(12). Uncontrolled fugitive emission has been observed during the visit.
(13). Control measures needs to be strengthened at Coal handling plant.
(14). Though the CAT Plan have been prepared, the action plan referred therein the CAT
Plan have not been effectively implemented so far. Further, it has been observed from
the copy of the CAT plan report made available during visit that the said report does
not bear any signature and year of the report.
(15). Implementation status of riverine / riparian ecosystem conservation and management
plan in consultation with the irrigation / water resource department in the State
Government have not been made available.
(16). The condition f(iv) of the EC dated 23/8/2023 regarding use of Fly ash for external
dump of overburden, backfilling or stowing of mine has not been complied with. If the
condition is not applicable, PA should get amended the EC condition.
(17). PA has not clarified the entire commitments made during the public hearing held on
20/8/2002 and 22/8/2008 and its implementation status. Further, though the part of
the R&R is already implemented, PA has not made available any valid documental
proof regarding R&R activities projected with total number of land oustees/ Project
Affected People/ Project Displaced People and present status of implementation along
with final awards passed by the of District Collector and implementation schedule of
remaining R&R activities with time frame i.e. well within the balance life of the mine.
(18). Though the PA submitting six monthly compliance report to the sub-Office of MoEF&CC
at Raipur, the status of compliance for each of the ten ECs conditions accorded to the
project have not been submitted regularly.
(19). PA has not obtained Public Liability Insurance under Public Liability Insurance Act,
1991. PA claimed that the condition is not applicable for them on account of the
Notification S.O.227(E) dated 24/3/1992. It was informed to the PA that in the
absence of amendment in the said EC condition, PA bound to effectively comply with
all the stipulated conditions contained in the ECs.
(20). Condition No.(ii) of EC letter dated 10/5/2021 regarding compliance of
existing/previous ECs and non-compliance condition have not been complied with as
stipulated by October, 2021.
(21). The mitigation measures proposed during the EAC meeting for reduction of air
pollution have not been effectively complied as committed by June, 2021.
(22). Road transportation of Coal has not been avoided within one year from date of issue of
EC as stipulated.
(23). Silos (no. 5 & 6 capacity 30MTY) with Rapid Load Out System (Capacity-20 MTY) have
not been constructed within one year from the date of issue of EC.
(24). PA has not planted additional 200 Ha of Sal trees.
(25). Part of the Wind breaker/ shield arrangement constructed along the railway siding is in
broken condition.
(26). Compensation of the land acquired for the project have not been settled within one
year as per R&R Policy.
(27). Additional condition No.(iii) of the EC letter dated 04/6/2020 have not been effectively
complied with.
(28). PA is requested to furnish the Production details issued from the Geology and Mining
Department to ascertain the production achieved by the PA during the past seven
years. PA assured to furnish the same.
(29). Environmental laboratory has not been established with adequate number and type of
pollution monitoring and analysis equipment in consultation with the State Pollution
Control Board rather environmental monitoring is being carried out through Central
Mine Planning and Design Institute Limited (CMPDI), Regional Institute-V.

(30). Peripheral fencing has not been made along the excavated area as stipulated.
(31). Still partly Road Transport of Coal is being continued.
(32). During the visit it has been observed few vehicles are transported coal by road without
covering with tarpaulin.

In view of the above, PA is requested to take appropriate corrective action on the observed non-
compliances and effectively comply with all the stipulated conditions contained in the ECs for the
above project and action taken report may be submitted to the MoEF&CC, New Delhi, endorsing
a copy to this Office.

6. Salient features:
a Present status of the project : Total lease area of the project is
4184.486 Ha. Out of which 1016.412 Ha
is forest land, 647.503 Ha is Govt. land
and 2520.571 Ha is tenancy land. Total
mineable/extractable reserve (within
4184.486 Ha.) as on 01/04/2023 is
265.724 MT. The average coal grade is
G10, G-11, G-13 and G-14. The average
gradient is 1 in 6 to 1 in 12. The coal
production is by Shovel-dumper mining
system, which is envisaged for
overburden removal and coal extraction is
being done through surface miner.
Reportedly project activity for this Mine
was commenced on 09.01.1981.
However, date of commencements for the
expanded capacity have not been made
available. Requisite approval for diversion
of 1016.412 Ha. forest land have been
obtained from the MoEF&CC under Forest
(Conservation) Act, 1980. Legal actions
initiated against the Project Authority for
the violations committed in the past is still
pending disposal of the Hon’ble Courts.

As informed by the Project Authority, the Gevra Opencast Coal Mine Project was initially
commenced on 09/01/1981 with the consented capacity of 10 MTPA. Ministry of Environment,
Forest & Climate Change accorded environmental clearance (EC) for the Gevra Opencast Coal
Mine Project and its expansion / capacity enhancement in various occasions, subject to
implementation of the conditions and safeguards contained therein the ECs. The Environmental
clearances (ECs), amendments, additional conditions imposed and validity extensions of the EC
accorded by the MoEF&CC is chronologically furnished as under:
It has been observed inconsistency in the condition accorded in multiple ECs of the
above project, wherein the EC letter dated 21/02/2018 supersedes the EC granted
vide letter No.J-11015/85/2010.IA.II(M) dated 31/01/2014, followed by
amendment in the EC dated 6/02/2015. However, in the EC letter dated 06/9/2022
and 23/8/2023, it has been stipulated that all other terms and conditions as
prescribed in Ministry’s letter dated 03/6/2009, 31/01/2014, 06/02/2015,
21/02/2018 & 10/05/2021 and letter dated 03/6/2009, 06/02/2015, 21/02/2018,
10/5/2021 & 05/9/2022 shall remain the same and need to be complied by Project
Proponent. Further, the EC letter dated 04/10/2004 neither expressly superseded
nor referred in the subsequent ECs. PA neither took any corrective action from the
Ministry on the observed inconsistency nor submitted six monthly compliance report
for all the ten ECs accorded.
2. MoEF&CC accorded approval for Stage-II forestry clearance in favour of M/s SECL for
diversion of 1016.412 Ha of forest land in Katghora Forest Range, District Korba of Chhattisgarh,
subject to the fulfilment of the conditions referred therein the following forestry clearances:
(i). 100.898 Ha. Forest land diverted vide letter No. 8-33/2005-FC dated 05/05/2008 of
MoEF&CC.

(ii). 46.198 Ha. Forest land diverted vide letter No.8–81/2006–FC dated 20/04/2015 of
MoEF&CC.
(iii). 564.855 Ha. Forest land diverted vide letter No.8–77/2006-FC dated 20/04/2015 of
MoEF&CC.
(iv). 192.046 Ha. Forest land diverted vide letter No.8–79/2006–FC dated 20/04/2015 of
MoEF&CC.
(v). 112.385Ha. Forest land diverted vide letter No.8-41/2017-FC dated 21/6/2022 of
MoEF&CC.
PA informed that Compensatory Afforestation have been carried-out through Chhattisgarh State
Forest Department in twice the area of the Forest land diverted and requisite payment have
been reportedly deposited in the State CAMPA fund based on the demand note issued by the
State Forest Department, Govt. of Chhattisgarh. However, supporting documents are not
made available regarding the demand note raised by the Forest Department and the
fund deposited so far, Physical and financial status of Compensatory Afforestation
implemented along with supporting KML file and Utilization certificate.
3. Total Mine Lease area of the Project is 4184.486 Ha., which comprises of Forest Land
(1016.412 Ha.), Govt. land (647.503 Ha.) and Tenancy land (2520.571 Ha.). Reportedly Mine
Lease was obtained under Coal Bearing Areas (Acquisition and Development) Act, 1957. Mining
Plan along with Mine closure plan for 52.50 MTPA was approved by CoFDs on 03rd August, 2022
in its 132nd meeting. Mining operation is fully mechanized opencast with formation of benches
by drilling and blasting, Surface Miner and shovel dumper combination. Reportedly blasting
operation is being carried out in day time between the shift change and in this regard project
authority has obtained Licence from the PESO vide Licence No. E/HQ/CG/22/44E764 for
Possession for use of explosives from Magazine, which is valid till 31/3/2024.
4. As informed average water requirement of the project is around 7000 KLD, which is
being met from Mine water and for domestic water requirement is 2400 KLD, which is being met
from the Hasdeo Right Bank Cannal. Validity of NOC obtained from the Central Ground Water
Authority vide NOC No. CGWA/NOC/MIN/ORIG/2018/4474 dated 22/01/2019 for abstraction of
11487 m3/day ground water has already expired. PA has submitted their application on
02/12/2020 through online for renewal of NOC for abstraction of ground water. However, PA
has not obtained requisite NOC for drawal of ground water. PA is having agreement on
17/02/2011 with Chhattisgarh State Water Resources Department for drawal of surface water
105000 m3 per month from the Hasdeo Right Bank Cannal. However, Permission/NOC for
the surface water allocation obtained from the Water Resources Department, Govt.
of Chhattisgarh have not been made available. As informed, for this project no ground
water is drawn through bore wells. Mining has already intersected the ground water table.

Reportedly, balance life of the Mine is 5 years @ 52.5 MTPA. PA has commissioned ETP having
the capacity of 210KLD and is in operation. The sewage treatment plant having the capacity of
3 MLD has already commissioned and is in operation. Treated water from the STP is being used
for greenbelt development.
5. Reportedly broken-up area is around 1800 Ha and mining is being continued in single pit
with an average working depth of around 200m. There are 8 internal O.B. dumps and 7 external
O.B. dumps are present. As informed area backfilled is 936.362 Ha and plantation taken up in an
area of 137.6 Ha through State Forest Department. So far technically reclaimed area is around
1319 Ha and 504 Ha has been biologically reclaimed. PA has prepared Wildlife conservation plan
through State Forest Research & Training Institute, Raipur, Chhattisgarh. However, approval
obtained for the Wildlife conservation plan have not been made available. Project authority
informed that demand note dated 12/5/2022 was raised by the DFO Katghora for an amount of
Rs.100892517/-. PA informed that the said amount was deposited in the CAMPA account on
31/5/2022. However, details regarding implementation of the Wildlife conservation
plan have not been made available during the visit. Details regarding the commitments
made during the public consultations held and its implementation status are partly made
available by the PA, which is enclosed herewith as an Annexure-1a and Annexure-1b. Details
made available regarding CSR activities undertaken by the PA is enclosed as Annexure-2. As
informed no National Park/sanctuary, Ecologically Sensitive area is located within core and buffer
zone of the project. Reportedly, R&R involves 16 villages. However, based on the EC
letter 03/6/2009, it appears that R&R involves 20 Villages (12+8). PA partly
implemented the R&R. PA has not made available any valid documental proof
regarding R&R activities projected with total number of land oustees/ Project
Affected People/ Project Displaced People and present status of implementation
along with final awards passed by the of District Collector and implementation
schedule of remaining R&R activities with time frame.
6. Project Authority has obtained “Consent to Establishment cum Consent to Operate” from
the Chhattisgarh Environment Conservation Board (CECB) vide Order No.8688/TS/CECB/2023
Nava Raipur Atal Nagar, Raipur dated 15/3/2023 for the Coal Mining production of 52.5 MTPA
under Air and Water, Act which is valid for a period of one year from the date of issue of this
consent. Authorization under the Hazardous and Other Wastes (Management & Transboundary
Movement) Rules, 2016 has been obtained from the Chhattisgarh Environment Conservation

Board (CECB) vide Order No.6803/HSMD/HO/CECB/2020 Raipur, dated 02/11/2020, which is
valid till 21/11/2025. PA has not obtained Public Liability Insurance under Public
Liability Insurance Act, 1991. PA claimed that the condition is not applicable for
them on account of the Notification S.O.227(E) dated 24/3/1992. It was informed to
the PA that in the absence of amendment in the said EC condition, PA bound to

7. During the site visit, the project activity / mining operation was in progress. The above
project has been monitored by the undersigned on 23/11/2023 and 24/11/2023 in presence of
the Project Authority and the factual status regarding compliance on the stipulated conditions
contained in the EC letters dated 04/10/2004, 03/6/2009, 31/01/2014, 06/02/2015, 21/02/2018,
28/03/2019, 04/6/2020, 10/5/2021, 06/9/2022 and 23/8/2023 are furnished hereunder:
