THE LEGAL SYSTEM IN INDONESIA

The legal system in Indonesia is based on civil law, which is a legal system that is based
on written laws and codes. The civil law legal system is used in mainland European countries
and their colonies, including Indonesia. The judiciary in the civil law legal system is
inquisitorial, meaning that judges play a significant role in directing and deciding a case. The
civil law legal system is divided into two basic categories: civil law and public law. The civil law
legal system has three characteristics: codification, judges are not bound by precedent or the
doctrine of stare decisis, and the judicial system is inquisitorial.

The civil law legal system has an equivalent concept to the doctrine of precedent, which
is called jurisprudence Constante. This concept requires judges to carefully consider previous
decisions on cases that have similar facts and legal issues. However, in practice, the Indonesian
legal system is not entirely aligned with the civil law legal system because it has adopted some
characteristics that are identical to the common law legal system.

The common law legal system, which originated in England and developed in its
colonies, is based on court decisions as a source of law. The influence of fast-paced information
technology has led to the acculturation of legal systems. Although the Indonesian legal system is
based on civil law, it also uses some characteristics of the common law legal system in certain
areas.
