Sub: Legal notice for inconvenience caused due to garbage dumping.

Madam,

1. That, on behalf and under instructions of my client Mr. X who is a law-abiding citizen
of India, I hereby serve you this legal notice.

2. That, my client owns a house in selaqui, Dehradun. Which he bought to spend rest of
life peacefully after serving in the Indian Army for 30 years.

3. That, my client’s house has a small garden full of flowers and is fenced by wooden
fencing with a small gate to enter the premises.

4. That, my client’s house is adjacent to the house of Ms. Y, who happens to be a new
resident of the locality. House being sold by Mr. Z to Ms Y.

5. That, my client on 9th August,2023 came home from work at about 11pm and noticed
that his garden had small packets filled with garbage and left over food. My
considering it to be an act of kids did not take it seriously.

6. That, my client cleaned up the place which took about an hour and a half after tiring
day of work at the office.

7. That, on next day 10th August,2023 my client came home from work only to find
similar amount of the garbage thrown into his garden, which meant that someone was
deliberately throwing the garbage into his garden.

8. That, on 12th August,2023 when my client returned to home at about 11pm, the usual
time that he reaches home from work, he yet again found garbage thrown into his
garden. This time my client took it seriously and decided to find about the culprit.

9. That, on 14th August,2023 my client took a half day’s leave and reached home early at
about 6pm to find about the person who was throwing the garbage bags. To my
client’s utter shock, he saw Ms. Y throw the garbage into his garden at about 8 pm.

10. That, on 15th August, 2023 my client being of polite nature that he is, calmly told Ms.
Y not to throw garbage into his garden, because that makes his garden dirty and also
harms the flower plants that he had been nurturing since a long time.

11. That, even after repeated requests from my client, Ms. Y being of stubborn nature
continues to throw garbage in my client’s garden which has resulted in a mess around
my client’s house and garden.

12. That, my client being an employee finds it difficult to take out time every day to clean
the garbage.

13. That, all the flowers in my client’s garden along with the paint of the wooden fence
got completely ruined.

14. That, on 18th August,2023 my client called labourers and gardener to fix his garden
and the wooden fence and to get rid from the huge dump of garbage.

15. That, my client spent the following amount on the renovation of his garden:

(a) New paint on wooden fencing-10,000rupees


(b) New plants for the garden-5000rupees
(c) Fertilisers- 2000rupees
(d) Labour charge-2000rupees
(e) Gardener charge-1000rupees

My client also suffered from mental agony and distress for which he claims a sum of
50,000rupees, therefore a sum of 70,000rupees in total to be paid to him.

16. That, my client demands the above-mentioned sum of money to be paid to him within
15 days of the receipt of the notice failing which my client shall be constrained to
initiate appropriate legal proceedings, civil or criminal, against you, at your own risk,
responsibility, cost, and consequences
