INFORMATION

The undersigned Government Prosecutor accuses ERNESTO P.

GATMAITAN of the crime of homicide as defined in Article 249 of the Revised
Penal Code, committed as follows:

“That on or about the 14th day of February 2021,

in the City of Davao, and within the jurisdiction of the
Honorable Court, the aforenamed accused, acting by
himself, did then and there, willfully, unlawfully and
feloniously, stab one LORENA G. MASANGKAY, with
the use of a double-bladed fan knife, hitting the latter at
her front right side, thus causing a mortal wound from
which the victim LORENA G. MASANGKAY succumbed
to death, thereby performing all the acts of execution
necessary to produce the felony of homicide.”
