SUBJECT OF INVESTIGATION: Rule A3: Compliance with Directives

ALLEGATION(S):

1. That between Thursday, January 7, 2021 and Friday, January 8, 2021, Officer -
violated USCP Directive 2053.013, Rules of Conduct, when he allegedly used a
USCP logo as his Facebook profile picture and shared concerning Facebook posts.

BACKGROUND:

On Monday, January 11, 2021, an Anonymous Complainant 1 (AC) sent the following email to
the Office of Professional Responsibility (OPR) [Exhibit I]:

"Dear Sir/Madam:

I am writing today regarding some recent concerns I have about one ofyour officers,
in light of the events at the Capitol 011 Janua,y 61".

Please understand I do so with a very heavy heart. I knew Officer from my


youth and my memories ofhim- from Little League to CCD classes to high school lunch
periods- were always ve1y positive. - (as I knew him) was a good, solid friendly guy
and always a pleasure to be around. Naturally, years later I decided to friend him on

Facebook. While his posts did not regularly come up on my feed, following the attack on
the Capitol and having learned about the tragic death of one of the USCP officers and

knowing that Officer • • • worked at the Capitol I wanted to check on his feed for
his own well-being.

ThanJ..fully, I learned that Officer was not the deceased officer in question.
And I noticed that on his page he had posted several tributes to the fallen officer.
However, upon seeing other posts on /tis page, I became rather concerned of what
appeared to be disturbing mixed signals on his part.

Please note I am aware that Officer's politics leaned conservative. And that
in and of itself obviously plays no role into his fitness for duty in the Capitol. Having
political opinions in one direction or another is only human and natural.

However, the message from the riots in the Capitol was one of insurrection against the
institutions ofgovernment and democracy in this counhy. And looking over the posts

from Officer - • • since Janua,y 6th , I have a hard time reconciling tributes to a
colleague murdered by this anti-democratic mob on one hand, and messages that appear
to be in sympathy and support of those involved in such a murder on the other hand.

For example, on Janua,y 8th Officer shared a post from a group called
"Deputy Matt & Others Who Serve " that contains the message, "Do you want a civil
war? Because this is /tow you start a civil war ... " accompanied by a list ofseveral gun
control bills introduced by the House ofRepresentatives. Officer •-•• himself
added the comment, "Prepare yourselffor your bs. "

I am attaching a screen shot of this along with a couple of other posts from Officer
that appears to echo viewpoints in sympathy with the persons who attacked
the U.S. Capitol.
Please note I am not accusing Officer ofbeing a co-conspirator in these
attacks. Nor am I advocating for Officer •-•• to lose his job. I am simply bringing
these to your attention, and if it is deemed to be problematic you can proceed accordingly
in whatever fashion your office typically utilizes.

I do /mow that there have been reports that a small minority of USCP officers had been
seen acting in an incongruously friendly manner towards the rioters, even posing for
pictures. I have no evidence that Officer • • • • was one of these officers; I do not
even know if he was on duty at the time oftlte attack. However, the exceptional brave,y
exhibited by the vast majority of USCP Officers who had been on duty that day as well as
the tragic sacrifice of two of the USCP Officers relating to these events should not in
danger of being corrupted or compromised by messages that might threaten the safety
and well-being of the institutions and individuals those officers are sworn to protect.

A review of the screenshots attached to A C's email revealed the following:

• used a USCP logo with a mourning band as his Facebook profile picture .

• On Thursday, January 7, 2021 at 12:33 hours, shared a picture of a t-shirt


with the word "fraud."

• On Thursday, January 7, 2021 at 13:13 hours, shared a post/picture from


hat said, "Some Americans will never appreciate America, until after
they have helped destroy it, and have then begun to suffer the consequences.
commented, "Here 's to the next four years. "

• On Friday, January 8, 202 l at l 0: 17 hours, shared a post/picture from


Deputy Matt and Others Who Serve. The post from Deputy Matt stated, "Do you
want a civil war? Because this is how you start a civil war ... "The picture contained a
series of proposed U.S. House of Representatives bills related to firearm regulation.
commented on the shared post/picture, "Prepare yourselffor this bs. "

On Thursday, January 14, 2021, this case was assigned to Sergeant Jeremy Krzyzanowicz (OPR)
for investigation.

DISCUSSION:

Department Policy, USCP Directive 2053.013, Rule A3 states the following [Exhibit 2]:
"Employees are required to obey all Departmental rules, regulations, Directives, orders,
policies and procedures. La11ful orders from a supervisor, including orders relayed from
a supervisor by an employee of equal or lesser rank, will be obeyed promptly"
Department Policy, USCP Directive 2053.019 states in part the fo11owing [Exhibit 3]:
"Sworn and civilian employees are free to express themselves as private citizens on
social media sites on non-Government equipment and when offduty. Wiren doing so,
Department employees are expected to maintain an exempla,y standard ofpersonal
integrity and the highest standards ofprofessional conduct in their private lives and their
official capacities "

"Wiren using social media sites, whether on or off duty, employees must be mindful and
adhere to the USCP Police Directives, 'Rules of Conduct ' and 'Ethics Policy, ' and other
applicable Policy Directives. Employees must not engage in any conduct that constitutes
neglect of duty, conduct unbecoming, discrimination and/or harassment, improper
remarks, or any other act that is likely to adversely affect the discipline, good order, or
reputation of the Department or any of its employees. "

For the purpose of testimonials employees are prohibitedfi·om displaying Department


logos, uniforms, or similar identifying items on personal Web pages. "
On Monday, January 18, 2021, AC was interviewed telephonically [Exhibit 4].

AC stated that he was previously aware that was a member of the USCP from
viewing his Facebook profile. According to AC, he became concerned with some of
Facebook posts, following the insurrection at the US Capitol on Wednesday,
January 6, 2021. One post of particular concern was posted on Friday, January 8, 2021 at 10:17
hours, which mentioned starting a civil war. AC did not have any additional posts of concern that
he wished to share with the OPR.

On Wednesday, January 27, 2021, Officer was interviewed and provided


a written statement [Exhibit 6 and Exhibit 7].

• In reference to the post from Thursday, January 7, 2021 at 12:33 hours of at-shirt

looking shirt. "

• In reference to the post from Thursday, January 7, 2021 at 13:13 hours, where
shared a post/picture from Thomas Sowell that said, "Some Americans
will never appreciate America, until after they have helped destroy it, and have then
begun to stiffer the consequences.

• In reference to the post from Friday, January 8, 2021 at 10: 17 hours, where
shared a post/picture from Deputy Matt and Others Who Serve, which
showed a picture that contained a series of proposed U.S. House of Representatives
bills related to firearm regulation and Deputy Matt stated, "Do you want a civil war?
Because this is how you start a civil war ... "

sustained at the U.S. Capitol on Wednesday, January 6, 2021.

denied being a part of, supporting, or assisting any group that attacked the U.S.

Capitol on Wednesday, January 6, 2021. • • • also denied being any part of or supporting
any group wishing to do harm to any Members of Congress.

At the conclusion of the interview, provided the following written statement:

"/ was asked about several facebook posts, only one of which I made in the time shown. I
had a department logo as my facebook - picture in memo,y of Ofc Sicknick during
one post I was asked about. The dept. logo was up for approx. 7 days, starting on
Janua,y 7'1', after which it was reverted back to my primary picture. The posts were
informative in nature and not in my own words. I do not belong to any group that
participated in the riots on the 6th• I do not belong to any group that intends harm upon
the U.S."

CONCLUSION(S)

I. The allegation that Officer violated USCP Directive 2053.013,


Rules of Conduct, Category A: Duty to Obey, Rule A3: Compliance with Directives, is
classified as SUSTAINED.
The investigation revealed that between Thursday, January 7, 2021 and Thursday, January 14,

2021, • • • displayed the USCP logo as his Facebook profile picture and shared posts that
AC considered concerning.

• The USCP logo was visible as Facebook profile picture in three posts sent
to the OPR by AC.

• admitted in his interview with the OPR that he displayed the USCP logo as
his profile picture to honor fallen USCP Officer Brian Sicknick from Thursday, January
7, 202 I to Thursday, January 14, 2021.

• A review of Facebook posts show one concerning post that


shared where there is a comment by Deputy Matt stating, "Do you want a civil war?
Because this is how you start a civil war ... " The post also shared a picture of a series of
proposed U.S. House of Representatives Resolutions related to firearm regulation.
commented on his shared post, "Prepare yourselffor this bs. "

o When asked to explain why he shared this post stated, "It's just a
passing on ofpossible HR 's that could be passed into law. "

o • • • stated that he was not part of and did not support any group that
attacked the U.S. Capitol on Wednesday, January 6, 2021.

wished to do harm to any Member of Congress.

concerning in nature.

This is to advise you that you are being interviewed as part of an internal
administrative investigation into alleged misconduct. You will be asked questions
specifically, directly, and narrowly related to the performance of your official duties or your
fitness for duty. Bargaining Unit officers who reasonably believe that this examination or
investigation may result in disciplinary action may request Union representation.

You are compelled to truthfully and fully answer all questions posed by a supervisor of
the United States Capitol Police (USCP) relative to official Department business and/or
pertaining to your official duties or fitness for duty (USCP Operational Directive PRF 1.3,
Rules of Conduct, Category A: Duty to Obey; Rule A3: Compliance with Directives; Rule
A6: Insubordination; and Rule A7: Truthfulness). If you refuse to answer, you will be
subject to disciplinary action which could result in the termination of your employment. If
you do answer, neither your statements, nor any information or evidence which is gained by
reason of such statements, can be used against you in any subsequent criminal proceeding;
however, such statements may be used against you in relation to subsequent Departmental
disciplinary action(s). (see Garrity v. New Jersey, 385 US 493 (1967)).

I, Officer have been advised that I am required to provide a truthful statement


regarding an official investigation. I make this statement to Sergeant Krzyzanowicz, who
has identified herself as conducting an official investigation.

I was asked about several facebook posts, only one of which I made in the time shown. I
had a department logo as my facebook profile picture in memory of Ofc Sicknick during
one post I was asked about. The dept. logo was up for approx. 7 days, starting on January
7th , after which it reverted back to my primary picture. The posts were informative in
nature and not my own words. I do not belong to any group that participated in the riots
on the 6th • I do not belong to any group that intends harm upon the US.
