Notice of Termination for the Breach of the Residential Tenancy
Agreement
dated December 13, 2019 and/or Contravevention of the Alberta
Residential Tenancies Act

I signed Residential Tenancy Agreement for the suite # xxxx at 6707 Elbow Drive SW
CAlgary, AB on the 13 of December, 2019. Actual move in date was on 24 of December.
After spending one night in the unit, I became aware of the strong smell in it; my
guess is that it is the smell of cat's urine from under the floor covering. I
discussed the issue with the rental office on December 26 and was promised that I
will be moved to another unit on Monday, December 30, 2019, when the administration
is back from the holiday.
I immediately moved out of the suite # xxxx and arranged for alternative
accomodation for several nights.
On December 30, 2019 I met with the administrator and it was explained that I need
to provide a Notice to Vacate and my case will be reviewed after the New Year.
It is unacceptable for me to continue occupy suite # xxxx due to the strong smell,
making residential premises unfit for habitation, therefore I serve this Notice of
Termination for the Breach of the Residential Tenancy Agreement dated December 13,
2019 and/or Contravevention of the Alberta Residential Tenancies Act. I request
immediate termination of the Residential Tenancy Agreement dated December 13, 2019
for suite # 0620 and a move into another unit. Until I am provided a posession of
another unit, I will not make rental payment for the month January 2020. If a
posession of another unit is not provided by January 2, 2020 - I will apply to the
Residential Tenancy Dispute Resolution Service for the termination of the
Residential Tenancy Agreement , for the refund of the Damage Deposit and
compensation of damages.
