Dear Bruno,

The Engineer is in receipt of the Contractor’s letter reference ASJ-AS-AAH-LTR-011304-IFO dated 26 th


September 2023, stating the Engineer’s response within its previous letter referenced AAH-ASJ-LTR-
09904-RR dated 8th September 2023 is unsatisfactory and unacceptable to the Contractor, and responds
accordingly.

First and foremost, the Contractor’s letter reference ASJ-AAH-LTR-018880-IFO dated 19th November 2015,
(quoted within the Contractor’s said letter reference ASJ-RS-AAH-LTR-011304-IFO dated 26 th September
2023) is incorrect. The correct letter reference is ASJ-AAH-LTR-01880-IFO dated 19th November 2015.

The Engineer’s acknowledges the Contractor’s position in the subject matter; however, it does not accord
with the Engineer assessment based on the Contract specification which are comprehensively compelling,
and stated vividly and unequivocally within the Engineer’s previous letters referenced above.

The Contractor’s statements that “The Contractor proposed a DC system design in line with ADWEA
specifications, as mutually agreed upon with Engineering” and “As for the Engineering team’s comments on
the DC system design under the contractor’s scope, these are not acceptable” are self-contradicting
statements, as it is deemed that the Contractor is well aware of its contractual obligations under the Main
Works contract, sub-clause 3.1, point no.C, that, Any approval by the Engineer shall not relieve the
Contractor from any responsibility he has under the Contract, including the responsibility for errors,
omissions, discrepancies and non-compliances. Please find below excerpt for the same. The same is
emphasized within the Engineer’s previous letter reference AAH-ASJ-LTR-09904-RR dated 8 th September
2023.

Moreover, as vividly expressed and evidently highlighted within the Engineer’s previous letter reference
AAH-ASJ-LTR-09904-RR dated 8th September 2023, that the Contractor had complied with the Contract
specification section 261319, sub-section 2.8, point no. B, whereby the standby power period (48V NiCd
batteries) should be provided for ALL CONNECTED CIRCUIT BREAKERS (extract below).

However, all the circuit breakers were not included within the Contractor’s calculations for sizing the 48V DC
system batteries.

In light of the above, the Contarctor’s below statements, does not justify the fundamental error on the
Contarctor’s part, which is failure to provdie the 48V NiCd batteries power supply for all connected circuit
breakers, rather the Contractor, on its own accord, chose to provide the battery power supply for only fifteen
(15) circuit breakers, accordingly these statements from the Contractor are extraneous and rejected
outright.

• “ The Contractor proposed a design for the HV system that aligned with approved materials and battery
calculations. However, Engineering made changes to the propsoed design without due consideration for the
system’s components”

• This is evident in the Contractor’s resposne to Engineering comments in DSF-2911, revision 06, comment
no.6. The delay between breaker operations, which could not be demonstrated in the SOP but would be
reflcted in the software program during FAT, was altered and removed per Engineering and AADC
instructions, without regard for the DC system battery calculations as clearly outlined in MSF-0521, Revision
01.”

• “This document specifically accounted for 15 breakers that could be operated simultaneously.”

• Nonetheless , the approved AMF SOP designed by Engineering and AADC situplated the operation of 27
breakers simultaneously, an increase of 90% over the orignially designed DC system.”

The Contrctor has exacerbated its own position by quoting the Engineer’s letter reference AAH-AADC-LTR-
4818-DM dated 17th December 2018 as the aforementioned Engineer’s letter appends the meeting minutes
for the Auto Mains Failure (AMF) panel specification and design, held between AADC, Employer, Project
Manager, Project Consultant and the Project Contractor dated 7 th August 2018, whereby the AADC have
vividly and unequivocally confirmed that “All AADC previous requriements for AMF panel control over the
last 2 years ar part of the specification 263200….. ISMS (Integrated Station Monitoring Control) mean both
SCADA and AMF system.” Please refer to the belwo excerpt for the same.

Moreover,the aforementioend AADC statements, which infact were agreed by all the parites (which include
the Contractor) are officially confirmed by the AADC via its letter reference AADC/EOMD/PDD/18/1546
dated 13th August 2018, which is officially conveyed to the Contractor via the Engineer’s letter reference
AAH-ASJ-LTR-04391-DM dated 19th August 2018 (copy attached).

Please refer to the below excerpt of the same.

In light of the above, the Contractor’s statement that “the Engineering continues to conflate the matter and
references the IFC, which has undergone changes in line with ADWEA specifcations, introducing an AMF
control panel separte from the SCADA, consequently, the DGU and AMF require a 24V Vdc supply,
whereas the Switching station and SCADA necesditate a 48Vdc supply” is a blantant disinformation and
rejected outright.

The Contractor’s action of adhoc arrangements of the exisiting 48V DC Chargers outgiong distribution
circuits to suit the ongoing AMF site testings does not provide a permanent remedial solution, morever, in
doing so, the ‘48V DC alarm’ and ‘Trip Coil supervision Relay operated’ alarm consistanlty persisted within
the AMF system site testing sessions, accordingly the Contractor’s adhoc arrangements cannot be
employed for permanent connections.

Based on the above and Engineer’s referenced letters , the Engineer has provided an exhaustive
documented references based on the Contract specifications, to eividently ascertain and conclusively affrim
that the desgin of the Emergency Power Plant system which entails the Auxiliary systems (48V DC Charger
system) and the AMF system is soley the Contractor’s scope, wtihout any contractual obligations on the
Engineer’s part, whatsoever.

It is vividly evident from the above, that the Contractor’s design to feed the auxiliary DC power supply for
fiften (15) circuit breakers of 11kV Swtiching Station (MT-0102) from the 48V DC system battery does not
adequately suffice the AMF system operation based on the approved Sequence of Operation (SOP), which
is also designed by the Contractor.

Accordingly, the Engineer empahsizes the Contractor to be cognizant of its contractual obligations and
reiterates its instrcution to immediately proceed with the rectification of its error and submit remedial action
plan, ensuring smooth and successful testing of the AMF systems.
