CRIMINAL COMPLAINT

The undersigned hereby accuses REY B. VERGARRA of Zone 7, San Antonio, Tabaco
City of Attempted Homicide defined and penalized under Article 249 of the Revised Penal Code,
committed as follows:

“That on 06 December 2008 at about 4:45 in the afternoon, at Barangay

13, Bacacay, Albay, Philippines, and within the jurisdiction of this Honorable
Office, the above-named accused, armed with a sickle (“kagot”), did then and
there willfully, unlawfully and feloniously, and with intent to kill, boxed the
undersigned in his right ear and attempted to hack/hit him which ordinarily
would cause his death but did not perform all the acts of execution which should
have produced the crime of Homicide as a consequence, but nevertheless did not
produce it by reason of the timely escape of the undersigned.

To the damage and prejudiced of the offended party.

CONTRARY TO LAW.”
