1. That the abovementioned matter is pending trial before

this Hon’ble Court.

2. That the above mentioned matter was listed before this

Hon’ble Court for evidence.

3. It is submitted that the Applicant / Accused is situated in

industrial suburb, Tumkur road, Yashwantpur, Banglore-
560022 and seeking to close the matter by issuing post
dated cheques for the same.

4. That in view of the above the Applicant/Accused No.1

couldn’t appear in the court due to Professional
constraints and files exemption from this Hon’ble Court
for this day only, Applicant/Accused No 1 booked his air
ticket but due to some personal medical reasons couldn’t
take the same.
5. It is submitted that the non appearance of the Accused
no.1 Applicant before this Hon’ble Court on 03.09.2023
was neither intentional nor deliberate but for the reason
stated above.

6. That it is submitted that the Applicant/accused No.1 has

been regularly appearing before this Hon’ble Court
when the captioned matter has been listed.

7. That the accused No. 1 undertakes not to be absent

before Court on any future dates and undertakes to be
punctual in future
