As per contract, failure to pay two consecutive rentals shall be ground for termination of the
lease contract.

Starting 2016, the rental payments started to be irregular, mostly not meeting the agreed
monthly rent. Emily Tolentino continuously asked for consideration to delay the payments in order to
keep her business afloat.

The situation continued for more than a year until sometime in August 2020, an agreement
was reached that she will be given until September 22, 2020 to either pay her rental liabilities or
vacate the premises.

Come September, she requested once again to pay every week for her delays. She has an
accumulated rental liabilities of Php 181,500 as of October 2020.

The lease contract is essentially void at this point as she has failed to pay more than 2
consecutive months. She has been allowed to continue leasing the place out of the lessor's
consideration.
