JUDICIAL AFFIDAVIT of

JERWIL CASUMPA

The following is the Judicial affidavit of JERWIL


CASUMPA, of legal age, single, Filipino citizen, and a
resident of 175-B, Ayala, Zamboanga City. The
examination of the witnesses is conducted by ATTY.
CAZIMIR WOLFE PAMARAN in his office address at 888-A
Watitiw street, Ayala, Zamboanga City. The witness shall
be testifying in English language, which he speaks and
understand; and that he will be answering the questions
asked of him, fully conscious that he does so under oath,
and that she may face criminal liability for false testimony
and perjury.

ATTY. PAMARAN: Please state your name, age,


status, address and occupation.

JERWIL CASUMPA: I am JERWIL CASUMPA, of legal


age, single, Filipino citizen, and a resident of 175-B, Ayala,
Zamboanga city and a businessman.

Purposes: To prove the fact that he has nothing to do


with the allegation of rape to which he was identified as
the perpetrator. He will also identify the documents
mentioned herein and to testify on other matters relevant
to the instant case.

Q1: Do you swear to tell the truth, the whole truth,


and nothing but the truth, so help you God?
A1: Yes, Sir. I swear that I will tell the truth, the
whole truth, and nothing but the truth, so help me God.

Q2: Are you going to answer the questions asked of


you, fully conscious that do so under oath, and that you
may face criminal liability for false testimony or perjury?

A2: Yes, Sir.

Q3: Why are you present here today?

A3: I am here today to give a sworn statement by


way of a Judicial Affidavit, the same to constitute as my
direct testimony, in the above captioned case.
Q4: Are you the same Accused Jerwil Casumpa, in
the above-entitled case?

A4: Yes, Sir.

Q5: As you have mentioned you are a businessman,


correct? And what kind of business that you are engage
with?

A5: Yes sir. I am not only a businessman but also a


farmer. My source of income comes from taking care of
fifty carabaos and I created a business by selling carabao
milk. I have been doing the carabao milk business for Ten
years.

Q6: In your business, how many employees do you


have?

A6: None. I manage my business alone.

Q7: Can you explain on how do you manage fifty


carabaos and also have a time to deliver the milk to your
customers?

A7: It is not an easy task but I manage the business


by following a strict and regimented schedule. Early in the
morning at 5am, I tend the carabao herd and collect their
milk. Then I start the delivery of the collected milk to my
customers at 7am to 12am, and after delivery, then at
12noon I take my lunch thereafter I go back to the farm
and spend the rest of my day at the farm preparing for the
next day collection and delivery of milk.

Q8: Usually in a day, how many customers do you


have?

A8: Four deliveries Sir. These are my regular


customers and it also depends on the production of milk in
the day.

Q9: What do you mean, when you say regular


customers?

A9: These are sure buyers, who regularly buy


carabao milk from me. These are the customers that I
trust and I also offer a loan of my carabao milk to the
regular customers, where the payment is collected at the
end of the month depending on their milk orders. Carabao
milk first then pay later policy to my regular customers.

Q10: Can you explain on how do you manage the


deliveries of the carabao milk to your costumers?

A10: I follow a tight schedule of the delivery to my


regular customers. I Usually travel a two-hour drive to
Don Pepot residence arriving at 9am thereafter a 30
minutes travel to Doña Pepita residence and arriving at
9:30am then a 30 minutes travel to Doña Maria residence
and arriving at 10am and lastly Thirty minutes travel to
the Fajardo Residence arriving at 10:30am and from there
I deliver the remaining time to the other customer before
taking lunch at twelve noon.

Q11: Why do you keep track of the time of your


travel from one customer to the other?

A11: In my ten years of experience in delivery, I find


it as a good business practice habit to keep track of the
travel time as to monitor the vehicles mileage so that I
can schedule the vehicle maintenance based on the km
reading and also to record the estimated time of arrival
and departure from one customer to the other. It helps
me to plan the efficient and fastest route from one
customer to the other customer.

Q12: Do you know of a certain Mary Jane Fajardo?

A12: Yes Sir. She is one of my regular customers. I


usually delivery the carabao milk at their residence at
10:30am.

Q13: Since Mary Jane Fajardo was a regular


customer, Does she have a loan of carabao milk from you?

A13: Yes Sir.

Q14: What evidence can you show to prove that fact


that Mary Jane Fajardo has a loan from you?

A14: I happen to keep a record on a notebook of the


milk order from my regular customers. I list their milk
orders in a day then after delivery, I let them signed the
record.
Q15: If you will be shown a notebook of the milk
order, will you be able to identify it?

A15: Yes Sir

Q16: I am showing you the notebook of the


customers milk order? Is this the one you are referring to?

A16: Yes Sir. That is my notebook of the customers


milk orders.

Q17: In the notebook of the milk order of your


regular customers, how much debt does Mary Jane
Fajardo have?

A17: Base on the record in my notebook of the milk


orders of the regular customers, Mary Jane Fajardo
accumulated a total of Fifty Thousand Pesos Debt.

Q18: Have you demanded Mary Jane Fajardo to pay


her fifty Thousand Pesos obligation?

A18: Yes sir.

Q19: When did you demand the payment?

A19: It was on May 31, 2022. I informed her verbally


the debt that she owes me.

Q20: After demanding then what happens next?

A20: She promise me that she will pay it on June 6,


2022 and she told me to come at 10:30am.

Q21: What happen on June 6, 2022?

A21: I came to the Fajardo’s residence as agreed to


collect the money that she owes me as payment for her
debt. Unfortunately, she did not have the money at that
time. So, I left the residence.

Q22: Was there a delivery of carabao milk to the


Fajardo’s residence at that time?

A22: No Sir.
Q23: When you left the premises of the Fajardo’s
residence, did you observe anything unusual?

A23: Nothing unusual sir.

Q24: Do you know of a person named Sharlene Fair


Sumalpong?

A24: Yes sir, she is the neighbor of Mary Jane


Fajardo.

Q26: Is Sharlene also a customer?

A26: No sir.

Q27: Do you know that Mary Jane Fajardo has an


accusation that you rape her?

A27: Yes sir. I did not receive any subpoena or


complaint from the barangay. I only came to know this
information that I have been accused of rape from Alex
Delos Reyes.

Q28: Who is this Alex Delos Reyes that you have


mentioned?

A28: Alex Delos Reyes is also a customer who is a


teacher. He was the one who warned me that the police
are looking for me.

Atty. Pamaran. That is all as of now.
