Dear Bruno,

The Engineer is in receipt of the Contractor’s letter reference ASJ-AS-AAH-LTR-011133-IFO dated 5 th

October, alleging that the Engineer is providing inaccurate information to obscure the design concerns
raised by the AADC pertaining to the AMF system and Generator Room layout and responds, accordingly.

The Engineer finds the tone and the contents of the Contractor’s aforementioned letter, generic, baseless,
and lacking in technical substantiation from the Contractor to the Engineer’s comments raised in the
Engineer’s original letter reference AAH-ASJ-LTR-09820-RR dated 18th August 2023 and reiterated the
same in the Engineer’s letters referenced AAH-ASJ-LTR-09741-RR dated 25th July 2023 and AAH-ASJ-
LTR-9953-RR dated 28th September 2023.

It is vividly evident that the sole aim of the aforementioned Contractor’s letter in response to the Engineer’s
letter reference AAH-ASJ-LTR-9953-RR dated 28th September 2023, is to maintain the Contractor’s key
performance indicators (KPI).

To this end, the Contractor has adopted an inept methodology, to reiterate its response to the Engineer’s
technical substantiations. In doing so, the Contractor has completed disregarded the Engineer’s technical
substantiation, which is an egregious delineation of the Contractor’s approach towards the fulfilment of its
contractual obligations and completion of the Auto Mains Failure (AMF) system for this project.

Please refer to the below extract from the Contractor’s aforementioned as an example.

August 2023, which is based AMF Factory Acceptance Test (FAT) in France dated 21st November 2022 up
to 25th November 2022.

• Extract of the Contractor’s original response via its letter reference ASJ-AS-AAH-LTR-011175-IFO dated
29th August 2023

• Extract of the Engineer’s substantiation to the Contractor’s response via the Engineers letter
reference AAH-ASJ-LTR-9953-RR dated 28th September 2023.

• Extract of the Contractor’s response to the Engineer’s substantiation via the Contractor letter reference
ASJ-AS-AAH-LTR-011333-IFO dated 5th October 2023, which is a futile repetition of its previous
response.

Furthermore, the Engineer have vividly stated and evidently proved that the Contractor is solely responsible
for the design and implementation of the AMF system, within its previous letter reference AAH-ASJ-LTR-
9953-RR dated 28th September 2023. Please find below extract of the same.

In light of the above, the Engineer encourages the Contractor to develop a positive approach towards the
fulfilment of this fundamental requirement of the AMF system and reiterates its previous formal instruction,
to immediately proceed with the Normal Sequence of operation as per the Engineer’s and AADC
comments, without any further delay.

Any further procrastination on the subject, will be deemed as the Contractor’s deliberate attempt to refuse to
undertake its contractual obligation, therefore, will be dealt with the Conditions of the Contract, accordingly.
