JOINT AFFIDAVIT OF ARREST

We, the UNDERSIGNED Police Officers, both members of the Philippine

National Police, presently assigned at the Pacdal Police station, City of Baguio , do
hereby depose and state THAT:

01. We are among the members of the Philippines National Police who
conducted entrapment operations at Barangay Pacdal located along Baguio City.

02. Said operation stemmed from the complaint of Jeffrey Bernabe for
violation of REPUBLIC ACT NO. 7659, Sec. 6. Article 248 which was referred to our office
by the Chief of Police against Rizal Espiritu y Kinao (32), (Married), (Filipino) and
residing at Barangay Pacdal, Baguio City

03. On the complaint dated September 9 2015 , FRED MALICDAN Y

MILLER and RIZAL ESPIRITU Y KINAO for them to kill SATO SANAD Y DOGA-ONG,
the accused Fred Malicdan and Rizal Espiritu, did then and there willfully, unlawfully
and feloniously attack, assault and stab Sato Sanad with a sharp pointed instrument
several times on his back inflicting on said Sato Sanad several stab wounds at his back
as a result of which said Sato Sanad died.

04. Upon receipt of their said complaint, our office planned out an
entrapment operation against the suspect. At about 7:50 in the morning of September
11 2015 the undersigned together with the complainant proceeded at the pre-arranged
pay off Jeffrey Bernabe located along Barangay Pacdal, Baguio City to give the money
being asked by the respondent;

05. Upon arrival thereat, complainants waited for the suspect to arrive
while we the undersigned seated near the table of the complainants. At about 9:00 am,
suspect arrived and approached the complainants and after few conversation,
complainants handed over the marked money to the suspect that minutes of prompted
the undersigned to immediately effect arrest;
06. Seized and recovered in the possession and control of the arrested
person were the following, to wit:

a.) Marked Money, (Five Hundred Peso Bill);

 b.) (Samsung S20 with Smart Sim); and

c.) Other evidence confiscated;

07. Suspect together with the seized and recovered evidence was brought
to the Pacdal Police Station, Baguio City for booking and proper disposition. Likewise,
the arrested person was apprised of their rights as provided for under the Constitution of
the Philippines.

We executed this joint affidavit to attest the truthfulness of the foregoing facts
and to support the filing of Criminal Cases against Rizal Espiritu y Kinao for violations of
REPUBLIC ACT NO. 7659, Sec. 6. Article 248.
