CRIMINAL COMPLAINT

The undersigned hereby accuses FAUSTO M. LUMENARIO of Brgy. Tinago,

Camalig, Albay and his other four (4) male companions whose respective names are still to be
established, of Frustrated Murder committed as follows:

“That on 23 December 2007 at 10:30 in the evening, in Camalig, Albay,

Philippines, and within the jurisdiction of this Honorable Office, the above-
named accused conspiring and confederating with four (4) other male persons
whose names are still to be established, armed with a gun, did then and there
willfully, unlawfully and feloniously, and with intent to kill, treacherously fired a
shot at the undersigned hitting the back of his body which ordinarily would cause
his death thus performing all the acts of execution which should have produced
the crime of Frustrated Murder as a consequence, but nevertheless did not
produce it by reason of timely and able medical assistance rendered which
prevented his death.
To the damage and prejudiced of the offended party.
