The Barangay Local Government Unit of Guinlajon, West District Sorsogon City wishes to thank the
following: Mr. Josie L. Jadie, City Social Welfare Officer for organizing a Barangay Juvenile intervention
Program workshop which helps us to educate ourselves on how to handle minors who are at risks and in
conflict with the law. That programs enlighten and train us to create a multi-disciplinary action team.

The Barangay Officials headed by Barangay Chairperson Roland Lasap and its Sangguniang Barangay
Member of Guinlajon for the issuance of barangay legislations and other policy supports as legal support
in the implementation of this plan.

The Barangay Council for the Protection of Children for the active participation and substantial Inputs in
the finalization of this plan and endorsement of this plan to the Local Government of Sorsogon City.

For the Sangguniang Kabataan President/Officials for their inputs during the write shop and inclusion of
the PPAs in their regular programs.

I. INTRODUCTION
As to the political unit, the Barangay serves as the primary planning and implementing unit
of government policies, plans, programs, projects and activities in the community, and
where disputes may be amicably settled.

When we work with children, we need to ensure that their rights are respected and their
best welfare given paramount consideration. This applies even to children-in-conflict with
law (CICL) and children-at-risk (CAR) especially because we took at them not as offenders
and the less-privileged but as individuals who need special protection and assistance. For
this reason, we shifted from retributive to restorative justice in handling CICL and CAR.
Restorative justice holds the offender accountable for the harm caused by the offense
committed. It repairs severed relationships to the extent possible with the maximum
participation of the victim and the community as it enables the CICL and Car to become a
better person. It gives emphasis on the just reparation of the damage rather than on
punishment especially through imprisonment.

To apply the principle of restorative justice, Sec. 22 B of Republic Act 9344 or the Juvenile
Justice and Welfare Act of 2006 mandates the conduct of diversion in the case of a CICL
above 15 but below 187 years old and was assessed to have acted with discernment. CICL
and CAR have rights which must be respected. According to the UN Convention on the Rights
of the Child (CRC). “Stated Parties recognize the right of every child alleged as, accused of or
recognized as having infringed the penal law to be treated in a manner consistent with the
promotion of the child’s sense of dignity and worth, which reinforces the child’s respect for
the human rights and fundamental freedom of other and which takes into account the
child’s age and the desirability of promoting the child’s reintegration and the child’s
assuming a constructive role in society” (Article 40.1) The CRC emphasizes that children
should be diverted away from judicial proceedings whenever possible and redirected to
community support services.

Every single individual today is affected by juvenile delinquency. It affects parents,


neighborhood in the barangay, teachers and students at school and families. It affects the
victims of juvenile delinquencies, the perpetrators, and the bystanders. While delinquency
rates in Sorsogon City can be assumed to have been decreasing rates are still too high. There
have been numerous programs that have attempted to lower this rate. According to the
research made by Zagar & Busch, a number of different types of programs currently exist.
Those that get involved with the delinquent after the occurrence of deviant behavior and
prevent that behavior-prevention programs by getting involved in children’s lives early, later
crime can be effectively reduced.

Republic Act 9344 otherwise known as the Juvenile Justice and Welfare Act of 2006, as
amended by the Republic Act 10630 otherwise known as the Act Strengthening the Juvenile
Justice System in the Philippines, provides for the Local Government Units development of a
Comprehensive Juvenile Intervention Program to address the concerns of the Children-At-
Risk (CAR) as well as the Children-In-Conflict with the law (CICL).

Cognizant to this, the Barangay Guinlajon through the office of the Sangguniang Barangay
passed Ordinances and Resolutions that champion the right of CICL and CAR.

ORDINANCE TITLE

Ordinance No. 20-002 “CHILD CODE”- An Ordinance on the Comprehensive and Integrated Children
Series of 2020 and Family Support System in the Barangay Guinlajon or the Children’s
Welfare Code of 2020.
Ordinance No. 20-011 An Ordinance Requiring All Barangays in the City of Sorsogon to establish
Series of 2020 their Violence Against Women and Children (VAWC) Desk.

Ordinance No. 20-19 An Ordinance Providing Special Protection for Children During Nighttime by
Series of 2021 Imposing Curfew Hours for minors within the territorial jurisdiction of
Barangay Guinlajon.
Special Ordinance No. A Resolution Adopting Republic Act No. 7877, or Otherwise Known as the
20-029-2021 anti-Sexual Harassment Act of 1995 in the City of Sorsogon and for other
purpose.

Resolution No. 21-085 A Resolution Adopting Republic Act no. 9710 otherwise known as the Magna
Series of 2021 Carta of Women in the City of Sorsogon City.

II. SUMMARY OF MAJOR PROBLEMS AND CHALLENGES CONFRONTING CHILDREN -AT-RISK


(CAR) and CHILDREN IN CONFLICT WITH THE LAW (CICL)

Most of the CICL are product of broken families where the family relationship is unstable resulting to
inadequate attention to children. This is compounded by marital discord and lack of parenting skills
in rearing their children. Some of the CICL were found out to be totally and partially abandoned and
living with relatives. Due to lack of parents accompanied by physical, emotional and verbally abused
by people who were to be the one guiding and giving care CICL ran away were forced to the streets.

Based on the inventory of CICL of Philippine National Police Region V for CY 2022, a total of 600
CICLs were reported of this, 539 or 76.65% are CICL ages below 15 years old and 125 or 23.35% ages
above 15 but below 18 years old.

A. The following are the top reported cases:


 Theft
 Physical Injuries
 Curfew
 Alarming Scandal
 Violation of RA 9165
B. The following are the identified problems on Demand side:
 Most CICL’s are product of broken family
 Parents are not properly educated in rearing their children
 Parents are force to work abroad to augment family income.
 Children are vulnerable to peer pressure.

C. On the Supply side the following problems are identified


 Absence of Bahay Pag-Asa in the Province.
 Social Worker are not solely focused on CICL’s work.
 Service providers are not equipped in handling CICL.
D. On the Enabling Environment these are the following problems
 Need to fully implement RA 9344 as amended by 10630
 Strict implementation of the statutory 1% IRA allocation
 Anti-Bullying law is not properly implemented
 And full implementation of DILG

III. GOALS AND EXPECTED RESULTS

With the CICL and CAR situation, Barangay Guinlajon some-up this goal:

That by 2023 100% of CICL’s are rehabilitated and reintegrated to their family and community and
new CICL cases are reduce by 50% from 50 cases reported 2020 baseline data.

Hence, the Barangay Local Government Unit thru The Barangay Council Protection of Children
likewise aims of:

 Strengthening family relationship and their children leading to a very dynamic and
harmonious relationship with the satisfaction of the children in the way their parents reared
them.
 Equipping the barangay local leaders, duty bearers and partner stakeholders towards a more
responsive, effective and efficient service delivery for our CAR and CICL.
 Continuing advocacy and information drive that would create public awareness in promoting
and protecting child’s rights.
 Availability of programs and services for the CAR and CICL at the community level that would
enable them to become functional ready for mainstreaming with their families and their
communities.
IV. PROGRAM COMPONENTS

Strengthening the family values and providing them gainful employment for economic stability, the
members of the family are bonded together, understanding their roles in the family. Assisting them
in gainfully employed will give the family assurance that there is food on the table every meal time is
set. The need to strengthen pre-marriage counselling service to would be married couples is also an
imperative act to let them understand better their roles when they will be parents in the future. A
complete parenting aspects. Providing parents accessibility to different programs and services such
as PES, ERPAT and Family Development Sessions will lead into realization of improving their roles and
responsibilities. It’s a reality that most of our children are very vulnerable to societal issues due to
peer pressure. It is at this very age that they are into the phase were they tried to discover their
selves more and better.

The functionalization and operationalization of Bahay Pag-Asa in the province is very essential to
address complete program in changing the perception of our CICL. We would like to restore our
children. Understandably, there was just a clinch on the very reason why their life was bent a little.

The essence of the law is to restore our children back again to society. Proactive BCPC giving full
attention to the sound every time a child cries, sees his welfare and a brighter tomorrow.

The heart of Republic Act 9344 as amended by RA 10630 is to protect the child who have committed
a crime, restore them back to society under a program. Furthermore, we see that there is still hope
in reforming the child, if properly guided. It might be that during his growth, something along the
way went gray and he is misguided. Duty bearers should do their part.

V. IMPLEMENTATION MECHANISM OF THE PLAN

This plan will set the tone for the committee in the implementation of the Barangay Comprehensive
Juvenile Intervention Program. Thus, the Barangay Council members, BCPC members and partner
stakeholders shall identifies procedures, steps and mechanism for a more concrete, specific and
timely program delivery thereby ensuring its efficiency and effectiveness. The barangay council will
ensure that all plans are cascaded and implemented by the accountable person or agency. This is an
initial step in laying the cornerstone and a very good foundation for program implementation.

Conducting Focus Good Discussion, consultation, meeting, group discussion, monitoring visit, for a
and advocacy café helped in the addressing data gathering.

Overall, the Barangay Council headed by the Barangay Chairperson will provide the committee
member, with the evaluation and assessment results for information, policy and decision-making
purposes.

Reporting for the outcomes under the Barangay Comprehensive Juvenile Intervention Program will
still be done on a quarterly basis which will be prepared by the Barangay Secretary.

Continuous provisions of technical assistance from the City Social Welfare and Development Office
and the Regional Juvenile Justice & Welfare Committee shall done all throughout the
implementation period.

VI. MONITORING AND EVALUATION

The Barangay Council together with the BCPC will conduct a bi-monthly meeting to discuss the
progress of the implementation of the plan. Accomplishment will be discussing the progress of the
implementation among the members. The responsible agency or person in each PPAs identified will
be the one to present the status of accomplishment.

A conduct of Consultation Dialogue, Focus Group Discussion and Key Informant Interviews to
validate data and generate more information from our CICL and from Duty Bearers. Getting first-
hand information to help us address a better program and improve the services needed by the CICL
and CAR.

It is imperative that a year-end review of the plan be done with the Barangay Council members,
BCPC members, Sangguniang Kabataan representative, partner stakeholders to determine if targets
are being met and if there is a need to reprogram few of the target.
