CONTRACT OF LEASE OF WATER REFILLING STATION


and TRUCK VEHICLE
KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT, made and entered into by and between ALFREDO DAGALEA, of legal age, married,
a resident of Talon-talon, Zamboanga City, hereinafter known as the LESSOR and GILBERT N. MARCELINO, also
of legal age, married, and a resident of Sitio Canucutan, Upper Pasonanca, Bunguiao, Zamboanga City, and hereinafter
known as the LESSEE,

-- WITNESSETH –

1. That the LESSOR hereby agrees to lease unto the LESSEE the following water refilling station and truck
vehicle for and in consideration of the monthly rental amount of THIRTY THOUSAND PESOS (Php
30,000.00), Philippine Currency, described as follows:

 a unit of building space which houses a water refilling station facility and with business name and
address as Iris Spring Water Refilling Station, situated at Zone-4, Bunguiao, Zamboanga City.
 Equipment consisting of a truck vehicle used in the delivery of bottled water with the following
descriptions:

2. That the LESSEE shall not make or cause to be made any improvement in the premises without prior written
consent of the LESSOR, it being understood that such improvement in the premises shall be at the sole
expense of the LESSEE;

3. That the LESSEE shall not directly or indirectly sublease, assign, or transfer her right under this Contract to a
third party or parties, without the consent in writing of the LESSOR;

4. That it is understood by both parties that payment for the use of electric and vehicle maintenance shall be at
the sole expense of the LESSEE;

5. That the term of this lease is for ONE (1) YEAR, commencing on May 20, 2023 and expiring on May 20,
2024;

6. That the LESSEE hereby expressly acknowledges that the leased premises are in good and tenantable
condition and agrees to keep the same in good and tenantable condition complying with laws, ordinances and
regulations of the City or National Government as regards the use, occupation and sanitation of the leased
premises, and failure to comply shall be at the risk and expense of the LESSEE;

7. That the failure of the LESSOR to insist upon a strict performance of any terms, conditions, and covenants
hereof shall not be deemed a waiver on her part of the terms of the contract;

8. That any and all violations of the conditions of the Contract herein stipulated shall subject the guilty party to
the payment of damages, aside from costs of suit and attorney’s fees.

IN WITNESS WHEREOF, these presents are signed both by the LESSOR and the LESSEE, this 20 th day May
2023, at Bunguiao, Zamboanga City.
