AN ORDINANCE AMENDING CERTAIN PROVISIONS OF CITY ORDINANCE NO. 2003-034,
SERIES OF 2003, ENTITLED CREATING THE COOPERATIVE DEVELOPMENT COUNCIL
OF THE CITY OF LAOAG
WHEREAS, The Cooperative Development Authority (CDA) is a proactive and responsive lead
government agency for the promotion of sustained growth and full development of the
Philippines cooperatives for them to become broad - based instruments of social justice, equity
and balanced national progress;
WHEREAS, section 15, article XII of the Philippine Constitution. To have an agency that would
promote the viability and growth of cooperatives as instruments of equity, social justice and
sustainable economic development, defining its powers, functions and responsibilities,
rationalizing government policies and agencies with cooperative functions, supporting
cooperative development, transferring the registration and regulation functions of existing
government agencies on cooperative as such and consolidating the same with the authority,
appropriate funds, therefore, and for other purposes;
WHEREAS, Article 2 of the Cooperative Code provides that, The State shall encourage the
private sectors to undertake the actual formation and organization of cooperatives and shall
create an environment that is conducive to the growth and development of these cooperatives;
WHEREAS, the Cooperative Development Authority under the office of the President issued
Memorandum Circular No. 2022-03, series of 2022 the subject matter of which is the revised
guidelines in the organization, structure and operation of the Cooperative Development Councils
(CDCs);
WHEREAS, there is a need to amend City Ordinance No. 2003-34 to further strengthen the
cooperative sector in the City of Laoag and to harmonize it with MC No. 2022-03, series of 2022
issued by the CDA;
SECTION 2. Chapter I, Article III, Section 1 of City Ordinance No. 2003-034, series of 2003 is
hereby amended as follows:
“Section 1. The Cooperative Development Council of the City of Laoag shall have the
following functions and powers:
f) To promote actively and strongly endorse the observance at all times of the
universally cooperative principles as enshrined in the Cooperative Code and
the Constitution in the performance of the above functions.”
SECTION 3. Chapter II, Article I, specifically Section 1, Section 2, Section 3 and Section 8 of
City Ordinance No. 2003-034, series of 2003 is hereby amended as follows:
a) Chairperson
b) 1st Vice-Chairperson
c) 2nd Vice-Chairperson, who shall come from the CDA
d) Secretary
e) Treasurer
f) Auditor
The chairperson of the Local Development Council at the CCDC who are
responsible for the spearheading the development in the City shall act as
Honorary Chairperson.
Except the 2nd Vice-Chairperson, all other officers shall be elected directly by the
members constituting the council at their respective levels.
The term of office of the elected officers shall be for two (2) years which shall
commence at noon on the day following their election. No officer shall serve for
more than two (2) consecutive terms.
The manner of election of officers shall be by secret ballot and shall and shall be
held on the second week of April of every year. No representative/s of the
Council shall be allowed to participate in the next CDC level should there be no
Election held in the Council he/she represents.
a) Oversees the preparation of the minutes and agenda and records the
attendance and proceedings of all meetings of the council;
b) Signs the minutes of meetings prepared by the Secretariat;
c) Ensures that notices of all meetings of the council are given to members;
d) Keeps register of the names and addresses of all members and keeps all
records through the Secretariat; and
e) In general, performs all the duties incidental to the office of the Secretariat
and those that maybe assigned to him/her by the Chairperson and/or the
Council.”
SECTION 4. Chapter II, Article I of City Ordinance No. 2003-034, series of 2003 is hereby
amended in part and there shall be intercalated a section 11 after section 10 which shall be read
as follows:
a) Prepares the minutes, agenda and records the attendance and proceedings
of all meetings of the Councils;
b) Serves Notices of meetings to all members of the Council
c) Furnishes the officers and members certified copies of the minutes of the
meetings;
d) Keeps register of the names and address of all members and keeps a
complete file of the laws, resolutions and executive orders to the creation of
the Council; and
e) In general, performs all duties incidental to the office of the secretariat and
those that may be assigned to it by the Chairperson and/or the Council”
SECTION 5. Chapter II, Article II, Section 1 of City Ordinance No. 2003-034, series of 2003 is
hereby amended as follows:
SECTION 6. Chapter IV, Article I, Section 3 of City Ordinance No. 2003-034, series of 2003 is
hereby amended as follows:
“Section 3. FUNDS
The funds of the Council shall primarily be derived from resource sharing
without prejudice to the right of the councils to receive gifts, donations,
benefits
and grants from any person whether natural or juridical including allocations
that may come from the Local Government Units.”
SECTION 7. Chapter IV, Article I of City Ordinance No. 2003-034, series of 2003 is hereby
amended in part and there shall be intercalated a section 4 which shall be read as follows:
For continuity of operation, the outgoing officers of the Council shall turn over
the official records, documents, properties and money accountabilities to the
new set of officers within 30 days after election. Failure to turn over shall be
subject to appropriate legal action”
SECTION 8. Chapter IV, Article II, Section 1 of City Ordinance No. 2003-034, series of 2003 is
hereby amended as follows:
“Section 1. The first regular election of officers of the Council under this ordinance shall
be held on the second week of November 2022 and every year thereafter and the officers shall
assume office immediately on November 15, 2022 and every year thereafter.”
SECTION 9. REPEALING CLAUSE – All ordinances, resolutions, motions or parts thereof not
consistent herewith are hereby repealed, amended or superseded accordingly.
SECTION 10. EFFECTIVITY CLAUSE – This ordinance shall take effect after ten (10) days from the
date a copy thereof is posted in a bulletin board at the entrance of the City Hall and in at least two (2)
other conspicuous places within the territorial jurisdiction of the City of Laoag.
