สัญญาฉบับนี้ทำขึ้น ระหว่าง นางสาวนฤมล ปะกิระสังข์ ที่อยู่เลขที่ 34 หมู่ที่ 9 ต. นาขาม อ.กุฉิ

นารายณ์ จ.กาฬสินธุ์ ซึ่งต่อไปนี้ในสัญญาจะเรียกว่า “ผู้ว่าจ้าง” ฝ่ายหนึ่ง กับ

ตั้งอยู่เลขที่ 105/105 ม.1 ตำบลบ่อผุ ด อำเภอเกาะสมุย จังหวัดสุ ราษฏร์ธานี 84320 ซึ่งต่อไปนี้ใน
สัญญาจะเรียกว่า
“ผู้รับจ้าง” ฝ่ายหนึ่ง

ทั้งสองฝ่ายได้ตกลงทำสัญญาว่าจ้างก่อสร้าง ดังมีข้อความต่อไปนี้ ::
IT IS HEREBY AGREED as follows ::

1. ผู้ว่าจ้างตกลงว่าจ้าง และผู้รับจ้างตกลงรับจ้าง ตามแบบแปลนและรายละเอียดของงานที่แนบ

ในการว่าจ้างนี้ เป็นการว่าจ้างทำของ “ผู้รับจ้าง” เป็นผู้มีหน้าที่ในการจัดหาวัสดุก่อสร้างและ

อุปกรณ์ต่างๆ ทุกอย่างทุกประการ โดยที่ “ผู้ว่าจ้าง” ไม่มีหน้าที่ในการซื้อหรือจัดการในการหามาซึ่งวัสดุ
อุปกรณ์ในการก่อสร้างแต่อย่างใดทั้งสิ้น
The commissioning of the "contractor" is responsible for providing all
construction materials. Where "the employer" is not obliged to purchase or manage the
acquisition of materials and equipment in the construction.
2. “ผู้รับจ้าง” ตกลงจะทำการก่อสร้างตามสัญญา ข้อ1 นับตั้งแต่ลงลายมือชื่อในสัญญานี้ ซึ่งตรงกับวันที่
ซึ่งตรงกับวันที่ ……………….. 2566 จนถึง …………. 2566
ถ้ า หาก “ผู้ รั บ จ้ า ง” ได้ ด ำเนิ น การก่ อ สร้ า งเสร็ จ สมบู ร ณ์ แ ละไม่ มี ข้ อ บกพร่ อ งใดๆ ก่ อ น
กำหนดเวลาการส่งมอบดังกล่าว “ผู้ว่าจ้าง” ก็จะต้องรับมอบงานและชำระเงินให้แก่ “ผู้รับจ้าง” ตาม
สัญญานี้

3. “ผู้ว่าจ้าง” ตกลงชำระค่าจ้างให้แก่ “ผู้รับจ้าง” เป็นเงินทั้งสิ้น 7,058,400 บาท (เจ็ดล้านห้าหมื่ น

ตามรายละเอียดการชำระดังนี้ / According to the payment details as follows ::

โดยในวันที่ลงลายมือชื่อในสัญญานี้ “ผู้ว่าจ้าง” ตกลงจะชำระค่าจ้างเป็นงวดๆ รวม 10 งวด
งวดที่ 1 : ชำระ 5% จำนวนเงิน 352,920.00 บาท (สามแสนห้าหมื่นสองพันเก้าร้อยยี่สิบ
บาทถ้ วน) สำหรับ การยื่ น ยั น ตกลงทำสั ญ ญา และเริ่ม ทำแบบสถาปั ตยกรรม เพื่ อ ขออนุญ าติในการ
ก่อสร้าง, ภาพทัศนียภาพ ,วิดีโอภาพ สามมิติ ,แบบก่อสร้าง ต่างๆ
First Payment : Payment 5% Amount 352,920.00 Bath. (Three hundred and fifty
two thousand nine hundred and twenty baht .) For submitting confirmation of agreement to
contract and started making architectural designs To request permission for construction,
landscape photos, 3D videos, various construction plans.)

งวดที่ 2 : ชำระ 10% จำนวนเงิน 705,840.00 บาท (เจ็ดแสนห้าพันแปดร้อยสี่สิบบาทถ้วน)

เมื่อผู้รับจ้างได้ทำการปรับพื้นที่, ตอกเสาเข็ม เสร็จสมบูรณ์แล้ว

งวดที่ 3 : ชำระ 15% จำนวนเงิน 1,058,760.00 บาท (หนึ่งล้านห้าหมื่นแปดพันเจ็ดร้อยหก

สิบบาทถ้วน) เมื่อผู้รับจ้างได้ทำ งานขุดดินหลุมฐาน, ตัดเสาเข็ม, ฐานราก, เสาต่อม่อ ,วางถังบำบัดน้ำเสีย
เสร็จสมบูรณ์แล้ว
3rd Payment : Payment 15% Amount 1,058,760.00 Bath. (One million fifty eight
thousand seven hundred and sixty baht ) the contractor has done Excavation of
foundation pits, cutting of piles, foundations, foundation posts, laying of wastewater
treatment tanks Completed.

งวดที่ 4 : ชำระ 10% จำนวนเงิน 705,840.00 บาท (เจ็ดแสนห้าพันแปดร้อยสี่สิบบาทถ้วน)

เมื่อผู้รับจ้าง ได้ทำคานชั้น 1, พื้นชั้น 1, ระบบท่อน้ำดี-น้ำเสียชั้น1 และเสาชั้น1, คานชั้น2 เสร็จสมบูรณ์
แล้ว ,วางระบบสระว่ายน้ำ
4th Payment : Payment 10% Amount 705,840.00 Bath.( Seven hundred and five
thousand eight hundred and forty baht). the contractor has completed the 1st floor
beams, 1st floor floor, 1st floor bile-sewage pipe system and 1st floor columns, 2nd
floor beams. Start to do swimming planning system

งวดที่ 5 : ชำระ 10% จำนวนเงิน 705,840.00 บาท (เจ็ดแสนห้าพันแปดร้อยสี่สิบบาทถ้วน)

เมื่อผู้รับจ้าง ได้ทื้ นชั้น2, เสาชั้น2 รับโครงหลั งคา, บันไดขึ้นชั้น2 เสร็จสมบูรณ์แล้ ว ก่ออิฐสระว่ายน้ำ
(บางส่วน)
5th Payment : Payment 10% Amount 705,840.00 Bath.( Seven hundred and five
thousand eight hundred and forty baht). the contractor Got the 2nd floor demolished,
2nd floor pillars supporting the roof frame, stairs to the 2nd floor. Completed Laying
bricks for swimming pool (Some part)

งวดที่ 6 : ชำระ 20% จำนวนเงิน 1,411,680.00 บาท (หนึ่งล้านสี่แสนหนึ่งหมื่นหนึ่งพันหก

ร้อยแปดสิบบาทถ้วน) เมื่อผู้รับจ้างได้ทำโครงสร้างเหล็กหลังคา มุงแผ่นกระเบื้องหลังคา, ก่อผนังอิฐชั้น
1 และชั้น 2 เสร็จสมบูรณ์แล้ว

งวดที่ 7 : ชำระ 10% 705,840.00 บาท (เจ็ดแสนห้าพันแปดร้อยสี่สิบบาทถ้วน) เมื่อผู้รับจ้าง

ได้ทำ ระบบท่อน้ำดี-น้ำเสียชั้น2, ระบบไฟ ฝังท่อ + ฝังบล็อคในผนังชั้น1 และชั้น2, ฉาบผนังภายในชั้น 2
และฉาบผนังภายนอก(บางส่วน) , ฝ้าเพดานยิปซั่ม, ระบบไฟ-ร้อยสายไฟในท่อ (บางส่วน) และระบบสระ
ว่ายน้ำสมบูรณ์
7th Payment : Payment 10% Amount 705,840.00 Bath. ( Seven hundred and five
thousand eight hundred and forty baht). the contractor has done Water pipe-sewage
system on the 2nd floor, electrical system, buried pipes + embedded blocks in the walls
on the 1st and 2nd floors, plastering the interior walls on the 2nd floor and plastering
the exterior walls (partial), gypsum ceiling, electrical system - strings Electrical wires in
pipes (partial) and complete swimming pool system

งวดที่ 8 : ชำระ 10% จำนวนเงิน 705,840.00 บาท (เจ็ดแสนห้าพันแปดร้อยสี่สิบบาทถ้วน)

เมื่อผู้รับจ้างได้ทำ ฝ้าเพดานยิปซั่ม, ฉาบผนังภายนอก (บางส่วน), ระบบไฟร้อยสายไฟในท่อ เสร็จสมบูรณ์
แล้ว ,ปูกระเบื้องพื้น+ ผนังบางส่วน, ฉาบผนังภายนอก, ติดตั้งประตู-หน้าต่าง (บางส่วน) , งานสีรองพื้น-สี
จริง (บางส่วน)
8th Payment : Payment 10% Amount 705,840.00 Bath. ( Seven hundred and five
thousand eight hundred and forty baht). the contractor has done Gypsum ceiling,
external wall plaster (partial), electrical wiring system in pipes Completed , floor tiles +
some walls, external wall plastering, door-window installation (some parts), primer-
actual paint work (some parts)
งวดที่ 9 : ชำระ 5% จำนวนเงิน 352,920.00 บาท (สามแสนห้าหมื่นสองพันเก้าร้อยยี่สิบ
บาทถ้วน) เมื่อผู้รับจ้างได้ทำ งานสุขภัณฑ์, ระบบไฟ- ติดตั้งอุปกรณ์ (ปลั๊ก, สวิทช์, ดวงโคม,แผงควบคุม
,ตกแต่งบันใด, ตกแต่งผนัง ต่างๆ , งานสุ ขภัณฑ์ (บางส่วน), ระบบน้ำดี -น้ำเสีย เสร็จสมบูรณ์แล้ว งานสี
เสร็จสมบูรณ์

ware, electrical systems - installed equipment (plugs, switches, luminaires, control panels ,

งวดที่ 10 : ชำระ 5% จำนวนเงิน 352,920.00 บาท (สามแสนห้าหมื่นสองพันเก้าร้อยยี่สิบ

บาทถ้วน) เมื่อผู้รับจ้างได้ทำ หารตรวจสอบระบบไฟ ต่างๆ และเก็บรายละเอียดงานก่อสร้างทำสะอาด
สถานที่ก่อสร้างส่งมอบงาน เสร็จสมบูรณ์แล้ว
10 th Payment : Payment 5% Amount 352,920.00 Bath. (Three hundred and fifty
two thousand nine hundred and twenty baht .) the contractor has done Inspect various
electrical systems and collect construction details for cleaning. Construction site delivering
work Completed

4. วัสดุเครื่องมืออุปกรณ์ที่ใช้ในการก่อสร้างรวมทั้งสัมภาระต่างๆ ที่จำเป็นให้ “ผู้รับจ้าง” เป็นผู้จัดหา ซึ่ง

จะต้องใช้วัสดุอุปกรณ์ตามขนาดและคุณภาพดังที่แจ้งไว้ในรายละเอียดแนบท้ายสัญญานี้
Materials, tools, equipment used in the construction, including the various
baggage that is necessary for the "contractor" to be the supplier, which must use the
equipment according to the size and quality as stated in the attachment of this contract.

ถ้า “ผู้ว่าจ้าง” ผิดนัดชำระค่าจ้างงวดใดงวดหนึ่ง “ผู้รับจ้าง” มีสิทธิยึดหน่วงในสิ่งก่อสร้างและ

สิ่งติดตรึงตราหรือการงานใดๆ ที่ “ผู้รับจ้าง” ได้ทำไว้ตามสัญญานี้ และ”ผู้รับจ้าง”มีสิทธิปฏิเสธทำการ
งานจนกว่า “ผู้ว่าจ้าง” จะได้จัดการชำระค่าจ้างแก่ “ผู้รับจ้าง” แล้วเสร็จ
If the employer has defaulted on payment of a particular period, The contractor
has the right to withhold the construction and fixture or any work That the contractor
has made in accordance with this contract. And the contractor has the right to refuse to
work until the employer has completed the payment of the contract to the contractor.

5. “ผู้รับจ้าง” จะต้องทำงานก่อสร้างทั้งหมดตามรายละเอียดให้ถูกต้องตามแผนผังการก่อสร้างที่ได้มีการ
ตกลงกันแล้ว ทั้งนี้ “ผู้ ว่าจ้าง” ยินยอมให้ “ผู้รับจ้าง” นำงานส่วนใดส่วนหนึ่งไปให้ ผู้อื่นดำเนินการ
(รับจ้างช่วง) แต่ต้องเป็นไปตามแบบแผนและมาตรฐานการก่อสร้างตามที่ได้ตกลงกันในสัญญานี้แล้ว
เท่านั้น และ “ผู้รับจ้างช่วง” จะต้องยอมรับในการที่ “ผู้ว่าจ้าง” มีสิทธิในการที่จะเข้าไปควบคุมและ
ดูแลตรวจการดำเนิ น การก่อสร้างของ “ผู้รับจ้างช่ว ง” ได้ด้วย และ “ผู้ รับจ้าง” จะต้องรับผิดชอบ
โดยตรงต่อ “ผู้ว่าจ้าง” ในการกระทำใดๆ ของ “ผู้รับจ้างช่วง”

"The contractor" must complete all construction work according to the correct

"employer" allows the "contractor" to take any part of the work to others. (Subcontract)
but must follow the pattern and standard of construction as agreed in this contract
only. And "subcontractors" must agree that the "employer" has the right to control and
supervise the construction of As well as "subcontractors" and "contractors" must be
directly responsible for "employers" in any act of "subcontractors".

6. ในระหว่างการดำเนินการก่อสร้างนี้ “ผู้รับจ้าง” ยินยอมให้ “ผู้ว่าจ้าง” หรือตัวแทนสามารถเข้าไปตรวจ

อาคารที่ก่อสร้างทั้งภายในและภายนอกได้เป็นการครั้งคราวตามความสมควร แต่จะต้องไม่เป็นการ
รบกวนหรือขัดขวางการก่อสร้างของ “ผู้รับจ้าง”

the agent can go to inspect the building both inside and outside the building from time

7. ในกรณีที่เกิดเหตุสุวิสัยใดๆ เช่น พายุเข้า น้ำท่วมใหญ่ หรือกระแสไฟฟ้าที่ส่งเข้าอำเภอเกาะสมุยขัดข้อง

หรือถูกตัด เป็นต้น ที่ไม่อาจหลีกเลี่ยงได้และเป็นเหตุให้การก่อสร้างดังกล่าวต้องหยุดชะงักลงโดยมิใช่
ความผิดของ “ผู้รับจ้าง” ก็ให้ยืดกำหนดดังกล่าวในวรรคก่อนออกไปเท่ากับเวลาที่สูญเสียไปเพราะเหตุ
ดังกล่าว

8. การรับประกันโครงสร้างกำแพงกันดิน ภายในระยะเวลา 1 ปี นับจากวันที่กำแพงนี้ตามสัญญาก่อสร้าง

เสร็จสมบูรณ์และได้ส่งมอบงานและ “ผู้ว่าจ้าง” ได้รับมอบงานในงวดสุดท้ายเรียบร้อยแล้ว หากส่วนใด
ส่วนหนึ่งของอาคารได้เกิดมีความชำรุดเสียหายอันเนื่องจากความบกพร่องในการก่อสร้างตามสัญญานี้
เช่น การทำฐานรากไม่มีคุณภาพหรือไม่ได้มาตรฐานตามหลักวิชาการ การใช้วัสดุต่ำกว่ามาตรฐาน การ
ไม่ระมัดระวังในการก่อสร้างอย่างเพียงพอ การก่อสร้างผิดแบบ หรืออื่นๆ เป็นต้น “ผู้รับจ้าง” จะต้อง
ดำเนินการแก้ไขซ่อมแซมให้ถูกต้องและเรียบร้อยและอยู่ในสภาพเดิมทันทีโดยไม่คิดค่าใช้จ่ายเพิ่มเติม
ใดๆ ทั้งสิ้น เว้นแต่ความเสียหายนั้นจะได้เกิดมาจากเหตุความผิดของ “ผู้ว่าจ้าง” หรือจากเหตุสุดวิสัย

เช่น ภัยธรรมชาติ วาตภัย อุ ทกภัย อัคคีภัย แผ่นดินไหว ความเสียหายจากสัตว์ แมลง โจรกรรมที่ไม่

เกี่ยวกับความผิดของ “ผู้รับจ้าง” หรือบริวารจากการจราจล เป็นต้น

has been damaged due to defects in the construction under this contract Such as
making a foundation without quality or failing to meet the technical standards, using
substandard materials, not being careful in the construction adequately, wrong
construction etc. "Contractor" must correct the repair To be in the original condition
immediately without additional charges. If the damage is caused by the fault of the
"employer" or from force majeure Such as natural disasters, storms, floods, fires,
earthquakes, animal damage, insects that are not related to the fault of "contractors" or
the family from rioting, etc.

ในการรับประกัน งานถ้ามีส่วนที่ต้องแก้ไข ให้ “ผู้ว่าจ้าง” แจ้งเป็นลายลักษณ์อักษรแก่ “ผู้รับ

จ้าง” หลังจากนั้นภายใน 15 วัน “ผู้รับจ้าง” ต้องทำการแก้ไขงานให้เสร็จสิ้นสมบูรณ์

shall notify in writing to the "contractor" within 15 days. "The contractor" must complete
the work.

9. ในกรณีที่ข้อความปรากฏในสัญญาหรือในเอกสารแนบท้ายของสัญญาเป็นภาษาไทยและภาษาอังกฤษ
ถ้าหากมีกรณี สงสัย และโต้แย้ งกันในความหมายของข้อความนั้นๆ คู่สัญ ญาตกลงกันให้ ใช้ข้อความ
ภาษาไทยในการตีความ

10. หากพบว่าบัญญัติใดๆ ในสัญญานี้ ไม่มีผลผูกพัน หรือไม่สามารถบังคับได้ เช่น เป็นโมฆะ โมฆียะ ไม่

สมบูรณ์ ไม่เป็นธรรมหรือใช้บังคับไม่ได้ประการใดๆ ก็ตาม คู่สัญญาตกลงกันว่า ความไม่สมบูรณ์หรือ
การใช้บังคับไม่ได้ใดๆ ของข้อตกลงดัง กล่าวนั้น จะไม่ส่งผลกระทบไปถึงส่วนอื่นๆ ที่ยังมีความสมบูรณ์
หรือยังใช้บังคับกันได้โดยให้ยังคงมีผลใช้บังคับได้โดยสมบูรณ์เต็มที่ได้ดังเดิมทุกประการ
If found that any provision in this contract is not binding Or cannot be
enforceable, such as voiding, voiding, incomplete, unfair, or not applicable in any way.

11. บรรดาหนังสือเอกสารหรือคำบอกกล่าวใดๆ ของ “ผู้ว่าจ้าง” หรือ ของ “ผู้รับจ้าง” ที่มีไปถึง “ผู้ว่า

จ้าง” หรือ “ผู้รับจ้าง” ตามภูมิลำเนาที่ปรากฏในสัญญานี้ ให้ถือว่า “ผู้ว่าจ้าง” และ “ผู้รับจ้าง” ได้
ทราบข้อความนั้นตลอดแล้ว กรณี “ผู้ว่าจ้าง” หรือ “ผู้รับจ้าง” ได้ย้ายที่อยู่หรือภูมิลำเนานั้น ให้ เป็น
หน้าที่ของ “ผู้ว่าจ้าง” หรือ “ผู้รับจ้าง” ที่จะต้องแจ้งให้แก่อีกฝ่ายทราบเป็นหนังสือภายในกำหนด 7
วัน นับตั้งแต่วันที่ได้ย้ายออก มิฉะนั้นให้ถือว่าบรรดาหนังสือบอกกล่าวหรือเอกสารใดๆ ที่ได้จัดส่งไป
ตามที่อยู่นี้ของ “ผู้ว่าจ้าง” หรือ “ผู้รับจ้าง” ตามสัญญานี้ เป็นการส่งไปโดยชอบด้วยข้อตกลงและ
กฎหมายแล้ว

12. หากผู้รับจ้างทำงานไม่แล้วเสร็จตามสัญญา ผูร้ ับจ้างตกลงให้ผู้ว่าจ้างคิดค่าปรับอัตราร้อยล่ะศูนย์จดุ ศูนย์หนึ่งของราคา

การรับจ้างอาคารโดยปรับเป็นรายวันนับตั้งแต่วันที่ล่วงเลยกำหนดกำหนดระยะเวลาตามสัญญา

การบอกเลิกสัญญาและค่าเสียหาย
Termination of contract and claim for damages
1. ก่อนหรือระหว่างที่ดำเนินการก่อสร้างตามสัญญานี้หากเกิดกรณีใดกรณีหนึ่ง หรือหลายกรณีเช่น ที่จะกล่าว
ดังต่อไปนี้ ผู้ว่าจ้างหรือผู้รับจ้างมีสิทธิ์บอกเลิกสัญญาจ้างก่อสร้างนี้ โดยบอกกล่าวเป็นลายลักษณ์อักษรล่วงหน้าไม่
น้อยกว่า 30 วัน
Before or during construction according to this contract, if any one or more cases occur,
such as the following: The employer or contractor has the right to terminate this construction
contract by giving written notice not less than 30 days in advance.

1.1 ผู้รับจ้างหยุดงานก่อสร้างติดต่อกันเกิน 30 วันหรือละทิ้งงานโดยไม่มีเหตุผลสมควรและ ผู้ว่าจ้างมีสิทธิ์เรียก

เงินที่ผู้ว่าจ้างได้ชำระไปแล้วในงวดงานที่ผู้รับจ้างยังไม่กำเนิดการร่วมถึงค่าเสียหายอื่นๆ
The contractor stops construction work for more than 3 0 consecutive days or abandons
work without reasonable cause and the employer has the right to demand money that the
employer has already paid for the period of work that the contractor has not yet started, including
other damages.

1.2 ผู้ว่าจ้างผิดสัญญาไม่ชำระงวดใดงวดหนึ่งเกินระยะเวลา 30 วันนับจากวันส่งงวดงาน

The employer breaches the contract by not paying any installment more than 30 days from
the date of sending the work installment.
1.3 เมื่อผู้ว่าจ้างได้บอกเลิกสัญญาแล้วตามข้อ 1 .1 หรือ 1.2 แล้วมีสิทธิ์เรียกร้องค่าเสียหายจากผู้ว่าจ้างได้
When the employer has terminated the contract according to Section 1.1 or 1.2 then has the
right to claim damages from the employer.

2. เมื่อผู้รับจ้างบอกเลิกสัญญาตามข้อ 1.3 แล้ว และมีสิทธิ์เรียกร้องค่าเสียหายจากผู้ว่าจ้างได้โดยทรัพย์สิน

อุปกรณ์เครื่องมือต่างๆที่ผู้รับจ้างดำเนินการก่อสร้างไปแล้วจะเสร็จสิ้นตามแบบหรือไม่ก็ตาม ผู้ว่าจ้างยินยอมให้ตก
เป็นกรรมสิทธิ์ของผู้รับจ้างทั้งหมด ( ยกเว้นในส่วนที่ผู้ว่าจ้างชำระเงินแล้ว)
After the contractor terminates the contract according to Section 1 .3 and has the right to
claim damages from the employer through property. The various equipment and tools that the
contractor has already constructed will be completed according to the design or not. The
employer agrees that it shall become the property of the entire contractor (except for the part
that the employer has already paid).agrees that it will become the property of the entire
contractor (except for the part that the employer has already paid).
