NATURE OF CAT
This is a group work CAT and must be done within the assigned groups.

CAT INSTRUCTIONS
1. Each firm is expected to make a 15 minutes’ presentation on the assigned task.
2. The group presentations will be made during the 1-hour virtual class segment of the unit.
3. Marks will be awarded for content grasp and application of contract law principles to the assigned task.
4. The CAT is marked out of 20 marks.

CASE FACTS: FIRM 3 & 4


Cecilia Mukami v GenuineJapanMotors Ltd

Cecilia Mukami entered into a written contract with GenuineJapanMotors Ltd, a car dealership, to purchase a
second-hand Demio Mazda car. The contract included the following key terms:

1. Price and Payment: The contract specified that Cecilia Mukami would pay Ksh. 650,000 for the second-hand
Demio Mazda car, with a down payment of Ksh. 150,000 and the remaining balance to be paid in 10 equal
monthly installments.
2. Delivery Date: The contract stated that GenuineJapanMotors Ltd. would deliver the second-hand Demio
Mazda car to Cecilia Mukami within 10 days of the contract signing.
3. Warranty: A standard warranty was included in the contract, guaranteeing the condition and performance of
the second-hand Demio Mazda car for a period of six months.
4. Additional Document: The contract referred to a Car Manual to be provided by GenuineJapanMotors Ltd.,
which would contain detailed information about the repayment terms and maintenance and care of the second-
hand Demio Mazda car.

During the negotiation process, the dealership manager, Mr. Kaur, verbally informed Mukami that the company
usually provides complimentary maintenance services for the cars purchased from them for the first five months.
Additionally, given the prevailing financial strain in the country, in the event that she was unable to keep up with
the monthly installments, she was eligible for an extension of up to three months to complete the arrears. Mukami
has faithfully kept up her installment payments for four months. However, she fell into financial hardship and was
unable to make the fifth installment. She decided to explain her situation to the dealership while also taking
advantage of the complimentary maintenance. Upon arrival at the dealership, the car was impounded due to her
failure to keep up with the installment payments. Mukami was informed that the Car Manual clearly specifies that
the complimentary service is only reserved for brand new cars.
