MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement is made and entered into by and between:


BIG HOTEL, with business address at 178 M.J Cuenco Avenue, Cebu City herein
represented by its HR Manager, Desilee Nares.
ST. MARY’S COLLEGE OF CATBALOGAN, an educational institution duly
organized and existing under the laws of the Philippines, with its address Del
Rosario St. Catbalogan City, Samar herein represented by its President, S. Ma.
Adelaida C. Huiso, RVM, who is duly authorized to represent it in this transaction,
herein referred to as SCHOOL.

That

The school selected ANTHONY JOSEPH THOMAS M. COBRIROS the


implementation of the ON-THE-JOB TRAINING of the students.

NOW THEREFORE, for and in consideration of the foregoing premises, the HOTEL
AND SCHOOL, do hereby agree and stipulate the following.

A. The HOTEL shall:


a. Assign Personnel Coordinator who will coordinate with HOTEL of any
activities under this program.
b. Accomplish the necessary forms required by the SCHOOL on connection
with the implementation of the program.
c. Issue certificates of completion upon finishing this program and
d. Adopt and enforce rules that will govern the conduct of the program. Said
rules shall be made known to the SCHOOL and the students before the
start of the program.
B. The SCHOOL shall:
a. Designate a Practicum Coordinator who will coordinate with HOTEL of any
activities under this program.
b. Together with students concerned, renounce and waived any claim against
the HOTEL for any injury the students may sustain or loss that they may
suffer, personal or pecuniary in the performance of their duties and
functions.
c. Hold the HOTEL free from any claims or suit and shall forever defend the
HOTEL from any such claims in connection with this Agreement.
C. The HOTEL and SCHOOL further agree that:
a) It is expressly understood that there will be no employer-employee
relationship between the HOTEL, and the students of the SCHOOL;
b) The students will be personally responsible for any and all of the
liabilities for damage to property or injury to third person, which may be
occasioned by their intentional or negligent acts while in the course of
their training;
c) The students shall abide with the HOTEL’S rules and regulations and
comply with those imposed for the training;
d) The Management of the HOTEL reserves the right to discontinue the
program upon prior written notice to SCHOOL and Vice-Versa.
D. Duration
This agreement shall take effect immediately upon signing hereof and shall
continue to be in force and effect until such time that any one of the parties
withdraws from this Agreement.
