lease. Two (15)

Q.2.2 Andrea owned an exclusive clothing store. Bongi bought six outfits worth
R7000 from Andrea. Bongi was in a hurry as she had several meetings on the
day of the purchase. Andrea and Bongi agreed that Andrea would keep the
outfits in the store and that Bongi would fetch them the following day. That
night the store burnt down, and the outfits were irreparably damaged.

Discuss the legal position in terms of the scenario set out below in accordance with the common
law and in relation to the Consumer Protection Act and how this piece of legislation has
developed the common law position.

Simone imports perfume from France and resells them in South Africa. Andrew purchased the
perfume from Simone and had a terrible reaction as the perfume had expired.

Andrew was in a serious condition and he has a hospital bill from his reaction in the amount of R
35 000. Simone advised that she could not have known that the perfume expired as it had arrived
in a concealed container. She is only prepared to refund Andrew for the price of the perfume
being R 2000.

Advise Andrew what defect is present with the perfume, what remedies he has available and what
he can recover from Simone.
