6. The fact that I am the sister of Maria Forbile Vistro, Eusebio Forbile Vistro and Teofilo Forbile
Vistro is evidenced by our Certificates of Birth showing that we have the same father and
mother. Copy of my Certificate of Birth is hereto attached as ANNEX “B” and Copy of the

her and my newly born child due to distance as I was on duty in
Alabang, Muntinlupa premises;

feeling well;
d. On November 3, 2016, I was diagnosed to suffer influenza and

was advised to rest for 3-4 days as evidenced by the Medical
Certificate issued to me by Dr. Allan A. Landrito, M.D., copy of it
is hereto attached as Annex “2’;
e. From November 4-6, 2016, I was not able to report for work as
my illness worsens. My wife and newly born child were still
confined in the birthing home as I have not paid yet their medical
billings. However, I was not still able to go to Batangas as I was

f. Then, after medication, on November 7, 2016 I was able to

report for work;
g. On November 10, 2016 I finished my duty at 8:00 o’ clock in the

morning. After duty, I did not rest/sleep anymore instead
immediately rushed to Nasugbu, Batangas City which is 3 hours
from Alabang, Muntinlupa City to attend to my wife;
h. My wife and child were discharged on November 10, 2016 at

1:30 PM as evidenced by the Admission and Discharge Record
issued by Saint Light Birthing Home, Nasugbu, Batangas hereto
attached as Annex “3”;
i. From birthing home, Nasugbu, Batangas to the resident house of

my wife in Brgy. Cumbento, Look, Nasugbu, Batangas is 2 hours
travel. Hence, we arrived at 4:00 o’ clock in the afternoon;
j. At about 5:30 o’ clock in the afternoon, though against my will

and without rest and sleep, I sacrificially left my wife and child as I
was to report for duty;
k. At about 8:00 o’ clock in the evening (November 10, 2016), I

arrive in Alabang, Muntinlupa City and directly reported for work
even restless, exhausted and sleepless for the sake of my duty;

sss. The restlessness, exhaust and weariness I suffered due to the narrated
facts and incidents contributed to my unconscious and unplanned
behavior at that time and not to intentionally neglect my duty, but
likely, a reaction of my tired human body;

duty is my first offense. I have been responsible, dependable and fully
aware of my duties as a policeman;

P25,000,000.00 with 8% commission equivalent to P2,000,000.00 for
Zaldy and Mr. Rey De Mesa. Mr. Rey De Mesa told Zaldy that the
P2,000,000.00 would be divided equally between the two of them. So,
each of them would earn P1,000,000.00 as their individual commission;
40. Thereafter, I verbally agreed with the contract especially that my

friend, Zaldy would benefit to the said transaction and I will somehow
gain a good profit. Then, Zaldy told me that he would just contact me
for the formal arrangement of the contract. Also, Mr. Rey De Mesa got
my cellphone number;
41. About the second week of December, 2014 Mr. Rey De Mesa started
to communicate with me regarding the said warehouse project. Mr.
Rey De Mesa told me that Zaldy advised him to talk directly to me
regarding the formality of the project as Zaldy was out of town. Mr.
Rey De Mesa and I constantly talked with each other thru cellphone;
42. During the first week of January, 2015 Mr. Rey De Mesa and I formally
settled the contract. I contacted Zaldy to inform him that the contract
was already settled. However, I did not know his number because my
old cellphone was lost and I was not able to retrieve Zaldy’s cellphone
number;
43. During the second week of January, 2015 the contract price was paid
by the client. Mr. Rey De Mesa told me that he would just go to my
house to get the commission;
44. On January ___, 2015 Mr. Rey De Mesa went to my house. I was a bit
surprised that Zaldy was not with him. I asked Mr. De Mesa where is
Zaldy. Then, he told me that Zaldy was still out of town. I also asked
how would Zaldy get his part of the commission. Mr. De Mesa told
me that he and Zaldy already talked and he would just be the one to
give Zaldy his commission;

would just give Zaldy his share, I gave Mr. Rey De Mesa their
commission, P500,000.00 as partial payment and six post dated checks
amounting to P250,000.00 each with date starting March, 2015 to
August, 2015. I told Mr. Rey De Mesa, “Ikaw na bahala kay Zaldy”;
46. On February 5, 2015, Zaldy called me thru my cellphone. He asked me

about the status of our warehouse project. I wondered and asked him
if Mr. Rey De Mesa did not tell him that I already gave their
commission, P500,000.00 as partial payment and six post dated checks
amounting to P250,000.00 each with date starting March, 2015 to
August, 2015;
47. Zaldy told me that he just came from the house of Mr. De Mesa to ask
about the project but Mr. De Mesa told him that, “Malabo kausap si
Barrameda”. Zaldy told me that he thought there was something
wrong so he immediately called me;
48. After hearing that from Zaldy, I told him to go to Mr. De Mesa and get
his share as Mr. Rey De Mesa assured me that Zaldy would get his
share;
49. Then, the next day, I learned from Zaldy that Mr. Rey De Mesa did not
give any amount as his share of the commission;
50. As of this date, Zaldy still did not get his share in the commission.

108. During that time, I was able to communicate with my mother and
told him the condition of my late father trying to ask for help. That
time, I learned that she already has relationship with another man and
been living with him for a long time in Europe;
109. Upon finding it out, I thought not to bother my mother anymore

because she has her own family. My mother asked me to just take care
of everything because she is living her own life and that there is no
way he can help my father. Moreover, she did not want to get involved
with my father’s life anymore because conflicts may arise if her new

110. Since, then, I tried to inform my mother about my father’s worsening

condition but I was not able to contact her anymore. My mother just
